Marvin Townsend City Attorney Jim Riggs City Secretary T. Ray Kring Mayor Jack R. Blackmon called the meeting to order. Commissioner W. J. Roberts gave the invocation in the absence of the invited Guest Chaplain. City Secretary T. Ray Kring called the roll of those in attendance. The Minutes of the Regular Council Meeting of January 27, 1971, were approved as submitted to the Council. Mayor Blackmon announced the issuance of proclamations relative to the following: LULAC WEEK, February 14 through 20, 1971; and NATIONAL DEFENSE WEEK, February 12 through 22, 1971. Students of the Del Mar Student Congress were recognized, and Mayor Black- mon presented Certificates of Attendance to the following: Debbie Blackmon, Vice - President, and Charles Webster, Pat Sheridan, Gilbert Muniz, Elide Tames, and Pam Buhidar, Senators. Twenty -Year Service Certificates were presented on behalf of the Board of Trustees of the Firemen's Relief and Retirement Fund, to the following named Firemen: E. W. Tyler, Firefighter; R. Elizaldi, Fire Captain; John Lindell, Fire- fighter; B. Tanguma, Fire Captain; E. J. Whitaker, Fire Inspector; and J. R. Slack, Master Mechanic. Mayor Blackmon presented the name of Mr. William Whittle for appointment to the Nueces County Mental Health and Mental Retardation Community Service Board. Motion by Bradley, seconded by Roberts and passed, that the foregoing nomination be approved and confirmed. Mayor Blackmon presented the name of Dr. James G. Gabbard for appointment to the Nueces County Mental Health and Mental Retardation Community Service Board, to fill the vacancy created by the resignation of Mr. Bill B. Cobb. Minutes Regular Council Meeting February 10, 1971 Page 2 Motion by Lozano, seconded by Bradley and passed, that the foregoing nomination be approved and confirmed, Mayor Blackmon announced the opening of bids to be read by Director of Public Works Jack McDaniel. Bids were opened and read for McBride Lane Street and Storm Sewer Improve- ments, Leopard Street to Agnes Street and Westchester Subdivision, from the follow- ing firms: Heldenfels Brothers, Inc.; B & E Construction Company; South Texas Construction Company; and Asphalt Paving and Construction Company. The foregoing bids were tabled for 48 hours pursuant to the requirements of the City Charter and referred to the City Manager for tabulation and recommenda- tion. Bids were opened and read for Hurricane Celia damage repairs to the Gas Division Office and Gas Regulator Station, from the following firms: Bartex, Inc.; Guaranteed Repair; and Manson Industries. Mr. McDaniel stated that the bid of Manson Industries was accompanied by a cashier's check, but that Bartex, Inc., and Guaranteed Repair had not complied with the recently adopted policy that bids be accompanied by cashiers checks and had submitted bid bonds instead. City Attorney Jim Riggs advised the Council that the requirement was a formality which was within the Council's jurisdiction to waive. Mayor Blackmon ruled that the formality would be waived in this case as a matter of error and if for any reason either bidder is low, security of the bidder would be worked out in the contract, but pointed out that this would not be a precedent for future bids. The Council agreed to the ruling, the bids were accepted and tabled for 48 hours pursuant to the requirements of the City Charter and referred to the City Manager for tabulation and recommendation. Bids were opened and read for Hurricane Celia damage repairs to the Corpus Christi Museum Building from the following firms: B. E. Beecroft Company; Manson Industries; Hill Masonry Company (incomplete bid and disqualified); Bartex Incor- porated; Astro Construction Company; and Braselton Construction Company. The foregoing bids were tabled for 48 hours as required by the City Charter and referred to the City Manager for tabulation and recommendation. • Minutes Regular Council Meeting February 10, 1971 Page 3 Bids were opened and read for Hurricanedamage repairs to West Guth Park Swimming Pool Building from the following firms: Manson Industries; Jack R. Mendenhall; and Bartex Incorporated. The foregoing bids were tabled pursuant to the requirements of the City Charter and referred to the City Manager for tabulation and