Jimenez, Jr. Gabe Lozano, Sr. Ken McDaniel W. J. Roberts MINUTES CITY OF CORPUS CHRISTI, TEXAS SPECIAL COUNCIL MEETING October 3, 1967 2:00 p. m. City Manager Herbert W. Whitney Assistant City Attorney Bob Young City Secretary T. Ray Kring Mayor Jack R. Blackmon called the Special Meeting to order, and announced the purpose of the meeting to hold public hearings on five zoning applications, and such other business as might properly come before the Council; and explained the procedure to be followed. Mayor Blackmon announced the public hearing on Application #867-4, Mr. Sam W. Main, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District for one -family residences on Lot 13, Block 4, Gardendale No. 1. Larry Wenger, Senior City Planner, presented the application and described the zoning and land uses on the map; stated that it is presently a nonconforming use; explained that at the Commission hearing held August 29, 1967, Mr. Main, applicant, appeared on behalf of his application and explained to the Commission his proposed plans to add two additional one -family residences to the property which now has four single-family residences; presented a site plan for future development of the lot if his request is granted; and stated that the addition of the two proposed residences will still give 6,600 square feet of area per unit. Mr. Wenger stated that no one had appeared at the hearing in opposition; that the Staff reported 22 notices were mailed, one received in favor and none in opposition; that it was the recommendation of the Zoning and Planning Commission that the application be approved as requested on the basis that this is the best use for this tract because of the existing land uses in the area, and that the Staff's recommendation was that the application be denied on the basis that approval would tend to further break down an already deteriorating resi- dential area. Mr. Sam Main, applicant, appeared on behalf of his application, and pointed out that there is a trailer park immediately adjoining which has 15 mobile homes; that there exists other non- conforming uses in the area; stated that when he purchased the property it was in a very rundown Minutes Special Council Meeting October 3, 1967 Page 2 condition, grown up with weeds; and stated there is a need for this type of development; that there is no longer a need for these large lots; and staed that the structures will be something that can be moved onto the property with the City's approval. No one appeared in opposition to the foregoing application. Motion by Jimenez, seconded by Bradley and passed that the hearing be closed. Motion by Sizemore, seconded by McDaniel and passed that the recommendation of the Zoning and Planning Commission be concurred in and that Application 867-4, Mr. Sam W. Main, for change of zoning from "R -1B" One -family Dwelling District to "A -l" Apartment House District for two additional one -family residences on Lot 13, Block 4, Gardendale No, 1, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application #867-5, Mr. Venancio A. Villarreal, for change of zoning from "R -1B" One -family Dwelling District to "1-2" Light Industrial District for Light Welding Ornamental Iron Works on Lot 22, Block H, Las Palmas Subdivision. Larry Wenger located the property on the map; pointed out the zoning and land use of the area; explained that at the Zoning and Planning Commission hearing held August 29, 1967, Mr. Villarreal had appeared and explained that the lot is vacant and that he wanted to start a black- smith type metal workshop on it, perhaps on a temporary basis, until he can find employment, and that he had selected this location because he was familiar with the neighborhood and residents of this area. Mr. Wenger stated that no one appeared at the hearing in opposition; that the Staff reported that five notices were mailed, one received in favor and one in opposition; that it was the recommendation of the Zoning and Planning Commission that the application be denied on the basis that approval would tend to break down the residential character of the area and would have a deteriorating effect on the area to the South for future residential development, and the Staff con- curred in this recommendation. Mr. Tony Bonilla, attorney, representing the applicant, spoke in support of the application and stated that the area was better identified as Las Palmas; that the addition had been established several years ago but that there has not been a great deal of building activity since then; stated that the property is surrounded by vacant lots; that there are several business establishments operating Minutes Special Council Meeting October 3, 1967 Page 3 a short distance away, and that two of these are beer establishments and that there is one food store, and stated they they are operating on Special Council Permits. Mr. Bonilla stated that he is strongly urging the Council to overrule the recommendation of the Zoning and Planning