SPECIAL COUNCIL MEETING
December 19, 1967

Mayor Blackmon called the Special Meeting to order and stated that the
purpose of the meeting was to hold public hearings on five zoning applications
and any other business as may properly come before the Council.
City Secretary T. Ray Kring called the roll of those in attendance.
Mayor Blackmon announced the public hearing on Application #1167-6, Dr.
Lay C. Reid, for change of zoning from "AB" Professional Office District to "B-1"
Neighborhood Business District for a professional office and a small antique shop
on Lot 11, Block 5, Sherwood Park No. 1.
Larry Wenger, Senior City Planner, located the property on the map; pointed
out the zoning and land use of the surronnAing area; stated that at the Commission
hearing held on November 21, 1967, the applicant, Dr. Loy C. Reid, had appeared
and stated that he plans to remove the existing residential structure from the
property and build a 2,000 square foot area for office space; that he has a
prospective lessor for some of the space for an antique shop provided the "B-1"
zoning is granted; and stated that the structure would be of a residential type
with no outward indication of a business. Mr. Wenger stated that prior to the
Commission hearing the Staff reported that 27 notices were mailed, none were
received in favor and one in opposition, and that it was the recommendation of the
Zoning and P]A.nning Commission that the request be denied on the basis that "AB"
Professional Office District is adequate and that 5B-1" would create spot zoning,
and that the Staff concurred in this recommendation.
At this point a question was raised by Commissioner Jimenez as to the
type notices which are mailed to property owners of the Zoning and Planning Com-
mission meetings, which he stated could account for the lack of interest shown in
zoning hearings, and on request of Commissioner Jimenez, Mr. Wenger produced a copy
of the type of notice which is mailed to property owners, and stated that the

matting list is obtained from the Tax Office. He further explained that the notice
is published three times in the local newspaper, plus a courtesy notice mailed of
the hearings before the City Council. It was determined that the requirements of
the State Statutes and City Charter are being fully complied with in this regard.
No one was present either in favor or in opposition to the foregoing appli-
cation.
Motion by Bradley, seconded by Sizemore and passed, that the hearing be
closed.
Motion by McDaniel, seconded by Roberts and passed, that the recommendation
of the Zoning and Planning Commission be concurred in and that Application #1167-6,
Dr. Loy C. Reid, for change of zoning from "AB" Professional Office District to
"B-1" Neighborhood Business District for a professional office and a small antique
shop, on Lot 11, Block 5, Sherwood Park No. 1, be denied, on the basis that "AB"
Professional Office District is adequate and that "B-1" would create spot zoning.
Mayor Blackmon announced the public hearing on Application #1167-7, Mr.
L. E. Turcotte, Jr., for change of zoning from .1R-12" One -family Dwelling District
to "AB" Professional Office District for the construction of office building, or
buildings, on the Northeasterly 54 feet of Lot U and all of Lot V, Lexington Place.
Mr. Wenger located the property on the map; pointed out the zoning and
land use of the surrounding territory; stated that at the Commission hearing held
November 21, 1967, the applicant had appeared and stated that he proposed to build
a 60 -bed nursing home on the subject property if the zoning is approved; stated
that he had contacted residents in the area and that they were all in favor of his
request with the exception of one. Mr. Wenger stated that one person had appeared
at the hearing in favor and one in opposition; that prior to the Commission hearing,
the Staff reported 14 notices were mailed, one was received in favor, and none in
opposition, but that a petition with four names in favor, and one notice in opposi-
tion, was received at the public hearing. Mr. Wenger stated that it was the recom-
mendation of the Zoning and, Pl.nning Commission that the request be approved, and
that the Staff concurred in this recommendation.
The applicant, Mr. Turcotte, Jr, spoke in support of the application and
stated that he had nothing specific to add to Mr. Wenger's presentation, but added