recommendation, Mayor Blackmon called for the City Manager's Reports. Motion by Lozano, seconded by Roberts and passed, that the City Manager's Reports, Items "a" through "n" be accepted, and that the requests and recommendations be granted and approved as follows: a. That the sale of $3,000,000 General Improvement bonds for authorized capital improvement projects be set for March 10, 1971, at 11:00 a.m., that Mr, Hobby H. McCall be employed as bond attorney, and that Mr. M. E. Allison serve as financial advisor under his contract which terminates April.1, 1971. Bonds to be sold are: Marina Improvements ($200,000); Service Center Improvements ($880,000); Sanitary Sewer Improvements ($650,000); Storm Sewer Improvements ($500,000); and Street Improvements ($770,000); b. That the date of February 26, 1971, 11:00 a.m., be set for receipt of bids for maintenance painting of the Meadow Park, Collier and Oso Swimming Pools; c. That the Corpus Christi Area Tourist Bureau's spring and summer news- paper advertising program, supported by the Hotel -Motel Occupancy Tax, whereby the ad will be included in ten newspapers in Texas and Oklahoma ($11,137.60), and in six magazines with national distribution ($9,124.00), be approved; d. That the date of March 3, 1971, be set for a public hearing on the closing of Carolyn Street from Lakeside Drive to HAS Drive; e. That the water rate ordinance changing the price of untreated water from 6C to 5C for 1,000 gallons for all water consumed in excess of 60,000,000 gallons per month be amended prior.to its third reading to provide a minimum charge for raw water customers equal to the average of the three highest years' consumption or the previous year's consumption whichever is higher times 1107 times the 1970-86 average annual debt service for Lake Corpus Christi which is $1,182,266 divided by the year 2010 yield of the reservoir which is 116,000,000 gallons per day times 365; f. That bids be received at 11 a.m., March 2, 1971, for the City's budgeted requirements of replacement and additional Heavy Equipment consisting of one l'J yd. • • Minutes Regular Council Meeting February 10, 1971 Page 4 Tractor Shovel, one 40 h.p. Diesel Tractor with sickle cutter, one 40 h.p. Diesel. Tractor with 3 point hitch, two 60 h.p. Aggregate Spreader Box, one self-propelled Aggregate Spreader and one Street Sweeper for Street Division; one 50 h.p. Gasoline Tractor with loader for Parks & Recreation Department; one 90 h.p. Diesel Tractor with PTO, Airport; one 8 ton Hydraulic Mobil Crane and one le yd. 4 -wheel drive Tractor with Backhoe and Loader, Water Division; one 40 h.p. Diesel Tractor with Loader and Trencher and one 50 h.p. Diesel Tractor with Loader and Backhoe, Gas Division; and one 12 ton Equipment Trailer for Sewer Division; g. That contracts be awarded to the following firms on the basis of low bid for a total sum of $25,799.00 (Bid Tabulation #7-71): Truckers Equipment, Inc. of Corpus Christi - Four cu.yd. Dump Bodies; two 80 ft. Brush Bodies; one 12 ft Brush Body; one Hose & Sprinkler Body; one 104" Service Body; one 120" Water Division Service Body; one 132" Service Body; and seven pairs Utility Tool Boxes, $20,349.00; Lufkin Industries, Inc. of San Antonio - one 12 to 15 cu, yd. Hydraulic. Dump Trailer, $5,450.00; h. That a temporary permit be issued to Getty Oil Company for temporary facilities to test their 7,700 foot Laguna Madre State Tract 41, Well #1, located approximately 1/2 mile east of Demit Island, to determine production capability, permit will expire June 15, 1971; i. That an easement for the construction of a 138 KV power transmission lint: through the Allison Sewer Plant property and the Westend Sanitary Landfill site be granted to Central Power and Light Company for 8 metal poles immediately adjacent to the McKenzie Road right-of-way, which easement will be revocable if the land is needed for street purposes; j. That Parcel No. 22 for Bayfront Open Space be acquired from Mr. and Mrs. Norman Foster for $8,760.00 and that $8,916.00 be appropriated, including $156.00 for closing, casts and related expenses; k. That the date of March 1, Special Meeting, be set for a public hearing on the following zoning applications: (1) Ruth Dearing.