Singer City Secretary T. Ray Kring Mayor Blackmon called the meeting to order. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Blackmon announced the purpose of the special meeting to hold public hearings on four zoning applications, and such other business as might properly come before the Council, and explained the procedure to be followed. Mayor Blackmon announced the public hearing on Application #567-1, J. M. Wilson, for change of zoning from "R -1B" One -family Dwelling District to "R-2" Two-family Dwelling District on Lots 13 through 18 inclusive, Block 6, Park Terrace, Unit 3. Larry Wenger, Senior City Planner, located the property on the map; pointed out the zoning and land use of the surrounding area, as being predominently single family dwellings, and stated that the property is presently vacant and faces on a sanitary fill area; stated that at the Zoning and Planning Commission hearing held on May 9, 1967, the applicant Mr. J. M. Wilson, had appeared and reviewed the history of this property stating that two previous applications had been made, but that both requests were denied; that neither the Federal Housing Administration nor the Veterans Administration will give loan commitments on the lots because they face a sanitary fill; that the four lots on the corner of Lavaca Drive and McArdle Road had been sold to a church, and that adjoining property owners were not satisfied with its appearance. Mr. Wenger stated that the Staff reported that 31 notices were mailed prior to the Commission hearing with one received in favor and none in opposition; that it was the recommendation of the Zoning and Planning Commission that the request be approved as submitted subject to deed restrictions being filed for record by the applicant, and that the Staff recommendation concurred with that of the Zoning and Planning Commission. Wilson, applicant, appeared in behalf of the request and stated that 26 property owners in the area who formerly opposed the zoning change had signed a petition withdrawing their objections provided deed restrictions are filed. Mr. Wilson further explained that if this request is granted he will file deed restrictions limiting this property to two-family dwellings. No one else appeared in favor or in opposition to the foregoing application. Motion by Bradley, seconded by Grant and passed that the hearing be closed. Motion by McDaniel, seconded by Bradley and passed that the recommendation of the Zoning and Planning Commission be concurred in and that Application #567-1, J. M. Wilson, for change of zoning from "R -1B" One -family Dwelling District to "R-2" Two-family Dwelling District on Lots 13 through 18 inclusive, Block 6, Park Terrace, Unit 3, be approved as submitted subject to deed restrictions being filed for record by the applicant, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application #567-2, William Stits, for change of zoning from "R-2" Two-family Dwelling District to "B-4" General Business District on Lot 1, Block 1, Dahlia Terrace. Larry Wenger presented the application and described the land use and zoning in and around the request area; stated that the property is presently zoned for duplexes; that at the Commission hearing held on May 9, 1967, Mr. William Stits had appeared representing Der Wienerschnitzel, Inc., and stated that the proposed operation is a national chain and pointed out that the subject property is an ideal location for the proposed establishment since it is at the intersection of two major streets, Ayers and Baldwin; presenfed a picture of the proposed building and site plan and explained that it also includes Lot 1, Block 10, Dahlia Terrace which has proper zoning, and stated that the plan will allow ample area for ingress and egress. Mr. Wenger stated that the Staff reported that prior to the Commission hearing, ten notices were mailed, one received in favor and one in opposition; that it was the recommendation of the Zoning and Planning Commission that the application be approved as submitted subject to a standard screening fence along the rear of the lot and a replat of both lots that are to be utilized, and that the Staff concurred in this recommendation. Minutes Special Council Meeting June 6, 1967 Page 3 Mr. William Stits of hbuston appeared in behalf of the application and stated that the one objection interposed at the Commission Hearing by Mrs. Joe E. Gomez, 2402 Winnie Street, was not, in fact, an objection but a misunderstanding as to the proposed location of the building and was concerned as to the effect the close proximity would have on her property. He further stated that they do not object to the requirements as to screening and is fully aware of the standard screening fence specifications. No one else appeared in favor or in opposition to the foregoing application. Motion by Bradley seconded by McDaniel and passed that the hearing be closed. Motion by Sizemore, seconded by Bradley and passed that the recommendation of the Zoning and Planning Commission be concurred in and that Application #567-2, William Stits, for change of zoning from "R-2" Two-family Dwelling District to "B-4" General Business District