CITY OF CORPUS CHRISTI, TEXAS
REGULAR COUNCIL MEETING
July 16, 1969

Mayor Jack R. Blackmon called the meeting to order.
The Invocation was given by The Reverend Dan E. Solomon, Pastor of St. John's
United Methodist Church.
City Secretary T. Ray Kring called the roll of those in attendance.
The Minutes of the Special Meeting of June 25, 1969, were approved as submitted
to the Council.
Mayor Blackmon expressed, on behalf of the Council, great concern for some
unsettled questions which have faced the Council the past week; stated that most citizens
are not aware of the enorminity of these problems, and that most of them do not take the
time to become involved, and that there is always more than one side to any controversy.
He stated that the Council has always been solicitous and particularly appreciative of
having representatives of all concerned so that the Council can be in a better position to
consider a cross -thinking of the citizens of the community as a whole. In this regard, he
recognized three distinguished members of the Clergy, Bishop Thomas J. Drury, of Corpus
Christi Diocese, Rabbi Sidney Wolff, of Temple Beth El Synagogue, and Dr. W. H. Colson,
Minister of Baptist Missions, representing major religious denominations of the community,
and stated their presence is of great solace and comfort, and their wisdom is always welcome
because of their long and varied experience. He especially welcomed them to the meeting
today, and asked for their prayers in all deliberations of this Council.
Mayor Blackmon called attention to this very historical day when our Country has
launched a team of men out into what we have always considered "unknown space" for a
landing on the moon Monday of next week, and asked that citizens of this community join

in prayer for the success of this unprecedented historical mission for what is hoped to be
for the good of all mankind.
Mayor Blackmon especially recognized and welcomed Dr. Harold Branch, Pastor
of St. John's Baptist Church, member of the Housing Authority, and Subcommittee on
Minority Group Housing, and expressed appreciation for his presence in the audience.
Mayor Blackmon ,read a proclamation designating Thursday, July 17, 1969, as
BEN BARNES DAY in Corpus Christi, in recognition of his services to the State of Texas as
State Representative, Speaker of the House for two terms, now lieutenant Governor, and
For his contribution to this City, and taking time from his busy schedule to visit Corpus
Christi and speak to the Chamber of Commerce -Rotary Club meeting in honor and recog-
nition of the Corpus Christi Delegation to the Texas Legislature and also to the Baptist's
Men's Organization of the City. The proclamation will be presented personally to
Lieutenant Governor Barnes.
Mayor Blackmon called for the City Manager's Reports.
Motion by Sizemore, seconded by Roberts and passed, that the City Manager's
Reports, Items "a" through "f", with de Ases voting "Nay" on Item "e", be accepted,
and that the requests and recommendations be granted and opproved as follows:
a. That an additional appropriation in the amount of $3,419 for the construction of
Belton, MacArthur, Sarita, Hiawatha, and Rodd Rield Road, Project No. 220-67-92.2,
due to quantity variations, be authorized, and that acceptance and final payment of
Estimate No. 7, in the amount of $18,181.24, representing the balance due the contractor,
King Construction Company, for completion of the project, be approved;
b. That an appropriation in the amount of $21,000 from No. 299 Special Projects
Fund, for architectural services by Morris L. Levy in connection with construction of a
Neighborhood Facility, TEX N-5, Project No. 299-68-1, under his contract approved on
April 19, 1967, be authorized;

c. That the date of Monday, August 11, 1969, at 2:00 p.m., be set for public
hearing on the following zoning cases: (1) Harold Jackson - "R -1B" to "B-1" at Van-
derbilt Drive and Roosevelt Drive; (2) Joe D. Moore - "R -1B" to "A-1" at Montego
Drive and Weber Road; (3) Hamburgers, Inc. - "1-2" to "B-5" at Morgan Street and
South Port; and (4) Wendell Barnes - "R -1B" to "R-2" near Burton Lane and Curtis
Clark Drive; and that the date of Monday, September 15, 1969, be set for public
hearing on application of Drs. Hubler and L. P. Guttman - "R -1B" to "A-2" on Ocean
Drive near Rossiter;
d. That Change Order No. 3 in the amount of $2,975 to substitute a retaining
wall for sloped private property at Doddridge and Ocean Drive, in connection with
Ocean Drive Unit III Project, be approved;
e. That the award of bids on. eleven Annual Supply Contracts: be made to the
following firms on the basis of low bids meeting specifications: (Bid Tabulation 012-69)