that construction would be begun right after the first of the year; that the pro-
posed facility would create approximately 16 new positions, and presented a petition
containing 5 signatures in favor of the request.
Mr. Don Erwin, representing the South Park Manor Nursing Home, spoke in favor
of the proposed development, stating that there is a definite need for more of this
type service in the City, and that his establishment welcomes the competition of
another such home neat door.
Mr. W. H. Stahl, 44901 Kostoryz, appeared in opposition and read a written
statement to the Council setting out reasons for his opposition. Mr. Stahl filed
the statement with the City Secretary for record.
Motion by Bradley, seconded by Mcn"niel and passed, that the hearing be
closed.
Motion by Jimenez that the foregoing application be tabled for further con-
sideration. The motion failed for lack of a second.
Motion by McDaniel, seconded by Roberts and passed, with Jimenez abstaining,
that the recommendation of the Zoning and Punning Commission be concurred in and
that Application #1167-7, Mr. L. E. Turcotte, Jr., for change of zoning from "R -1B"
One -family Dwelling District to "AB" Professional Office District for the construc-
tion of office building, or buildings, on the Northeasterly 54 feet of Lot U and
all of Lot V, Lexington Place, be approved, and that an ordinance be brought for-
ward effectuating the change.
Mayor Blackmon announced the public hearing on Application 01167-8, The
Loyal order of Moose Lodge, for change of zoning from "R -1B" One -family Dwelling
District to "B-4" General Business District for lodge purposes, on a portion of
Lots 1 and 2, Section 30 and a portion of Lot 9, all of Lot 10, Section 31, Flour
Bluff & Encinal Farm & Garden Tracts, having 29.31 acres fronting on Padre Island
Drive.
Larry Wenger presented the application; pointed out on the map the zoning
and land use of the surrounding area; stated that at the Commission hearing held
on November 21, 1967, Mr. Toufic Nicolas, attorney representing the applicant, spoke
in support of the request, and named several officials of the Lodge who were in
the audience in support of this application; explained that the present facilities
for the Moose Lodge were inadequate, and that their plans were to construct a new

facility costing approximately $100,000. Mr. Wenger stated that Mr. Lawrence Berger
and W. John Thomason spoke in favor of the request, and that no one had appeared
in opposition; that the Staff reported that 10 notices were mailed, none were received
for nor against; that it was the recommendation of the Zoning and Planning Commission
that the application be denied, but in lieu thereof a Special Permit be granted for
a fraternal lodge hall and its accessory uses subject to a site plan to be approved
by the Planning Staff and a proper plat, and that the Staff had recommended denial
on the basis that there is no need for this zoning in this area at this time.
Mr. Toufic Nicolas, attorney, spoke on behalf of the applicant and assured
the Council that they plan to use the property for lodge purposes and accessory uses
only such as swimming pool and some playground equipment; stated that they are con-
cerned with whether or not the Council can issue a permit subject to a site plan if
the applicants do not develop the tract before a three-year period. He further
stated that the recommendation of the Zoning and Planning Commission is satisfactory
with the applicant, if authority can be granted to build. later, as they are under
contract to purchase subject to the zoning cra*ige.
Mr. Nicolas introduced other Lodge Officials who were in favor of the
application.
Mr. John Thomason, realtor, spoke in favor of the request and verified the
applicant's intentions to develop the subject tract for lodge purposes only.
Ro one else appeared to speak in connection with the foregoing request.
Motion by Bradley, seconded by Sizemore and passed, that the hearing be
closed.
Motion by Sizemore, seconded by Roberts and passed, that Application #1167-8,