on Lot 1, Block 1, Dahlia Terrace, be approved as submitted subject to a standard screening fence along the rear of the lot and a replat of both lots that are to be utilized, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application #567-4, Bird Pontiac, Inc., for change of zoning from "B-1" Neighborhood Business District to "B-5" Primary Business District on Lots 10-8, 10-C & 10-D, Block 23, Windsor Park #4. Larry Wenger located the property on the map; pointed out the zoning and land use of the surrounding area as being predominently business uses and located at the corner of Lansdown and South Staples adjacent to Autotown, and stated that the subject property is presently zoned "B-1" Neighborhood Business District; stated that at the Commission hearing held on May 9, 1967, the applicant had stated that his business had been such that he is in need of additional area for a used car lot. Mr. Wenger stated that prior to the Commission hearing the Staff reported 12 notices were mailed, two received in favor and none in opposition; that no one had appeared in opposition, and that it was the recommendation of the Zoning and Planning Commission that the request be approved as requested, but informed the applicant of the 25 -foot building line which is shown on the plat of Windsor Park #4 which is filed for record, and that the Staff had recommended that the request be approved on Lot 10-B only with denial on Lots 10-C & 10-D on the basis that they face on a residential street and already have adequate zoning. Minutes Special Council Meeting June 6, 1967 Page 4 Mr. Stewart Bird, applicant appeared and stated that he also owned Lot 1, Block 3, Autotown, but that he felt this property would be more suitable for his used car lot operation and at the same time be convenient to his present business location; stated that he desires to have "B-5" Primary Business Zoning the same as Autotown. No one appeared in opposition to the foregoing application. Motion by Bradley, seconded by Jimenez and passed that the hearing be closed. Motion by Bradley, seconded by Grant and passed that the recommendation of the Zoning and Planning Commission be concurred in and that Application #567-4, Bird Pontiac, Inc., for change of zoning from "B-1" Neighborhood Business District to "B-5" Primary Business District on Lots 10-B, 10-C & 10-D, Block 23, Windsor Park #4, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application #567-5, Floyd A. Reeves & Lura V. Turner, for change of zoning from "R -1B" One -family Dwelling District to "A-2" Apart- ment House District, on the East 290 feet of Lot 17, Block 2, Alameda Estates. Larry Wenger presented the application; located the property on the map; pointed out the zoning and land use of the surrounding area, and stated that the property is presently occupied as a single-family use; stated that at the Commission hearing held May 9, 1967, Mr. Joseph Hans, architect had appeared and stated that his client, Dr. Roger Mills is buying the property from the applicants to erect an apartment complex. Mr. Wenger stated that the Staff reported 13 notices were mailed, three received in favor and one letter in opposition; that four persons had appeared favoring the request; that no one had appeared in opposition, and that it was the recommendation of the Zoning and Planning Commission that the request Jae approved as a logical buffer to the business zoning and subject to a proper plat, and that the Zoning and Planning Staff had con- curred in this recommendation. Mr. Joseph Hans appeared and presented a plan and explained in detail the proposed complex showing six buildings which will accomodate 44 living units; stated that this request would extend into Lot "A" of Alameda Center which is zoned "B-4" and would permit the erection of the proposed apartment complex; pointed out that apartment zoning has been granted across the street Minutes Special Council Meeting June 6, 1967 Page 5 and that this development would fit into the overall plan of the surrounding area. He further stated that his clients would cooperate with the adjacent property owners as to ingress and egress and that the plan would create a better traffic flow to the rear of the property. Mr, Robert R. Brodkey, 4118 Meridian, appeared and stated that he did not oppose the requested zoning but was concerned with the building lines, use of the alley for ingress and egress, and fence obligations. No one else appeared in connection with the foregoing zoning request. Motion by Sizemore seconded by Bradley and passed that the hearing be closed. Motion by Bradley, seconded by Grant and passed that the recommendation of the Zoning and Planning Commission be concurred in and that Application #567--5, Floyd A. Reeves & Lura Vo Turner, for change of zoning from "R -1B" One -family Dwelling District to "A-2" Apartment House District, on the East 290 feet of Lot 17, Block 2, Alameda Estates, be approved as a logical buffer to the business zoning and subject to a proper plat, and that an ordinance be brought forward effectuating the change. There being no further business to come before the Council, the .meeting was adjourned,