Commission and approve the application to provide a livelihood for his client. Mr. Bonilla stated that his client had initially indicated to the Zoning and Planning Commission that the request is on a temporary basis, but that further conversation with him had revealed that the time will depend on the success of the business. Mr. Bonilla further stated that a special Council Permit would be acceptable to his client. No one appeared in opposition to the foregoing application. Motion by Bradley, seconded by Roberts and passed that the hearing be closed. Motion by Sizemore, seconded by McDaniel and passed, that action on the foregoing applica- tion be tabled for two weeks for further consideration. Mayor Blackmon announced the public hearing on Application #867-6, Mrs.. Lena Marie Jackson, for change of zoning from "B-4" General Business District to "1-2" Light Industrial District for the construction of light portable buildings on a 1.12 acre tract lying Southwest of Texas State Highway No. 9 and having a frontage thereon of 200 feet and a depth of 254 feet. Larry Wenger located the property on the map; pointed out the zoning and land use of the area; stated that at the Zoning and Planning Commission hearing held August 29, 1967, Mr. W. D. Emmert, building contractor, had appeared on behalf of Mrs. Jackson, and explained that the request was to permit him to assemble portable metal buildings on the property. Mr. Wenger stated that the Staff reported that five notices were mailed, one was returned in favor and none in opposition; that no one had appeared at the hearing in opposition; that it was the recommendation of the Zoning and Planning Commission that it be denied on the basis that industrial zoning should not be allowed to develop along the entrance to the City and it would also have a deteriorating effect on the surround- ing area, and that the Staff had concurred in this recommendation. Mr. Emmert was present and spoke on behalf of the request; described the type of buildings proposed to be assembled; stated that the buildings are not manufactured on this location, but are constructed and hauled in here; pointed out that this is money being spent out of town which could be kept here; stated that there will not be an accumulation of lumber on the premises; that residents Minutes Special Council Meeting October 3, 1967 Page 4 of the neighborhood are not opposed; that he is not specially interested in "1-2" zoning but mainly wants a permit to fabricate buildings on the scene; that he had applied for a permit for such con- struction and was advised that he could not operate this type of business under "B-4" zoning; stated that he is not particularly interested in "1-2" zoning, but would like to have some kind of permit to fabricate these buildings on the premises, otherwise he would have to apply for a permit for each building separately. Mr. Emmert stated that the back portion of the property is a creek bottom about 1/4 mile from the tract and that the entire area is not suitable for any other development. Mr. Bob Dixon, 11218 Leopard Street, appeared and stated that he was the owner of the property which Mr. Emmert referred to as creek bottom land; and with reference to the opposition on the basis that Leopard Street is an entrance to the City, stated that Leopard Street is a secondary entrance to the City, as the new Expressway 37 is now the main entrance; stated that he did not believe the proposed operation would be detrimental to the area, and urged the Council to overrule the recommendation of the Zoning and Planning Commission and grant the request. No one appeared in opposition to the foregoing request. Motion by Bradley, seconded by Jimenez and passed that the hearing be closed. Motion by Bradley,secondedby Robertsand passed, Jimenez abstaining, that Application #867-6, Mrs. Lena Marie Jackson, for change of zoning from "B-4" General Business District to "I-2" Light Industrial District be denied, but that a Special Council Permit be granted for the fabrication of light portable buildings on a 1 .12 -acre tract lying Southwest of Texas State Highway No. 9, having a frontage thereon of 200 feet and a depth of 254 feet, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application #867-7, Mr. Raul Rodriguez for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District for a Photographic Studio on Lot 22, Block 1, Rosemary Place. Larry Wenger located the property on the map; pointed out the zoning and land use of the surrounding area; stated that at the Commission hearing held on August 29, 1967, Mr. Gilbert Mora, Realtor, appeared on behalf of the applicant and stated that Mr. Raul Rodriguez wishes to use the property for a photography shop but that it would be maintained as residential; stated that it faces Minutes Special Council Meeting October 3, 1967 Page 5 Gollihar Road which is a major commercial street, and that it is in a state of transition to business uses. Mr. Wenger stated that Mr. Ed Harris, 