Blackmon called the meeting to order, and stated that all members of the Council were present, except for Mr. Roberts. Mayor Blackmon stated that any application must have two public hearings; one by the Planning Commission and one by the City Council. The Planning Commission only makes a recommendation to the Council. Until the Council receives the agenda for a hearing, they do not know which cases are to be heard, and therefore, have no previous knowledge of what has been said at the Commission hearing. Mayor Blackmon announced the public hearing on Application #868-10, Mr. and Mrs. Frank P. Blalock, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District, on a portion of Lot "Q", Travis Addition, Unit 3, located on the Southwest corner of the intersection of Carroll Lane and Dolraida Drive, having 100 feet on Carroll Lane and siding 150 feet on Dalroida Drive.. Senior City Planner Larry Wenger presented the application; pointed out the location on the zoning and land use map, and described the zoning classifications in the surrounding area. He explained that the property comer is vacant, but part of the lot has a residence and garage on it; most of the area is in single-family use, and that the entire area is zoning "R -1B" with a few exceptions. He stated that at the Commission hearing held August 20, 1968, the Applicant was represented by Mr. Scott Cook, Attomey, who stated that they propose to construct a drive-in grocery type of business. At the hearing two people spoke in favor of the drive-in grocery and stated it would be an asset to the community; The only v ;position to this zoning was Mrs. keno hs, who Minutes Special Council Meeting September 16, 1968 Page 2 lives on nearby property owned by her son. She wrote that her son does not approve any type business zoning in this area. Mr. Wenger quoted Mr. Cook as stating that the son lives in another state and cannot be contacted for any discussion; further stated that the woman is in her seventies and would probably benefit from this drive-in grocery as she now must walk the seven blocks to the nearest grocery. A petition containing 45 names was presented at the Commission hearing. A previous request for change of zoning on this same property was denied in September, 1967. Prior to the hearing 12 notices were mailed out, four received in favor and one against. There was no opposition at the hearing, and the recommendation of the Planning Commission was that it be denied, but in lieu thereof, a Special Permit be granted for a drive-in grocery with the requirement that the nonconsumption of alcoholic beverages on the premises be enforced. Attorney Cook, representing the Applicant, stated that this zoning case was resubmitted because of the neighbors wanting this type of business. The neighbors stated that "spot" zoning is not undesirable in this area as they do need the drive-in grocery. Three petitions were presented to the Council with a total of 48 names. The property must be platted according to Staff recommendations which Attorney Cook said would be done. The Carroll Lane Elementary School had not expressed themselves in any way. Appearing in favor of the Applicant were Mrs. H. W. Riner, 3429 Browner Parkway; Mrs. E. G. Byers, 3613 Dalraida; Mrs. R. B. Vogel, 3645 Dalraida; and Mrs. J. W. Coker, 4229 Carroll Lane. No one else appeared at the hearing in regard to the foregoing request. Motion by Bradley, seconded by Sizemore, and passed that the hearing be closed. Motion by Bradley, seconded by McDaniel, and passed that the request be tabled for further discussion at Workshop meeting. Mayor Blackmon announced the public hearing on Application 0868-7, Mr. C. C. Speed and Mr. Randal G. Stivers, Jr., for change of zoning from "R-113" One -family Dwelling District to "B-1" Neighborhood Business District, on Lots 11 and 12, Block 16, Meadow Park Addition. mutes Special Council Meeting September 16, 1968 Page 3 Senior City Planner Larry Wenger presented the application; pointed out the location on the zoning and land use map, and described the zoning classifications in the surrounding area. He explained that the property is vacant; the area is predominantly residential, with little business zoning. He stated that at the Commission hearing held August 20, 1968, Mr. Speed stated that he felt that the best use of the property would be Neighborhood Business. Two appeared in opposition reasoning that this area is residential and would like for it to remain as such. Prior to the hearing 34 notices were mailed, one received in favor, and two in opposition. The recommendation of the Planning Commission is that it be denied on the basis that the existing zoning is adequate. *Dr. Jimenez departed. There was some discussion among the Council as to the intersection problem at the comer of Osage and Huron Streets, and straightening out this street. City Manager Townsend and Mayor Blackmon stated that this was an entirely differentproblem and not related to the zoning case. No one appeared for or against the zoning case. City Manager Townsend read a letter from Mr. Speed and Mr. Stivers in regard to this case, stating the application was made because the City Right of Way Department and theCity Engineering Department expressed to them a strong desire to acquire a portion of their property to enable them to straighten out a bad offset at the intersection of Huron and Osage. It was also stated that since the property is vacant, the public uses it in crossing the corner. Motion by Bradley, seconded by Sizemore and passed, that the hearing be closed. Motion by Bradley, seconded by Lozano and passed, that the Council concur with the Planning Commission and deny this request. Mayor Blackmon announced the public hearing on Application #868-8, Mr. W. H. Hammonds, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District, on 