- from "R -1B" to "B-1" on the northeast corner of Everhart Road and Janssen Street; (2) Buford Nicholson - from "R -1B" to "A-1" on the south right-of-way line of Williams Drive, east of Daly Drive; (3) Roy Lay, Jr., & Carl D. Villarreal - from "R -1B" to "A-1" on the west right-of-way line of Waldron Road, south of Don Patricio Drive; Harold Kronke - from "R -1B" to "I-2" at 10322 Leopard Street, west of Charles Drive; and Mrs. Aileen M. That the City file a protest to the Texas Water Rights Commission against the increasing of the evaluation of a small dam on the Nueces River in Mc&,11en County for the reason that the dam would increase the storage by 80 acre feet which is not significant in itself but is part of a process of construction of many small storage facilities in the water shed which, if it continues, could endanger the dependability of the future water supply; m. Spoor, Judge and Dewey Nix, Alternate Mrs. Paul Bluntzer, Judge and Paul Bluntzer, Alternate American Little League lease in Botsford Park which expires after the 1972 season, be renewed for five years as recommended by the Park and Recreation Board so that repairs can be financed with Small Business Administration assistance: • • Minutes Regular Council Meeting February 10, 1971 Page 6 City Manager Townsend presented pending items and the following actions were taken: Motion by Sizemore, seconded by Roberts and passed, that the ordinance amending Section 11-5 of the Corpus Christi City Code, 1.958, as amended (also referred to as the "Building Code") , read at two several meetings of the City Council, being January 6, 1971 and January 13, 1971, be and the same is hereby amended as follows: 1. Delete from the caption the provision of adoption of Subsection 106.2, Contractor's License and Bond Required, of Chapter 1 of the Southern Standard Building Code, 1969 Edition, excepting payment of license tax, and providing for bond to be made payable to the use and benefit of the inhabitants of the City. 2. Changing the caption to provide that the design pressure, for Southern Coastal Region, as appears in the Table under Subsection 1205.1 of Chapter XII of the Southern Standard Building Code, 1969 Edition, as relaxes to buildings or structures under 30 feet be changed from 40 to 30 pounds per square foot horizontal load. 3. Changing the caption by deleting the first sentence of Subsection 1205.5 (a) of Chapter XII, Southern Standard Building Code, 1969 Edition, and in lieu thereof adding a new sentence providing for signs to conform to wind design pressure loads stated and listed. 4. Deleting from the caption the provision concerning the addition of a subparagraph (d), concerning construction of fences, to Subsection 1205.5 of Chapter XII of the Southern Standard Building Code, 1969 Edition. 5. Deleting from the caption the provisions concerning designation of the first paragraph of Section 1503 of Chapter XV of the Southern Stan- dard Building Code, 1969 Edition, as Subsection 1503.1, and the second paragraph of said Section as Subsection 1503.2; deleting the addition of Subsection 1503.3, pertaining to design and materials of cold -formed steel, and Subsection 1503.4, pertaining to steel roof deck construction. 6. That Section 4 of the ordinance, pertaining to adoption of Subsec- tion 106.2, CONTRACTORS LICENSE AND BOND REQUIRED, of the Southern Standard Building Code, 1969, be deleted in its entirety. • Minutes Regular Council Meeting February 10, 1971 Page 7 7. That Section 5 of the ordinance, relating to Subsection 108.3, SPECIAL HURRICANE INSPECTIONS, be amended by amending subparagraph (c) to hereafter read as follows: "(c) No building or other structure or assembly or part thereof which is structurally unsafe for human occupancy, or dangerous to adjacent premises, buildings, structures, assemblies, or parts thereof, or collapsed shall be repaired or altered or otherwise returned toits original position without inspection and approval by the Building Official." 