City Manager Townsend preso aed for the Ccs ll''s rc.rdeeation the following resolution: RESOLUTION NO. 9421 RESOLUTION THAT THE CITE` COUNCIL GO ON RECORD FAVOR OF THE APPLICATION MADE BY RIO AIRWAYS, FILED WITH THE TEXAS AERONAUTICS COMMISSION, FOR AN INTRASTATE AIR CARRIER CERTIFICATE OF CONVENIENCE AND NECESSITY, AUTHORIZING RIO AIRWAYS TO ENGAGE IN AIR TRANSPORTATION, AND HEREBY REQUESTS THE TEXAS AERONAUTICS COMMISSION TO GRANT THE SERVICE SOUGHT IN SUCH APPLICATION; DECLARING AN EMERGENCY, The Charger rule WaS sk2spended and :he foregoing res u• oby the following vote Bloc; on, Lozano, Bradley, de Lyses, MaDonel, Roberts and Sizemore, present and voting "Aye". Senlcr Cry Planner Larry Wenger located the property on the zoning and and use map and described the zoning and land uses in the sL;rrournding area; stated that at the Commission hearing held June 10, 1969, M. Sheldon Katz, .ealtor representing Mc. Mr. Wenger stated that there was no opposition at the hearing; that the Staff mailed nineteen notices, none were received in favor and nine in cppos%tion; that it was the recommendation of the Planning Cornmi.seionComm that the appa flocs be dered, ard that the Staff recommended denial on the basiss u ext. ti-,cz zoning it odeq;:nte fear cmea and that granting this would only eneo, Road. ge ip-type zoning along Oid Robdtc r • Mr. Sheldon Katz spoke in sapport of the appeaticn on behalf of the applicants and stated that in has opinion the proposed Circle "K" would be the highest and best use for this property and that such development would not devaluate surrounding prcpe cies; that there are existing substandord buildings in the area, and that they propose to E:;,id new b- i!dings which would upgrade the x:haracter of the neighborhood. Mr. Katz stated t'.rot they did not anticipate any opposition and therefoe had not prepared a defense; that one person living at 458 Old Robstown Road had been opposed on the basis trot she thougr:t beer w.celd be old. Motion by McDaniel, seconded by Roberts and passed, that bio r r rug be cased. Mayor Blackmon announced the public hearing en Application *669-2, Messrs. frank A. McCaughan and C. S. Reagan, for change of zoning from "AB" Professional OffL e District to "3-1' Neighborhood Business District, ors all of Lots 22 and 23 and the north 30 feet of Lot 24, Block 7, Tracy Addition, located at 2642 Elizabeth Street. Larry Wenger stated that the Commission heard this request lune 10, 1969, and that Mr. Hutch Bryan, realtor representing the applicants, had appeared and stated that a Odin - :prated washateria is proposed for the property. No one appeared in opposition to the foregoing request. Messrs. McCaughan and Reagan were present but did not speak. Motion by Bradley, seconded by Lozano and passed, that the hearing be closed. Motion by Sizemore, seconded by de Ases and passed, that the recommerldari<:iin of the Planning Commission be concurred in and that Application 4669-2, Mesa's. F,rarik A. McCaughan and C. 5. Reagan, for change of zoning from "AB" Professionol Office D°<.'trict to "B-1" Neighborhood Business District, on all of Lots 22 ord 23, and the Ncith 30 fe -t of Lot 24, Block 7, Tracy Addition, located at 2642 Elizabeth Street, be app,oved a requested, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the publi hearing on Application #669-3, A-1 U -Store - It Warehouse, Inc., for change of zoning from "B-4" (Granted Special Perrr l) to "i-2" Light Industrial District, on Lots 1 thru 4, Block E, Lexington Place Add"aion;, hated at 2902 South Padre Island Drive, Larry Wenger located the property on the zoning and land use map and de,c• hed the zoning and land uses in the surrounding area; stated tho', at the Commissior_ hearing held June 10, 1969, Mr. Foy G. Hall, representing A-1 U -Store -it Warehouse, Is�> appeared and stated that the application is being made to accommodate a s3gn which had been painted on the front of the building by one of the applicant's tenaris which did riot advertise the use of the property but off -premises sales, and had been notified by a C+'y inspector that the sign was in violation of zoning regulations. Mr. Wenge; stated tl-al a.o one appeared