Singer Assistant City Secretary Bill G. Read Mayor Jack R. Blackmon called the meeting to order and stated the purpose of the Special Meeting was to hold public hearings, and any other business as may properly come before the Council. City Manager Townsend announced that the Director of Health and Welfare, the Permit. Officer, had withdrawn the charges against Custom Ambulance Service, and had filed a complaint based on the same facts in Municipal Court after Mr. Henry Ayala of Custom Ambulance Service, through his attorney, had admitted that Custom Ambulance Service was guilty of violation of the ordinance. He stated that Custom had plead guilty and paid '.a Twenty -Five Dollar fine in Municipal Court, and therefore, the appeal scheduled for 3:00 p.m. this date had been withdrawn. Mayor Blackmon announced the public hearing on Application #1069-2, Mrs. Ralph E. Broyles, for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on the West 1/2 of Lot 5 & all of Lots 6, 7 and 8, Sunnyside Strip, located on the West side of the 700 Block of Everhart Road. Senior City Planner Larry Wenger located the property on the zoning and land use map, and described the zoning and land uses in the surrounding area; stated that at the Commission hearing held October 14, 1969, Mr. Tim Clower, Koepke & Clower Realtors, spoke on behalf of the applicant and explained that they plan to develop the property for business offices, and that they have several clients who are interested in this location, but that they have no definite plans at, the present time. Mr. Wenger stated that no one appeared at the hearing in opposition; that prior to the hearing twenty-one notices were mailed, three received in favor, none in opposition, one received in favor at the public hearing, and three received in favor from persons living outside the 200 -foot notification zone; stated that it was the recommendation of the Planning Commission that the application be approved as requested (It was further recommended that the Com- • • Minutes Special Council Meeting November 17, 1969 Page 2 mission instruct the Staff to take the necessary steps to rezone the remainder of lots in Sunnyside Strip Addition facing on Everhart Road for "AB" Professional Office District); and that the Staff recommended denial on the basis that the request does not conform to the Everhart Zoning Study; there is already sufficient "AB" zoning in the area; it would encourage "strip -type" zoning on the remainder of the property east all the way to Alameda Street; and would adversely affect the residential property that backs up to this tract which faces on Sam Street. Mr. Tim Clower spoke on behalf of the applicant and presented a map show- ing the various businesses located in the surrounding area; pointed out that this is an excellent location for business offices as Everhart Road is a major thoroughfare and that there is a demand for this type development; stated that the area is pro- tected by existing deed restrictions; that he has communicated with several people in the immediate area and they were favorable to the request so long as the develop- ment does not go beyond office uses; and that letters from the Jewish Community Center and Parkdale Kindergarten had been received in favor. He stated the lots are not suitable for residences, and that they are not large enough for apartments, and that they feel the proposed development to be the highest and best use of the land, No one appeared in opposition to the foregoing application. Motion by Lozano, seconded by Sizemore and passed, that the hearing be closed. Motion by Sizemore, seconded by Lozano and passed, that the recommenda- tion of the Planning Commission be concurred in and that Application #1069-2, Mrs. Ralph E. Broyles, for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on the West 1/2 of Lot 5 & all of Lots 6, 7 & 8, Sunnyside Strip, located on the West side of the 700 Block of Everhart Road, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application #1069-1, Henry L. Tucker, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District, on Lots A, B, C, D, E and the South 115 feet of Lot 36, Block 8, Gardendale No. 2, located on the East side of the 5400 Block of Everhart Road between Curtis Clark and Bonner Drive. Minutes Special Council Meeting November 17, 1969 Page 3 Larry Wenger located the property on the zoning and land use map, and described the zoning and land uses in the surrounding area; stated that prior to the Commission hearing held October 14, 1969, the applicant had withdrawn from the original application the portion included in the North 185 feet of Lot 36, Block 8, Gardendale #2, on which the construction of a drive-in grocery store was proposed, and that the office building is proposed for Lots "A" through ,"E",and the neighborhood business center for the South 115 feet of Lot 36. Mr, Wenger stated that there are four existing buildings on the property which will be removed; that the applicant and other person spoke in favor of the request and one in opposition; that prior to the Commission hearing twenty notices were mailed, five received in favor and three in opposition; that it was the recommendation of the Staff that the request, be denied generally on the basis that it does not conform to the Everhart Zoning Study; would encourage "strip -type" zoning;' would adversely affect the resi- dential area both on Bonner and Curtis Clark Drives; that there is already sufficient business zoning in planned neighborhood shopping centers; is inadequate in size; and that it is not located at the intersection of two major streets as recommended in the ADC Report and the Community Builders' Handbook. He stated the Planning Commis- sion concurred in this recommendation, and that the 20 percent rule is in effect. No one appeared in favor nor in opposition to the foregoing application. Motion by Bradley, seconded by de Ases and passed, that the hearing be closed, Motion by Bradley, seconded by de Ases and passed, that the recommenda- tion of the Planning Commission be concurred in and that Application #1069-1, Henry L. Tucker, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District zoning on Lots A, B, C, D, E, and the South 115 feet of Lot 36, Block 8, Gardendale No. 2, be denied. Mayor Blackmon recognized the presence of Corpus Christi Caller -Times reporter Miss M. J, Wats, who was covering the Council Meeting for the first time today. There being no further business to come before the Council, the meeting was adjourned.
