Marvin Townsend City Attorney Jim Riggs City Secretary T. Ray Kring Mayor Jack R. Blackmon called the meeting to order. Commissioner W. J. Roberts gave the invocation in the absence of the invited Guest Chaplain. City Secretary T. Ray Kring called the roll of those in attendance. The Minutes of the Regular Council Meeting of December 23, and Regular Meeting of December 30, 1970, were approved as submitted to the Council. Members of the Student Council of Incarnate Word Academy were recog- nized, and Mayor Blackmon presented Certificates of Attendance and designated as Honorary Junior City Commissioners the following: Mary and Ann Skrobarczyk, Kathy Kelly, Mary Lynne Casteel, Pat Mulligan, and Twosy Haegelin. The group was accompanied by their sponsor, Mrs. Robert Haegelin. Bids were opened and read for the repair of Hurricane Celia damages to Lindale Recreation Center, from the following firms: Jack R. Mendenhall; Manson Industries; Robert Hall Construction Company; J.S.R. Building Company; Guaranteed Repair; Epperson Construction Company; Bartex, Inc.; Maurice Mendel, Inc.; and Atlantex Construction Corporation. The foregoing bids were tabled for 48 hours pursuant to the requirements of the City Charter and referred to the City Manager for tabulation and recommenda- tion. Bids were opened and read for Improvements to Gollihar Road, Unit III, Ayers Street to Kostoryz Road,from the following firms: B & E Construction Company; Asphalt Pavement Construction Company; South Texas Construction Company; and Heldenfele Brothers. The foregoing bids were tabled for 48 hours pursuant to the require- ments of the City Charter and referred to the City Manager for tabulation and recommendation. s Minutes City of Corpus Christi, Texas Regular Council Meeting January 6, 1971 Page.2 Mayor Blackmon called for the City Manager's Reports. Motion by Bradley, seconded by Lozano and passed, that the City Manager's Reports, Items "a" through "i", be accepted, and that the requests and recommenda- tions be granted and approved as follows: a. That a contract for the repairs of the Kiwanis Recreation Center be awarded to B. E. Beecroft and that $24,375 be appropriated for this purpose - $18,000 of this amount to be covered by insurance, and OEP expected to pay the remainder; b. That a contract for the repairs of the West Guth Maintenance Building be awarded to Epperson Construction Company, and that $4,175.99 be appropriated for this purpose - a request having been made to OEP for reimbursement of these costs; c. That the bid security procedure on public works projects be modified by requiring a.cashier's check, certified check or bank draft rather than a bid bond and reducing the amount involved to a sliding scale from a $200 minimum to 51/4 at $50,000 and 2% over $1,000,000, which procedure would eliminate collection problems on bid bonds, simplify the procedure, and would not materially increase the cost of bidding to the contractor. (The Highway Department uses basically these same requirements); d. That the Building Code revisions as recommended by the Special Citizen's Advisory Committee, be adopted, and that the ordinance be placed on a three -reading basis to provide more opportunity for public study and comment; e. Recommendation that a three-year non -drilling Oil & Gas Lease on 3.244 acres at the Woodlawn Recreation Center, and 1.055 acres at Glen Royal Subdivision - Park, be awarded to Charles J. Smith, Trustee, for $250.00 bonus, and the usual City Lease provisions, including 3/16th royalty; f. That a revised cooperation agreement with the Corpus Christi Housing Authority to expand the number of units from 1740 to 1970 to include the 230 Celia Units, extend the assurance of City support to the new units, and provide for an increased payment -in -lieu of taxes as a result of the additional units, be authorized; g. That the 0. N. Stevens Plant grounds be designated as a bird and wild- life sanctuary to the extent that such designation does not interfere with the Plant's L. s Minutes Regular Council Meeting January 6, 1971 Page 3 operation or expansion, or with existing or future agricultural leases, and that the property be so signed; h. That Special Commissioners award be placed on deposit regarding I. W. Shaffer, et ux property and that an appropriation of $3,090 be made to cover cost of said award. Mr. John Epperson of Epperson Construction Company, spoke with reference to the foregoing Item "c" and questioned the logic of the City changing its procedure on public works' projects by requiring that a cashier's check accompany the bid instead of the bid bond stating that the City holds the money for several weeks which works a hardship on a company bidding on several projects resulting in tying up too much of their working capital. He stated it would appear more reasonable to exclude those bonding companies who are reluctant to pay. City Manager Townsend pointed out that the new procedure would not materially increase the cost of bidding to the contractor; that the City has had difficulty in the past collecting the bid bonds, and that the only success in collecting the bond is getting involved in litigation. He explained that all of the checks except the low bids are released to the bidders the day of the bidding, and that in almost all cases the bids are awarded the following week. Motion by Sizemore, seconded by Roberts and passed, that the public hearing relative to Urban Renewal be further recessed one week.