8.21, plus or minus, acre portion of Lots 12 and Section 13, 13,/Flour Bluff and Encinal Farm and Garden Tracts, and a portion of Lot 7, Wilkey Addition, fronting 750', plus or minus, on Williams Drive, approximately 232' west of Airline Road. Minutes Special Council Meeting September 16, 1968 Page 4 Senior City Planner Larry Wenger presented the application; pointed out the location on the zoning and land use map; and described the zoning classifications in the surrounding area, which is residential and business.. He explained that there are businesses on Padre Island Drive, a junior high school, an industrial wrecker service and junk yard, and some residential area. At the Commission hearing held on August 20, 1968, there was no opposition received for this change of zoning. It was reported that seven notices were mailed, three received in favor, and none in opposition. Mr. Hammonds, the Applicant, appeared and stated that he plans to provide 2.4 parking spaces per apartment; that he considered this parking ratio essential this day and time when most every family has two automobiles. Motion by Sizemore, seconded by Bradley and passed, that the hearing be closed. Motion by Sizemore, seconded by Lozano and passed, that the Council concur in the Commission's recommendation that the application be approved as requested. Mayor Blackmon announced the public hearing on Application 0868-9, Mildred Mahan Kusel et al, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District, on Lot 19, Block 7, Gardendale Addition No. 1. Senior City Planner Larry Wenger presented the application, pointed out the location on the zoning and land use map, and described the zoning classifications in the surrounding area, which is residential and business. He explained that there is a residential area, drive-in grocery, service station, and offices in the surrounding area. At the Commission hearing held on August 20, 1968, Mr. William Kusel, husband of the Applicant, stated that they propose to build medical office buildings, which they feel is the best use of this property. They also plan a drug store on this property. The Staff reported that 14 notices were mailed, three received in favor, and two in opposition. Commissioner McDaniel questioned the use of the comer lot next to this one, and was told that there is an application pending now, waiting for this application to come through, so that both applications can be considered together. The first application Minutes Special Council Meeting September 16, 1968 Page 5 will have a service station on the corner. Mr. Kusel showed the Council a site plan for the development of the project. Mr. Tim Clower, local real estate broker, elucidated on the plans for development. Motion by Sizemore, seconded by Bradley and passed, that the hearing be closed. Motion by McDaniel, seconded by Sizemore and passed, that the appli- cation be tabled for discussion at Workshop meeting. Mayor Blackmon announced the public hearing on Application #868-11, Mr. Abe Block, for change of zoning from "I-3" Heavy Industrial District to "A-2" Apartment House District, on Lots 16 and 17, Block 2; Lots 19 through 27, Block 1, Los Angeles Hills. Senior City Planner Larry Wenger presented the application; pointed out the location on the zoning and land use map, and described the zoning classifications in the surrounding area. He explained that the area is mostly industrial and business district, with residential only on the two streets of Bluntzer and Parr. He stated that at the Commission hearing held August 20, 1968, one person spoke in favor and two in opposition to the change in zoning. 33 notices were mailed, one received for and one received against the application. City Manager Townsend described some property in the area which the City owns and pointed out the general land usage in the area. He stated that this area does need the concern of the public in perhaps a study of rezoning of the area. Mr. Abe Block, the Applicant, stated that many of the homes in this area are substandard and he would like to bring those he owns up to standard. Over the past three to four years, he has torn down and rebuilt several homes on these two blocks, and wants to continue doing so. He stated that there is a tremendous demand for houses on these streets, as they are close to schools, and employees of the surrounding businesses would like to live close; many are homeowners in this area. He read and presented a petition from the neighborhood with 59 names in favor of the request. He stated that on the first two Tots he will build ane home, on the other nine lots he will build four homes. Minutes Special Council Meeting September 16, 1968 Page 6 Mr. Maury Wolfson presented pictures of some of the homes which Mr. Block has built to show the type of housing planned for this area. These homes are privately' financed and not a governmental project. Mr. C. H. Darnell of the Texas Mexican Railway. Company opposed the change in zoning because it will deprive the Railway Company of a potential industrial site, and the noise factor involved in railroad switching operations and other noise operations render the property not suitable for residential use. He stated that they certainly hove no objections to the upgrading of the area, but believe the noise will be a problem, as they do not like complaints. Mr. Block stated that they have never had complaints about the noise. Mayor Blackmon stated that he was happy that Mr. Block was trying to upgrade and help the neighborhood as this was something that needed to be done. Motion by Bradley, seconded by Sizemore and passed, that the hearing be closed. Motion by McDaniel, seconded by Bradley and passed, that the application be tabled for.d.iscus'sion at Workshop. meeting. There being no further business to come before the Council, the meeting was adjourned .
