Marvin Townsend Assistant City Attorney Bob Coffin City Secretary T. Ray Kring Mayor Jack R. Blackmon called the meeting to order and stated the purpose of the Special Meeting was to hold public hearings and any other business as may properly come before the Council. He asked that it be noted that a quorum of the Council and the required Charter officers were present, and explained the procedure to be followed. Senior City Planner Larry Wenger presented Application #670-5, Veterans of Foreign Wars Post #8932, for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on a 1,7 -acre tract of land out of the Northwest 1/4 of Lot 25, Section 55, Flour Bluff and Encina) Farm and Garden Tracts, located in the 1700 Block of Waldron Road. He pointed out the existing zoning and land use in the surrounding area stating that there is an existing two-story dwelling on the subject property, a mobile home subdivision located to the southwest, a mobile home park located to the south on the east side of Waldron Road, and Humble Oil Company operates a storage tank and gauges directly across Waldron Road. He stated that at the Commission hearing held June 23, 1970, Mr. O. G. Long represented the applicant and indicated that the two-story dwelling presently located on the property would be suitable for their operation at the present time. Mr. Wenger stated that one other person spoke in favor, and that no one appeared in opposition. He stated that prior to the Commission hearing, the Staff mailed seven notices, one was received in favor, none in opposition, and one letter received in favor beyond the 200 -foot notification zone; that it was the recommendation of the Commission that the request be approved, and that it was the Staff's opinion that this property should remain as it is presently zoned and used due to the fact that if the requested zoning is granted, it would tend to encourage rezoning and downgrading on the properties fronting Waldron Road. Minutes Special Council Meeting July 27, 1970 Page 2 Thomas Herrera, Commander of VFW Post #8932, spoke on behalf of the application stating that if the zoning request is granted, they plan to apply for the necessary permits to convert this two-story building into the future home of Post #8932 if found to be feasible and usable. No one appeared in opposition to the foregoing zoning request. Motion by Bradley, seconded by McDaniel and passed, that the hearing be closed. Motion by de Ases, seconded by Roberts and passed, McDaniel voting "Nay", that the recommendation of the Planning Commission be concurred in and that Application #670-5, Veterans of Foreign Wars Post #8932, for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on a 1 .7 -acre tract of land out of the Northwest 1/4 of Lot 25, Section 55, Flour Bluff and Encina) Farm and Garden Tracts, located in the 1700 Block of Waldron Road, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application #670-6, Dr. Joseph R. Lee and Mrs. Paul A. Thrailkill, for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on Lots 20 and 21, Block 11, Lawndale Subdivision, located at 3109 and 3113 South Staples Street. Larry Wenger pointed out the existing zoning and land use in the area surrounding the request property and explained that Dr. Lee maintains a chiropractic office in his home at the present time as a home occupation pointing out that properties to the west of. Kostoryz and along South Staples on both sides are developed with single-family dwellings; also a church, a school, a service station, and Gibson's Discount Center are located in the vicinity. He stated that at the Commission hearing held June 23, 1970, Dr. Lee spoke on behalf of the request stating since the time he purchased the property, South Staples Street had been widened and the neighborhood had deteriorated with respect to residential usage. Mr. Wenger stated that no one appeared at the hearing in opposition; that prior to the hearing the Staff mailed out fifteen notices, five received in favor and two in opposition; that it was the recommendation of the Planning Commission that the request, be approved, but it was the opinion of the Staff that this property should remain as it is presently zoned and used due to the fact that if the zoning • Minutes Special Council Meeting July 27, 1970 Page 3 change is granted, it would tend to encourage rezoning and downgrading of the properties fronting Staples north of the subject property. Dr. Joseph R. Lee, co -applicant, spoke on behalf of the request stating that the noise generated from the all-night service station (Texaco), the flashing neon signs, the ambulances from Clifford -Jackson Mortuary, the ball games at Lindale Park, and football practice at Ray High School, are all nuisances and for this reason he felt he must move his residence to another location but would like to continue his office at this location. The two daughters of Mrs. Paul A. Thrailkill, co -applicant, were present but stated they were not authorized to make a statement. No one appeared in opposition to the foregoing zoning request. Motion by Bradley, seconded by Sizemore and passed, that the hearing be closed. Motion by Bradley, seconded by Roberts that the recommendation of the Planning Commission be concurred in and thpt Application 4670-6, Dr. Joseph R. Lee and Mrs. Paul A. Thrailkill, for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on Lots 20 and 21, Block 11, Lawndale Subdivision, located at 3109 -and 3113 South Staples Street, be approved as requested. Commissioner McDaniel stated he felt the same nuisances complained of by Dr. Lee would apply to the other pieces of residential property in the area, and that whatever action the Council takes on this application would set a precedent for future zoning requests, and made. a motion that the matter be tabled for further consideration. The motion died for lack of a second. On vote of the Council, the foregoing motion to concur with the recommendation of the Planning Commission and grant the request passed by majority vote, and Mayor Blackmon directed that an ordinance be brought forward effectuating the change. Mayor Blackmon announced the public hearing on Application 0670-7, Mrs. Rebecca Dominguez, for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on Block 1, Lot 29, High Terrace Addition, located at 2712 Greenwood Drive. Larry Wenger stated that no one had appeared at the hearing which was held June 23, 1970, in opposition; that prior to the hearing the Staff mailed out 26 notices, one was received in favor and none in opposition, and that the Commission and the Staff had unanimously recommended that the application be approved as requested. 1 • Minutes Special Council Meeting July 27, 1970 Page 4 No one appeared in opposition to the foregoing request. Motion by Roberts, seconded by de Ases and passed, that the hearing be closed. Motion by de Ases, seconded by Roberts and passed, that the recommendation of the Planning Commission and the Staff be concurred in and that Application #670-7, Mrs. Rebecca Dominguez, for change of zoning from "R -1B" One -family Dwelling District to ''AB" Pro- fessional Office District, on Block 1, Lot 29, High Terrace Addition, located at 2712 Greenwood Drive, be approved as requested, and that an ordinance be brought forward effectuating the change, Mayor Blackmon proclaimed the period July 28 through July 30, 1970, as YOKOSUKA DAYS in the City in honor and recognition of the visit of Vice Mayor and Mrs, Kazuo Yokoyama and Miss Yoko Nagano, daughter of the Mayor of Yokosuka, sponsored by the Sister City Committee in connection with our affiliation with Yokosuka, Japan through the People -to -People Progtam, and urged all our citizens to extend every courtesy to these visitors and to make them welcome and to insure that their visit will be significant and highly enjoyable. City Manager Townsend recommended that the $6,550 of the Department of Labor Grant foraspecial summer recreation be used to sen(i275 boys to Camp Karankawa. He stated that the boys will be selected on the basis of need through neighborhood centers from which at least five adult supervisors must be made available; that 50 boys will attend regular sessions, the remaining 225 will attend a special camp from August 2, 1970, through August 10, 1970, and that the program will also furnish busses to transport the boys. Motion by Sizemore, seconded by de Ases and passed, that the foregoing recommendation of the City Manager be approved as presented. Commissioner de Ases commended the Nueces County Medical Society for agreeing to provide free medical examinations for the boys who will be selected from disadvantaged areas. There being no further business to come before the Council, the meeting was adjourned.
