Ray Kring Mayor Blackmon aa.1ied the Special Meeting to order and stated that the purpose of the meeting was to hold public hearings on five zoning applications and any other business as may properly come before the Council. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Blackmon announced the public hearing on Application #1167-1, Mrs. Genergsa Vasquez, for change of zoning from "R -1B" One-fpmiiy Dwelling District to "B-4" General Business District to set up a hurricane fence company that will stock, sell and install hurricane fences, on Lot 15, Block 1, Casa Blanca Addition, and explained the procedure to be followed. Larry Wenger, Senior City Planner, located the property on the map; pointed out the land use of the surrounding area; stated that at the Commission hearing held November 7, 1967, Mr. Gil Garza, attorney, had represented the applicant and stated that Mrs. Vasquez wished to establish a hurricane fence company on the sub- ject property which will sell, install and display fence materials. Mr. Wenger stated that one person had appeared in opposition and one in favor; that the staff reported that prior to the Commission hearing, 29 notices were mailed, and that none were received in favor nor in opposition; stated that it was the recommendation of the Zoning and Planning Commission that the application be denied, but in lieu thereof a Special use Permit be granted for the operation of a fence sales office with no warehouse or storage facilities, and subject to all the regulations of "B-1" Neighborhood Business District, and that the Staff had recommended that the application be denied on the basis that there is already sufficient business zoning in the area. Mr. F. L. Villnwreal, 3045 Eisenhower, appeared and spoke in opposition stating that it had been the experience in the past that people apply for zoning for a specified use, and that after such zoning is granted, they decide on another Mimites Special Council Meeting December 18, 1967 Page 2 use that is permitted under the same zoning. Mr. Villarreal stated that he would not oppose the Special Council Permit as recommended by the Zoning and Planning Commission if he could be assured that it would only be used for a fence company and not changed to a "beer joint" later. Mrs. Frank Greer, 3105 Greenwood Drive, spoke in opposition, but when ques- tioned by Mayor Blackmon, stated that she would not be opposed to the Special Permit as recommended by the Zoning and Planning Commission if it were restricted to this use only. Mr. Wenger stated that Mr. Garza had stated at the Commission Hearing that the applicant would be satisfied with a Special Permit for the fence company only, and that if "B-4" zoning could not be recommended as requested, a Special Permit would be satisfactory. Motion by Lozano, seconded by Sizemore and passed that the hearing be closed. Motion by Lozano, seconded by Bradley and passed, that the recommendation of the Zoning and Planning Commission be generally concurred in, and that Applica- tion #3167-1, Mrs. Generosa Vasquez, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District to set up a hurricane fence company that will stock, sell and install hurricane fences, on Lot 15, Stock 1, Casa Blanca Addition, be denied, but in lieu thereof a Special Use Permit be granted for the operation of a fence sales office with no warehouse or storage facilities, subject to all the regulations of "B-1" Neighborhood Business District zoning; that the ordinance specify the amount of display to be worked out between the Legal Depart- ment and Zoning and Planning Staff, and that an ordinance be brought forward effectuating the Special Permit. Mayor Blackmon announced the public hearing on Application #1167-2, Margarito C, Salvador G., and Gil C. Garza, Jr., for change of zoning from "R -1B" One -family Dwelling District to "A-2" Apartment House District to build seven apartment units on the South 1/2 of Lot 1, Block 21, Meadow Park Addition. Larry Wenger located the property on the map; pointed out the land use of the surrounding area; stated that at the Commission hearing held November 7, 1967, Mr. Gil C. Garza, attorney, had appeared on behalf of the application and stated that at present there are approximately seven separate delapidated units on the lot Minutes Special Council Meeting December 18, 1967 Page 3 which is 50' x 150' in size; explained that they plan to tear down the existing units and build a new apartment intended to upgrade the property, and stated that all city codes and ordinances pertaining to apartment structures will be complied with. Mr. Wenger stated that no one had appeared in opposition; that the Staff reported that 24 notices were mailed, one was received in favor and none in opposition; that it was the recommendation of the Zoning and pisnntng Commission that the application be ap- proved as requested, and that the Staff had recommended denial on the basis that this area is not of sufficient size to accommodate the proposed use. No one appeared to speak on behalf of the foregoing application. Motion by Bradley, seconded by McTh niel and passed, that the hearing be closed. Motion by MoDsniel, seconded by Roberts, with Bradley, Jimenez, Lozano and Sizemore voting "hay" that Application #1167-2, Margarito 0., Salvador G. and Gil C. Garza, Jr., for change of zoning from "R -1B" One -family Dimtitng District to "A-2" Apartment House District to build seven apartment units, on the South 1/2 of Lot 1, Block 21, Meadow Park Addition, be denied, but in lieu thereof a Special Permit be granted to build four apartment units, subject to all other requirements of "A-1" zoning. Mayor Blackmon declared the foregoing motion had failed to pass for lack of majority vote. Motion by Jimenez, seconded by Sizemore and passed, with Bradley, Jimenez, Sizemore, Lozano and Blackmon, voting "Aye" and Roberts and McDaniel voting "Ray", that Application #1167-2, Margarito C., Salvador G. and Gil Garza, Jr., for change of zoning from "R -1B" One -family Dwelling District to "A-2" Apartment House District to build seven apartment units on the South 1/2 of Lot 1, Block 21, Meadow Park Addition, be denied, but in lieu thereof a Special Permit be granted to build a maximum of seven apartment units, subject to all other requirements of "A-2" zoning, and pro- vided further that no amendment or modification to said