Ray Kring Mayor Pro Tem Ronnie Sizemore called the meeting to order in the absence of Mayor Blackmon, and stated the purpose of the meeting was to hold public hearings on five zoning applications, and any other business as may properly come before the Council, and explained the procedure to be followed. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Pro Tem Sizemore announced the public hearing on Application #968-8, Mr. Edwin Juelg, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District, on a 10.5 acre Tract out of Lots 2 & 12, Section 17, Flour Bluff and Encinal Farm and Garden Tracts. Senior City Planner Larry Wenger presented the application; pointed out the location on the zoning and land use map, and described the zoning classifications in the surrounding area. He explained that the property is surrounded by the Oso Golf Course, driving range, and Pharaoh Valley residences. He stated that at the Commission hearing held September 17, 1968, Mr. Carl Duaine, Surveyor representing the applicant, presented a site plan of the proposed apartment complex. He also stated that since this time, the property has become jointly owned by Mr. Edwin Juelg and Mr. Carl Duaine. Three people appeared in opposition at the Commission hear ing. The Staff mailed three notices, none were received in favor, and one in opposition. The recommendation of the Staff is that this application be denied on the basis that existing zoning is adequate for this area and access to the property is inadequate for apartment development; the Planning Commission recommendation is that it be denied, but in lieu thereof, a Special Permit be granted for the construction of multiple family structures with a density no greater than that allowed in "R -1B" Single-family Dwelling District subject to a site plan to be approved by the Planning Staff and a proper plat. • Minutes Special Council Meeting October 21, 1968 Page 2 M Acting City Manager Pilcher stated that a letter had been received from Mr. James P, Ryan, attorney for Mr. Frank Peerman, Mr. Graford N. Rogers, and Mr. Robert E. Peerman, advising that the clients support Mr. Juelg's application for rezoning, Also a letter had been received from Mrs. Clyde Hazlett of 6822 Aswan, who is in opposition. Mr. Carl Duaine, who is now co-owner of the property, appeared before the Council with a proposed development of the area. He explained to the Council the development of the land and how he and Mr. Juelg plan to develop the property. Mr. Jack Nelson, 1302 Limestone, Vice President of the Woodlawn - Haas Civic Association, spoke in opposition to the zoning change because of the tremendous traffic problems already in this area. He stated that there is almost no way that the traffic from this apartment complex could be routed that would be away from McArdle Street. He stated that there is already a problem in trying to get to the schools in the area and no additional traffic is needed. Mr. Sid Beauford, 926 Shiels, questioned that if the traffic is routed away from the Pharaoh Valley streets, wouldn't it be corning into the Woodlawn area streets of Sheils, or Bernice. He doesn't want that since he lives in that area and the streets are narrow enough without any additional traffic. Mr. Tony Bonilla, attorney representing Dr. H. N. Siemer, President of the Woodlawn P.T.A., stated that this hearing is premature because the site plan only is for the street layout of the area, and it is difficult to see how the project will be developed. He stated that if the Staff believes the existing zoning is adequate, then accept it. He stated that those are for the apartment project are involved either directly or indirectly.. The people opposed are those having an interest in their homes, schools, and their property rights. He stated that this area has very poor planning as far as streets are concerned; the drainage in the area is poor. Many times the applicants do not live in the area, so cannot really be concerned with the problems existing there. Minutes Special Council Meeting October 21, 1968 Page 3 Mrs. Clyde Hazlett; Mrs.. C. M. Thomason, Jr., 1306 Aswan; Mrs. W. C. Peterson, 1305 Aswan; and Mrs. Robert Wells, 1009 Memphis, all spoke in opposition to the changein zoning. Dr. H. N. Siemer stated that some of the land: is, low and good for nothing. The apartments would be crowded on the higher ground next to the Woodlawn School. Dr. Jimenez questioned if the opposition would be satisfied with the change in zoning if the traffic could be routed away from the residential area. He was advised by Dr. Siemer that they have no opposition to single family dwellings, but fail to see how the traffic could be routed any other way than through the school area. Mr. Duaine stated that it would not be feasible to lay streets across the lower area to the Woodlawn School area. I -e explained