"AB" Professional Office District for a beauty shop on Lot 19, Block C, Reynolds
No. 1 Addition.
Larry Wenger presented the application; located the property on the map;
pointed out the zoning and land use of the surrounding area; stated that at the Zoning
and Pl nnin.g Commission hearing held November 21, 1967, Mr. Lawrence Berger, attorney
representing the applicant, stated that Mrs. Harper was a reputable beautician and
that a beauty shop is needed in the immediate neighborhood; that adequate off-street
perking is available, and that this use would not create a nuisance or adversely
affect adjacent properties. Mr. Wenger stated that no one had appeared in opposition;
that the Staff reported 38 notices were mailed, two received for and one in opposi-
tion; that it was the recommendation of the Zoning and Planning Commission that the
application be denied, but in lieu thereof a Special Permit be granted for a two-
ohaiw beauty shop with no outdoor advertising other than one sign limited to one
aware foot in area, and that the Staff recommended that it be denied on the basis
that it would tend to break down the character of the neighborhood and also create
spot zoning.
No one appeared in connection with the foregoing application.
Motion by Sizemore, seconded by McDaniel, with Blackmon, Bradley, Lozano
and Jimenez, voting "Nay," and Sizemore, McDaniel and Roberts voting "Aye," that
Application #1167-9, Mrs. George Harper, be denied. Mayor Blackmon declared the
motion had failed to pass for lack of majority vote.
Motion by Jimenez, seconded by Lozano and passed, with Bradley, Jimenez,
Sizemore and Lozano voting "Aye," and Roberts and McDaniel voting "Nay," that
Application #1167-9, Mra. George Harper, for change of zoning from "R -1B" One -family
Dwelling District to "AB" Professional Office District for a beauty shop on Lot 19,
Block C, Reynolds No. 1 Addition, be denied, but in lieu thereof a Special Permit
be granted for a period of two years for a two -chair beauty shop with no outdoor
advertising other than one sign limited to one square foot in area, and that an
ordinance be brought forward effectuating the Special Permit,
Mayor Blackmon announced the public hearing on Application #1167-11, Mr.
Jack Maddux, for change of zoning from "R -1B" One -family Dwelling District to "B-1"
Neighborhood Business District for reconstruction of the Oso Fishing Pier with

accessory retail uses on the Southwest corner of Lot 10, Section 16 of the Flour
Bluff & Enoinal Farm & Gardenn Tracts, containing .74.7 acres fronting on Ocean Drive.
Larry Wenger presented the application; pointed out the location on the
zoning and, land use map; stated that at the Commission hearing held. on November 21,
1967, Mr. Richard, Hatch, attorney representing the applicant, appeared and stated
that his client wished to reconstruct the Oso fishing Pier which was destroyed by
Hurricane Beulah; explained that this business was a nonconforming use since it
vas in operation at the time it was annexed into the City, and that he was applying
for proper zoning in order to provide accessory retail uses for the fishing pier,
and that tubas; opinion this request would be a logical extension of zOPinE. Mr.
Wenger stated that Mr. F. A. Petty, 6026 Edgewater, and Dr. H. H. Hildebrand of
the University of Corpus Christi, appeared in favor of the piers because of their
tourist attraction to this area, anc. stated that no one had appeared in opposition.
He further stated that prior to the Commission hearing, the Staff reported that Your
notices Were mailed, two were received in favor, none in opposition, and that a
Petition was received at the public hearing containing five signatures of property
in the area
owners /who were in favor of the request; stated that it was the recommendation of
the Zoning and Planning Commission that the application be approved on the land
area only subject to the installation of adequate off-street parking; that a
Special permit be approved on the water area for reconstruction of the fishing
pier, and that the Staff had concurred in this recommendation.
Mr. Jack Maddux, applicant, appeared, and stated that he vas aware of the
recommendation of the Zoning and Planning Commission and that it was acceptable to
him,
Dr. B. H. Hildebrand, spoke in support of the request and stated he favors
the construction of the proposed piers generally because of their tourist attrac-
tion to this area,
No one else appeared in connection with the foregoing application.
Motion by Bradley, seconded by Jimenez and passed, that the hearing be
closed.
Motion by Jimenez, seconded by Sizemore and passed, that the recommenda-
tion of the Zoning and Planning Commission be concurred in and that Application
#1167-11., Mr, Jack Maddux, for change of zoning from "R -1B" One -family Dwelling

District to "B -l" Neighborhood Business District for the construction of the Oso
Fishing Pier with accessor ' retail uses, on the Southwest corner of Lot 11, Section
16 of the rlour Bluff & Bhcipal Parra & Garden Tracts, containing ,71t7 acres fronting
on Ocean Drive, be approved on 'the land area only of the request subject to the in-
stallation of adequate off-street parking, and that a Special Permit be approved on
the water area for reconstruction of the fishing pier according to pians submitted
and on fi1,e in the office of Zoning and Planning, and that an ordinance be brought
forward effectuating this action.
There being no further business to cane before the Council, the Special
meoting was adjourned,.