permit shall be made by any Other municipal board or agency, and that an ordinance be brought forward effectuating the special permit. Mayor Blackmon announced the public hearing on Application #1167-3, Mr. Edgar Linkenhoger, for change of zoning from "R -1B" One-fAmily Dwelling District to "B-4" General Business District for a service station on a portion of Tract 1 of State Survey 422, Abstract 450, located on the Southwest corner of Rand Morgan Minutes Special Council Meeting December b 18, 1967 Page Road and Interstate Highway #37. Larry Wenger located the property on the map and described the land uses of the surrounding area; stated that at the Commission hearing held November 7, 1967, Mr. Garnett T. Brooks appeared on behalf of the applicant and explained that Mr. Linkethoger proposed to erect a service station on the subject property, and stated that the location at the intersection of Rand Morgan and UpRiver Roads adjacent to Interstate #37, eras an ideal site for the operation of a service station. Mr. Wenger stated that the Staff reported that four notices were mailed, two received in favor and none in opposition; that no one had appeared at the hearing in opposition; and that it was the rec:Emendation of the Zoning and P7nnnin8 Commission that the appli- cation be approved subject to a proper plat, and that the Staff concurred in this recommendation. Motion by Jimenez, seconded by Bradley and passed that the hearing be closed. Motion by Sizemon;,seconded by Roberts and passed, that the recommendation of the Zoning and Planning Commission be concurred in and that Application 11167-3, Mr. Edgar Tinkenhoger, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District for a service station on a portion of Tract 1 of State Survey 422, Abstract 450, located on the Southwest corner of Rand Morgan Road and Interstate Highway #37, be approved, subject to a proper plat, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application 11167-4, David H. Janecek & Others, for change of zoning from "AT" Apartment -Tourist District to "B-2" Bayfront Business District on Lots 85, 86, 87, 100, 101 & 102, Block 1, Corpus Christi Beach Hotel Addition. Larry Wenger pointel out the location on the land use map and described the zoning of the surrounding area; stated that at the Zoning and Planning Commission hearing held on November 7, 1967, Mr. Bob Sorrell, Jr., attorney representing the applicants, bad stated that Lots 85, 86 and 87, were owned by Lloyd A. Adams, that Lots 101 and 102 were owned by Sara Jane Wilson, and that Lot 100 was owned by Elizabeth Ann McKibben, all of which had joined in the application; stated that the existing building had suffered damage from Hurricane Beulah, and that the appli- cants plan to rebuild and enlarge the grocery store on Lots 85, 86 & 87 which will Minutes Special Council Meeting December 18, 1967 Page 5 improve the appearance of the properties. Mr. Wenger state& that four persons had appeared at the Commission hearing in favor of the request and that no one had appeared in opposition; stated that the Staff reported 13 notices were mailed, five, including one after the hearing, were received in favor and none in opposition, and that the recommendation of the Zoning and Planning Commission was that the applica- tion be approved as requested, and that the Staff concurred in this recommendation. Mr. Bob Sorrell, Jr., attorney representing the applicants, was present in support of the application. No one appeared in opposition to the foregoing request. Motion by Bradley, seconded by Sizemore and passed, that the hearing be closed. Motion by Sizemore, seconded by Roberts and passed, that the recommendation of the Zoning and Planning Commission be concurred in and that Application #1167-4, David H. Janacek 84 Others, for change of zoning from "AT" Apartment -Tourist District to "B-2" Bayfront Business District on Lots 85, 86, 87, 100, 101 m 102, Block 1, Corpus Christi Beach Hotel Addition, be approved as requested, and that an ordinance be brought forvard effectuating the change. Mayor Blackmon announced the public hearing on Application #1167-5, Dr. Martin Pigott & Mr. V. H. Gehlbach, for change of zoning from "A-1" Apartment House District to "B-1" Neighborhood Business District for office buildings on Lot C-2 and a portion of Lot D-1, J. E. Habluetzel Tract. Larry Wenger described the zoning on the land use map and pointed out the zoning of the surrounding area; stated that at the Commission hearing held on November 7, 1967, Dr. Pigott had appeared in behalf of the application and explained to the Commission that it was Mr. Gehlbach's plans to construct an office building on his property, but that he, himself, did not have any plans at the present time; that it was their opinion that the subject property was better suited for "B-1" use and would make a better investment for the owners than the existing apartment zoning. Z. Wenger stated that no one bad opposed the request at the hearing; stated that the Staff reported 20 notices were mailed, none were received in favor nor in oppo- sition; that it vas the recommendation of the Zoning and Planning Commission that the application be denied, but in lieu thereof "AB" Professional Office District Minutes Special Council Meeting December 18, 1967 Page 6' be approved, and that the Staff concurred in this recommendation. No one appeared in favor or in opposition to the fO going application. Motion by Bradley, seconded by Sizemore and passed, that the recommendation of the Zoning and planning Commission be concurred in and that Application 1167-5, Dr. Martin Pigott and Mr. V. H. Gehlbach, for change of zoning from "A,,1" Apartment House District to "B-1" Neighborhood Business District for office buildings, on Lot C-2 and a portion of Lot D-1, J. E. Habluetzel Tract, be denied, but in lieu thereof "AB" Professional Office District be approved, and that an ordinance be brought forward effectuating the change. Motion by McDaniel, seconded by Sizemore and passed, that City Manager Whitney be directed to write a letter to Congressman John Young expressing the concern and intereet of the City Council of the matter of Corpus Christi Beach Erosion Study, and asking for his aid for the expeditious resolving of this matter. There being no further business to come before the Council, the Special meeting was adjourned.