on the layout how streets were proposed. Also he stated that these would be one -bedroom apartments, which would probably not add to the overcrowded schools in the area. Motion by Bradley, seconded by Jimenez and passed, that the hearing be closed, Motion by Bradley, seconded by McDaniel and passed that the foregoing zoning application be tabled for further consideration, Mayor Pro Tem Sizemore announced the public hearing on Application #968-9, Mr. C. V. Guzman, for change of zoning from "R -1B" One -family Dwel ling District and "R-2" Two-family Dwelling District to "AB" Professional Office District, on Lots 1, 2, 3, 4, 61, 62, 63, and 64, Block 815, Port Aransas Cliffs. Larry Wenger presented the application; pointed out the location on the zoning and land use map, and described the zoning classifications in the surrounding area, which is residential single-family, duplex and the Driscoll Foundation Hospital. He stated that at the Commission hearing held September 17, 1968, Mr. Kimey Johnson, Realtor representing Mr. Guzman, presented a site plan of the proposed development which indicated that two separate buildings would be constructed for professional offices. The offices would face on Ropes Street. Four appeared in opposition at the Commission hearing; the Staff mailed 30 notices, two were received in favor, two in opposition, and two were received at the hearing in opposition. The recommendation of the Planning • Minutes Special Council Meeting October 21, 1968 Page 4 Staff is that this application be denied on the basis that it would encroach into a residential area and would lead to more strip -type zoning along South Alameda Street, and the present zoning is adequate for this area; the Planning Commission recommendation is that the "AB" Professional Office District be approved on Lots 61 through 64 facing on Alameda Street, but that it be denied on Lots 1 through 4 facing on Topeka Street. Mr. C. V. Guzman, the applicant, of 1111 Agnes, stated that he believes the application for this change in zoning for the property is right. Mr. Kimey Johnson, representing the applicant, stated that the property is 100' X 250'. He stated that with the off-street parking provided for this property, there would be probably less traffic than if apartments were built. Also, he stated that it would increase the value of the surrounding property. Mr. Lozano questioned using ;i,a front lots for the buildings and the back lots for parking area. He was advised that a certain amount of parking must be provided for the building area, and the back lots could only be used for extra parking space. Mr. Daniel Rash, 3562 Topeka, spoke in opposition, stating that he does not prefer parking lots or office buildings across the street from his house. He stated that there is quite a bit of traffic already. He presented a petition with 39 names in opposition to the change in zoning. He stated that he does not want spot zoning in this area; that it is residential, and should stay that way; the streets are not very wide. Mrs. Eckel, 3612 Topeka, spoke in opposition, stating that she has lived in this area for 20 years; that her block is a dead end street; most of the garages are attached which means that many cars park on the streets. Mrs. B. L. Hobbs, 3660 Topeka; Mr. J. O. Hedrick, 226 Melrose, who owns property in this area; Mrs. H. M. Meredith, 3545 Topeka; and Mrs. Rash, all spoke in opposition to the change in zoning because of the increased amount of traffic with school children in the area, and no sidewalks on Ropes Street. Mr. Johnson stated that he believes the change inzoningwill improve the area, especially because of the property now being a vacant lot. Motion by Jimenez, seconded by Lozano and passed, that the foregoing application be tabled for further consideration. *Dr. Jimenez departed from the meeting. Mayor Pro Tem Sizemore announced the public hearing on Application 0968-10, Dr. Richard Lyman, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District, on Lot "A", Carroll Heights Annex and a 100' X 455.6' portion of Lot 2, Section 2, Bohemian Colony Lands. Larry Wenger presented the application; pointed out the location on the zoning and land use map, and described the zoning classifications in the surrounding area, which is business on Padre Island DrPve, a school, church, and doctors offices on Weber Road, and residential area behind the property. He stated that at the Commission hearing held on September 17, 1968, Mr. S. J. Becker, Realtor, presented a site plan of the apartment complex proposed by the applicant. Four appeared in favor of the application at the hearing; the Staff moiled out 16 notices, two received in favor, three in opposition. The recommendation of the Staff is that the application be approved as being a good transition from business to residential; the Planning