f. That a contract be authorized with the Community Committee on Youth
Education and Job Opportunities for the City to operate five additional neighborhood
youth activity facilities in schools and to employ approximately 80 disadvantaged youth,
ages 16 - 21, to help with supervision activities at all of the summer recreation programs,
including a program providing for the rental of City Buses to transport neighborhood youths
to recreation facilities, with the City's portion to include the in-kind provision of one
supervisor, health examinations for the employees and use of facilities.
Dr. Harold Branch inquired as to why the OEO program is being started so late
in the summer.
City Manager Townsend explained that it should have been with the renewal type
program submitted last year, but that because of some misunderstanding with the local
office of the OEO and the Austin Staff reporting first there was not enough money and
later reporting there was, resulting in the late date for submission of the matter.

ORDINANCE NO. 9434
AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING
SECTION 4-3, AS AMENDED, RELATING TO CONSUMPTION OF ALCOHOLIC BEVERAGES
AND THE SALE THEREOF, SO AS TO EXTEND THE CLOSING HOURS; PROVIDING FOR AN
EFFECTIVE DATE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY.
Mayor Blackmon explained that the foregoing ordinance was placed on a three -
reading basis last week to allow more time for expressions from the public, and stated that
he had had no communications or dialogue since that lime either in protest or inn favor, and
that it is his decision at this time that the ordinance be put on an emergency basis.
The Charter Rule was suspended and the foregoing ordinance was read for the
second time and passed as an emergency by the following vote: Blackmon, Lozano, Bradley,
de Ases, McDaniel, Roberts and Sizemore, present and voting "Aye".
ORDINANCE NO. 9435
THIRD READING OF AN ORDINANCE GRANTING A FRANCHISE TO HUMBLE OIL AND
REFINING COMPANY TO LAY, CONSTRUCT, OPERATE, MAINTAIN, REPAIR AND
REMOVE CERTAIN PIPELINES WITHIN SPECIFICALLY DESIGNATED LOCATIONS BY
CROSSING SAID STREETS, ROADS AND HIGHWAYS AT SAID DESIGNATED POINTS,
FOR THE TRANSPORTATION OF PETROLEUM PRODUCTS; SETTING FORTH THE TERMS
OF SAID FRANCHISE; PROVIDING FOR PUBLICATION; AND SETTING FORTH OTHER
PROVISIONS PERTAINING TO THE FRANCHISE.
The foregoing ordinance was read for the third time and passed finally by the
following vote: Blackmon, Lozano, Bradley, de Ases, McDaniel, Roberts and Sizemore,
present and voting "Aye".
FIRST READING OF AN ORDINANCE GRANTING A FRANCHISE TO CABLECOM-
GENERAL OF CORPUS CHRISTI, ITS SUCCESSORS AND ASSIGNS, TO OPERATE
AND MAINTAIN A COMMUNITY ANTENNA TELEVISION SYSTEM IN THE CITY;
SETTING FORTH CONDITIONS ACCOMPANYING THE GRANT OF FRANCHISE;
PROVIDING FOR CITY REGULATION AND USE OF THE COMMUNITY ANTENNA TV
SYSTEM; AND PRESCRIBING PENALTIES FOR VIOLATION OF THE FRANCHISE
PROVISIONS.
The foregoing ordinarce was read for the first time and passed to the second
reading by the following vote: Blackmon, Lozano, Bradley, de Ases, McDaniel,
Roberts and Sizemore, present and voting "Aye".