at the hearing in opposition; that the Staff mailed four netictec,, noise were received in favor and none in opposition; that it was the recommendaticn of tl°e Staff that the application be denied on the basis that this area should not be encouraged to beeaome an outdoor advertising strip since it is the only direct route to Padre island Beach, and that the Planning Commission concurred in this recommendation. Minutes Special Council Meeting July 7, 1969 Page 4 • City Manager Townsend pointed out that the Special Council Permit avhitih was originally granted in July of 1968, was specifically for a storage and warehonsing operation, with an approved site plan. Mr. Townsend stored that they are now advertising Victor's -Appliance and T.V. Center whose business is transacted at another location, and that the ' llboard" type sign is in violation of the Special Permit. No one appeared in favor or in opposition to the foregoing applIcotior. Bradley, for change of zoning from "R-2" Two-family Dwelling District to "AB" Pr°efession,al Office District, on Lots 43 and 44, Block 814, Port Aransas Criff , lo4.ated at Alameda Street. Larry Wenger presented the application, located the property on fil=e zoning and land use map, and described the land uses in the surrounding area; stated .that at 4F;e Commission hearing held June 10, 1969, Mr. Tin! Clower, realtor representing the cppliroza, presented floor plans for the building to be used for a dance studio for rs1. id r, and stated that dance classes will be held from 1:00 to 5:30 p.m. for nct more that. 10 children at any one time. Mr. Wenger stated that one other peason, owner of the d.'plex located immediately adjoining on the south, had appeased in favor, and that no ore hod appeased in opposition; that the Staff mailed fifteen notiicec, four were received in favor and four in opposition; that it was the recommendation of the Staff that the request be denied en the basis that it would create "spot" zoning and would nct be in keeping with the character of the neighborhood and would also tend to encourage "strip" zoning along South Alameda, and that the recommendation of the Commission was that it be denied, bit in lie;; thereof a Special Permit be granted for a dance studio according to the plot pion subm'tted to the Commission. • Minutes Special Council Meeting July 7, 1969 Page 5 Mr. Wenger stated that a study of the plot plan which was submitted to the Commission had been made by the Staff, and presented to the Council two altercate plot plans which the Staff felt would provide better egress and ingress and parking for children being brought by their parents to and from the school; stated that if there is t . only one driveway itshould be 16 -feet wide with a hard surface. The plan provided for a 15' setback line and a screening fence on the side of the lot adjoining the "R-2" residential area. Mr. Tim Clower and Mr. Hutch Bryan, realtors representing the applicant, ta+rri they had been employed to locate a suitable site for the proposed dance school, and th:l- this site had been selected as most suitable. He stated that there has beer, a general trend for zoning changes in this area; that "AB" zoning changes have been numerous; and that there has been no new construction sir.ee 1960. Mr. Clower stated that in his opinion<, th; proposed development would be the highest and best use for this property. No one appeared in opposition to the foregoing application. Motion by Roberts, seconded by de Ases and passed, that the hearing be zslosed. Mr, Nat Friedman, father of the applicant stated that they had errpoyed Dexte Hamar., arr.hitect,to study the plot plan, that he had approved the plan as submitted by Mr. Clower, and that the applicant had selected this plan on his advice. Motion by McDaniel, seconded by Roberts and passed, that the foregorrg application be tabled for further consideration of which plot plan is most acceptable relative to parking, egress and ingress, driveway arrangement, and fence requirements, and directed that the Staff and the applicant work together for an acceptable plot plan. There being no further business to come before the Council, the meeting was adjcuoed.