Commission recommendation is that the application be approved as reuqested. Mr. George Rohrman, Jr., 330 Canterbury, of Rome Construction Company, appeared before the Council with a drawing of the proposed apartment complex. He stated that the number of apartments to be built has been reduced from 38 to 32 units. Mr. S. J. Becker, Mr. Neal Fulgham, and Mr..Sam Allen, are all in favor of the application. No one appeared in opposition at the Council hearing. Motion by McDaniel, seconded by Bradley and passed, that the hearing be closed. Motion by Bradley, seconded by McDaniel and passed, that the recommendation of the Planning Commission be concurred in and that Application 0968-10, Dr. Richard Lyman, for change of zoning from "R -1B" One -family Dwelling District to "A-1" • Minutes Special Council Meeting October 21, 1968 Page 6 Apartment House District, on Lot "A", Carroll Heights Annex and a 100' x 455.6' portion of Lot 2, Section 2, Bohemian Colony Lands, be approved as requested and that an ordinance be brought forward effectuating the change. Mayor Pro Tem Sizemore announced the public hearing on Application #968-11, Mr. Sam L. Allen, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District, on a 325' X 287' portion out of Lot 2, Byron Willis Subdivision. Larry Wenger presented the application; pointed out the location on the zoning and land use map, and described the zoning classifications in the surrounding area, which is business on South Padre Island Drive, doctors offices on Weber Road, and residential behind the property. He stated that at the Planning Commission hearing held on September 17, 1968, Mr. Sam Allen, the applicant, presented a site plan explaining that a commercial shopping center was proposed to serve the surrounding residential and apartment areas. Three appeared in favor of the application at the Commission hearing; the Staff mailed eight notices, two received in favor, none in opposition. The recommendation of the Planning Staff is that the application for "B-4" be denied, but recommend "B-1" as a transition or step-down zoning; the recommendation of the Planning Commission is that the application be approved as requested. Mr. Sam Allen appeared before the Council and pointed out the location of his property and proposed development. Mr. Neal Fulgham spoke in favor of the application. No one appeared in opposition at the Council hearing. Motion by Bradley, seconded by Lozano and passed, that the hearing be closed. Motion by McDaniel to approve application for "B-1" zoning died for lack of a second. Motion by Bradley, seconded by Lozano and passed, that the recommendation of the Planning Commission be concurred in and that Application #968-11, Sam L. Allen, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District on a 325' X 287' portion out of Lot 2, Byron Willis Subdivision, be approved as requested and that an ordinance be brought forward effectuating the change. Minutes Special Council Meeting October 21, 1968 Page 7 Mayor Pro Tem Sizemore announced the public hearing on Application #968-12, The City of Corpus Christi, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District, on Lot A, Bancroft Dodge Annex. Larry Wenger presented the application; pointed out the location on the zoning and land use map, and described the zoning of the surrounding area, which is residential, Special Permits for apartments, a church, and a professional office. He stated that at the Commission hearing held on September 17, 1968, Mr, Edward Shaw, City Planner, explained that this application was initiated at the request of Acting City Manager Wayland Pilcher, upon recommendation by the City Council and with full knowledge of the owner, Mr. Donald V. Kingsbury. At a recent paving assessment hearing by the Council, it was brought out that this property was zoned "R -1B" Single-family Dwelling District, but was being used for apartments, whicl was a valid nonconforming use. One person in addition to the applicant, spoke in favor of the zoning change at the Commission hearing. The Staff mailed 16 notices, none received in favor or opposition. The recommendation of the Staff is that the application be approved as requested; the Planning Commission recommends the same. Mr. Kingsbury, presentat the Council hearing, stated that he approved this change in zoning. Motion by Bradley, seconded by Lozano and passed, that the hearing be closed. Motion by Lozano, seconded by Bradley and passed, that the recommendation of the Planning Commission be concurred in and that Application #968-12, The City of Corpus Christi, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District, on Lot A, Bancroft Dodge Annex, be approved as requested and that an ordinance be brought forward effectuating the change. There being no further business to come before the Council, the meeting was adjourned.
