SPECIAL COUNCIL MEETING
December 7, 1970

Mayor Pro Tem Gabe Lozano called the meeting to order and stated the
purpose of the special meeting was to hold public hearings on four zoning cases and
any other business as may properly come before the Council. He asked that it be
noted that a quorum of the Council and the required Charter officers were present,
and explained the procedure to be followed.
Senior City Planner Larry Wenger presented Application #1170-1, C. E.
Munson, for change of zoning from "A-2" Apartment House District to "AB" Profes-
sional Office District on all of Lot 5, Block 1, Doddridge Addition. He pointed out
the location on the zoning and land use map, and described the various zoning dis-
tricts and uses in the area including an architect's office located immediately
adjacent to the south, South Bluff Park across Tancahua Street, Midtown Interchange
to the north, and single-family residences, apartments and professional offices
throughout the area. He explained that professional offices are proposed for the
property; that at the Commission hearing, held November 10, 1970, Mr. T. C. Wilemon
spoke on behalf of the applicant stating it was his client's opinion that the pro-
posed use would be in keeping with the existing land uses; that no one appeared in
opposition; that prior to the hearing, the Staff mailed out 13 notices, four were
received in favor and none in opposition; that it was the recommendation of both
the Planning Commission and the Staff that it be approved as submitted.
The applicant, Mr. C. E. Munson, was present on behalf of the application
and stated that his statement had been submitted in writing.
No one appeared in opposition to the foregoing application.
Motion by Bradley, seconded by McDaniel and passed, that the hearing be
closed.
Motion by McDaniel, seconded by Roberts and passed, that the recommenda-
tion of the Planning Commission and the Staff be concurred in and that Application
#1170-1, C. E. Munson, for change of zoning from "A-2" Apartment House District to
"AB" Professional Office District on all of Lot 5, Block 1, Doddridge Addition,

located at 462 South Tancahua Street, be approved as requested, and that an
ordinance be brought forward effectuating the change.
Larry Wenger presented Application #1170-2, C. B. Ritter, for change of
zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on
a tract of land located in the 1900 Block of Waldron Road. He pointed out the loca-
tion on the zoning and land use map, and described the zoning classifications in the
immediate area. He stated that an apartment project is proposed for the property;
that the Planning Commission heard the request November 10, 1970; that there was no
opposition; that prior to the hearing the Staff mailed out 13 notices, three received
in favor and one letter received in opposition from a property owner outside the
200 -foot notification zone, and that two were received in favor after the public
hearing. He stated it was both the recommendation of the Staff and the Planning
Commission that the request be granted as submitted.
Mr. L. A. Gates, realtor representing the applicant, stated his client felt
this area very suitable for the proposed use due to the location of school facilities,
and the shortage of housing in this vicinity. He explained that he has a client
who is interested in buying the property for the purpose of developing it as an
apartment project, and that Mr. Ritter wishes to sell because the taxes are high
and it has become a burden to him.
No one appeared in opposition to the foregoing request.
Motion by Roberts, seconded by Bradley and passed, that the hearing be
closed.
Motion by Bradley, seconded by Roberts and passed, that the recommendation
of the Planning Commission and the Staff be concurred in and that Application #1170-2,
C. B. Ritter, for change of zoning from "R -1B" One -family Dwelling District to "A-1"
Apartment House District on approximately 7 acres out of Lots 1 & 2, Section 54,
Flour Bluff & Encinal Farm & Garden Tracts, located in the ;900 Block of Waldron
Road with a frontage of 330 feet and extending 924 feet in depth, be approved as
requested, and that an ordinance be brought forward effectuating the change.
Larry Wenger presented Application #1170-4, Billy W. & Gl�ria Bell, for'change
of zoning from "R -1B" One -family Dwelling District to "I.2" Light Industrial Dis-
trict on a 2.87 acre tract located in the 400 Block of Brett Street. He located the

property on the zoning and land use map, pointing out the various zoning uses in
the surrounding area, and explained that an industrial center is proposed for the
property. He stated that the Commission heard the request November 11, 1970; that
no one had appeared in opposition; that prior to the hearing the Staff mailed out
seven notices, none received in favor nor in opposition; that it was the recommendation
of both the Planning Commission and the Staff, that the applicatioe be approved as
requested.
City Manager Townsend pointed out that there may be problems in the area
airound the.Sanitary Fill Area because the lots must be platted before they can be
developed, and tIiat the City has no plans for improving any of the streets although
they are dedicated rights -df -Way.
No one appeared in favor or in opposition to the foregoing request.
Motion by Bradley, seconded by McDaniel and passed, that the hearing be
closed.
Motion by Bradley, seconded by Roberts and passed, that the recommendation
of the Planning Commission and the Staff be concurred in and that Application #1170-4,
Billy W. & Gloria Bell, for change of zoning from "R -1B" One -family Dwelling District
to "I-2" Light Industrial District on approximately 2.87 acres out of Lot 2, Byron
Willis Subdivision, located in the 400 Block of Brett Street with a frontage of 385
feet and depth of 325 feet, be approved as requested, and that an ordinance be
brought forward effectuating the change.
City Manager Townsend reported that a letter dated December 1, 1970, had
been received from Mr. Fred F. Morgan, Jr., in which he requested that Application
#1170-5, for change of zoning from "R -1B" One -family Dwelling District to "A-1"
Apartment House District on approximately a 28 -acre tract of land out of Lots 1 & 2,
Section 5, Range 8 of Gugenheim and Cohn Farm Lots, located in the 5100 Block of
Bear Lane, be withdrawn.
There being no further business to come before the Council, the meeting was
adjourned.