4522 Christie; Mr. George D. Morgan, 4517 Christie, and Mr. M. J. Browder, 4502 Christie, had appeared in opposition generally on the basis that it would create traffic problems, and that it will destroy the residential character of the neighborhood. Mr. Wenger further stated that Mr. Morgan had presented a petition to the Commission containing 25 signatures in opposition to the request; that the Staff reported that 27 notices were mailed, one received in favor and nine in opposition; that it was the recommendation of the Zoning and Planning Commission that the application be denied on the basis that it would have a deteriorating effect on the surrounding residen- tial area, plus it would tend to encourage strip zoning along Gollihar Road, which is already a heavily used and congested major artery, and that the Staff had concurred in this recommendation. No one appeared in opposition. Mr. Gilbert Mora, representing the applicant, appeared and stated that because of the opposition expressed from area residents, Mr. Rodriguez wishes to withdraw the application, but suggested that a traffic signal light be installed at the intersection of Gollihar and Christie Streets. Mayor Blackmon announced the public hearing on Application #867-8, Mr. Chuck Stone, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on a portion of Lot 2, Oso Farm Tracts, being also known as a portion of Block 2, Gray Village #2, located on the Southwest corner of the Intersection of McArdle Road and Everhart Road extending 186.4' in a Southwesterly direction along Everhart Road and 277' in a Northwesterly direction along McArdle Road. Larry Wenger presented the application; described the zoning and land use of the area; ex- plained that at the Commission hearing held August 29, 1967, Mr. Stone appeared and explained his request stating that he planned to use the property for several small free-standing business buildings, which would include an ice cream parlor, donut shop, service station, washateria, etc.; stated that he had made an extensive study of what he believed was happening to Everhart Road from a land use standpoint, and presented pictures of the property. Mr. Wenger stated that Mr. Ralph Bennett, architect; Mr. Joe McManus, realtor; and Mr, John Thomason, realtor; had spoken in support of the application generally on the basis that the subject property would not be suitable for residential use, Minutes Special Council Meeting October 3, 1967 Page 6 and that this particular type of development would be an asset to the neighborhood; stated that Mr. Joe Cox, 4701 Alice Street, and6 othermembers of Trinity Baptist Church; Mr. Gordon W. Kliazke,4906.: Mildred, Mrs..VernonLia ingston, 4915Evsrhart,Mr..Allen Merrion, 4926 Arlene; The Vice President of the Parkdale Elementary School; Mr. Eddie Mycum, Assistant Pastor of the Trinity Baptist Church; and Mr. Eddie Payne, appeared in opposition on the basis that it would be a hazard to school children; that there is not a need for more business uses in this area; would interfere with the church services. Mr. Wenger stated that the Staff reported 26 notices were mailed, five received in favor and three in opposition; and that it was the recommendation of the Zoning and Planning Commission that it be denied, but that in lieu thereof "AB" Professional Office District be approved,and that the Staff recommended that it be denied. Mr. Joe McManus, realtor spoke on behalf of the applicant, and stated that he feels the character of the area would lend itself properly to "B-1" zoning; explained that churches and small business are compatible, and that he felt most of those opposing the request objected to the proposed ice cream parlor. Mr. McManus stated that the applicant would accept "AB" zoning and would be willing to change the design and character of the proposed buildings to fit into "AB" type of zoning should the Council decide to concur in the recommendation of the Zoning and Planning Commission. Mr. Joe Cox, spoke on behalf of members of the Trinity Baptist Church and stated that it had been agreed that the Church would not oppose "AB" zoning. Motion by Bradley, seconded by Jimenez and passed that the hearing be closed. Motion by Lozano, seconded by Jimenez, and passed that the recommendation of the Zoning and Planning Commission be concurred in and that Application #867-8, Mr, Chu Stone, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District ona por- tion of Lot 2, Oso Farm Tracts, being also known as a portion of Block 2, Gray Village 02, located on the Southwest corner of the Intersection of McArdle Road and Everhart Road extending 186.4' in a Southwesterly direction along Everhart Road and 277' in a Northwesterly direction along McArdle Road, be denied, but that in lieu thereof "AB" Professional Office District zoning be approved, and that an ordinance be brought forward effectuating the change. There being no further business to come before the Council, the Special meeting was adlourned.