A TEXAS CORPORATION, ITS SUCCESSORS AND ASSIGNS, TO OPERATE AND MAIN-
TAIN A COMMUNITY ANTENNA TELEVISION SYSTEM IN THE CITY; SETTING FORTH
CONDITIONS ACCOMPANYING THE GRANT OF FRANCHISE; PROVIDING FOR CITY
REGULATION AND USE OF THE COMMUNITY ANTENNA TELEVISION SYSTEM; AND
PRESCRIBING PENALTIES FOR VIOLATION OF THE FRANCHISE PROVISIONS.
The foregoing ordinance was read for the first time and passed to the second reading
by the following vote: Blackmon, Lozano, Bradley, de Ases, McDaniel, Roberts and
Sizemore, present and voting "Aye".
ORDINANCE NO. 9436
APPROPRIATING OUT OF NO. 220 STREET BOND FUND THE SUM OF $3,419 TO
SUPPLEMENT FUNDS PREVIOUSLY APPROPRIATED FOR CONSTRUCTION AND CON-
TINGENCIES, APPLICABLE TO PROJECT NO. 220-67-92.2, DESIGNATED AS BELTON,
MACARTHUR, SARITA, HIAWATHA, RODD FIELD ROAD IMPROVEMENTS, AND AS
REQUIRED FOR FINAL PAYMENT OF CONSTRUCTION COSTS; AND DECLARING AN
EMERGENCY.
The Charter Rule was suspended and the foregoing ordinance was passed by the
following vote: Blackmon, Lozano, Bradley, de Ases, McDaniel, Roberts and Sizemore,
present and voting "Aye"
ORDINANCE NO. 9437
APPROPRIATING OUT OF NO. 299 SPECIAL PROJECTS FUND, THE SUM OF $21,000
FOR ARCHITECTURAL SERVICES BY MORRIS L. LEVY IN CONNECTION WITH
CONSTRUCTION OF A NEIGHBORHOOD FACILITY, TEX N-5, APPLICABLE TO PRO-
JECT NO. 299-68-1; AND DECLARING AN EMERGENCY.

following vote: Blackmon, Lozano, Bradley, de Ases, McDaniel, Roberts and Sizemore,
present and voting "Aye".
Mayor Blackmon stated that a request had been received by telegram Monday of
this week in the Office of the City Secretary from Mr. Tony Bonilla, Executive Secretary
of LULAC District 11, to appear on the agenda today to speak on behalf of the "plight"
of the Sanitation workers. He explained that Mr. Bonilla and his brother, William Bonilla,
had been invited to the Workshop meeting this morning and that one hour and forty minutes
had been given over to them for discussion, specifically and generally, on the matter of the
"plight" of the Sanitation workers. He stated that he had been authorized by the Council
to state at this time that the entire Council is, and always has been in the past, ready to

receive and hear any single City employee who for any reason feels he has a matter of
grievance which should be presented to the Council after he has exhausted the normal
chain of procedure.
Relative to the current strike of the Sanitation workers, he explained that if our
City Manager form of government is to be respected, the City Council and the City Manager
must stay within the State Law and the laws of the City Charter, and that the City Council
has extremely limited authority in directing or supervising the employees of the City. He
stated the Council is extremely interested and concerned about any problem of dissatisfaction
existing with any employee or group of employees; but that these matters must be handled
as'directed by law. He stated that it is the opinion of the City Council that in the case of
the Sanitation workers, the City Manager did not have an opportunity to work out the problems
before the strike occurred, but that his action was in accordance with the provisions of the
Stote Law. He explained that the Council has informally expressed itself that all former
Sanitation employees may re -apply for employment and that this is the only avenue open to
them at this point.
Mayor Blackmon stated that Messrs. Tony and William Bonilla departed the workshop
meeting this morning stating that the matter which they wished to present to the Council: had
been thoroughly presented and felt they had no further information to bring before the Council,
and that accordingly, that is why they are not appearing on the agenda at this time.
There being no further business to come before the Council, the meeting was adjourned.