8. That Section 8 of the ordinance, which proposes amending of the Table under Section 1205.1 - MINIMUM DESIGN LOADS of Chapter XII of the Southern Standard Building Code, 1969 Edition, be amended to change the design pressure, for Southern Coastal Region, in the less than 30 -foot height zone, from 40 to 30 pounds per square foot horizontal load. 9. That Section 9 of the ordinance be amended to provide for deletion of the first sentence of Paragraph 1205.5 (a) of Chapter XII, being in 1205.5 - SIGNS, of the Southern Standard Building Code, 1969 Edition, and in lieu thereof, inserting the following sentence: "All signs shall conform to the wind design pressure loads listed in 1205.1 and as amended and all ordinary solid signs elected on ground level shall be capable of withstanding a load of thirty (30) pounds per square foot for height zone of less than 30 feet." 10. That Section 10 of the ordinance, relating to addition to Sub- section 1205.5 of Chapter XII of the Southern Standard Building Code, 1969 Edition, of subparagraph (d) concerning construction of fences, be deleted in its entirety. 11. That Sections 12 and 13 of the ordinance, concerning designation of the first paragraph of Section 1503 of Chapter XV of the Southern Standard Building Code, 1969 Edition, as Subsection 1503.1, the second paragraph of said Section as Subsection 1503.2, the addition of Sub- section 1503.3 and addition of Subsection 1503.4, be deleted in their entirety. • Minutes Regular Council Meeting February 10, 1971 Page 8 12. That Section 17 of the ordinance, concerning Appendix I to Section 2506 - MOBILE HOMES, be amended as follows: add to subparagraph (a) the following wording: "provided, however, mobile homes as herein defined installed upon or connected to utilities on land within the corporate limits and approved for occupancy by the City as of the effective date of this ordinance shall be required to comply with the provisions, as to this Appendix, of 1-6, Subsections 1 through 5." Adding to 1 - 4 Definitions, further definition as to mobile homes, said paragraph to hereafter read: "Mobile Home - A vehicular, portable structure built on a chassis and designed to be used without a permanent foundation as a dwelling for year-round living when connected to indicated utilities (per ANSI Standards A110.1). It may consist of one or more units that can be telescoped when towed and expanded later for additional capacity, or of two or more units, separately towable but designed to be joined into one integral unit." Adding to 1 - 5 Identification, further provision as to identifi- cation, the first paragraph to hereafter read: "A mobile home unit may bear the label or seal of compliance with the Standard for Mobile Homes A119.1, of a recognized independent, engineering testing laboratory and/or agency having follow-up inspec- tion services, or a seal of certification by the Bureau of Labor Statistics issued pursuant to the Uniform Standards Code for Mobile Homes, Chapter 656 (S.B. 153) 61st Legislature. of Texas - Regular Session. Such label or seal shall be deemed to be in full compliance with the standards for mobile homes prescribed by the Southern Building Code,Congress within the governmental jurisdiction which has approved such independent recognized testing laboratory for this service." Adding a new paragraph following the last paragraph of 1 - 5, Identification, said new paragraph to read as follows: "All mobile homes shall be anchored and tied down in a manner equivalent to or better than the following on or before June 1, 1971, as follows: • Minutes Regular Council Meeting February 10, 1971 Page 9 "1-6 Anchorage - Minimum Hurricane TieDown Requirements (Approved Blocking and Anchorage is Illustrated in this Appendix)" • Adding to B, of Paragraph numbered 2 Anchors, under 1 - 6, a new sentence reading as follows: "A11 augers must be screwed into the earth the full four -foot depth." Adding the word "or" at the end of A and B of paragraph numbered 3 Connectors. Adding the word "or" at the end of B of paragraph numbered 4 Piers and Footings. Deleting the present item D under 4 Piers and Footings, and in lieu thereof, adding a new item D, reading as follows: "D. Wood Blocks used for leveling shall not exceed a maximum thick- ness of four (4) inches. Such blocks must be of nominal 8" x 16" dimensions." Substituting the work "equivalent" for the word "similar" in first sentence item E, under 4 Piers and Footings. Adding Subsection 6, Travel Trailers (Local Rule). 13. That Section 7 of the ordinance, concerning the addition to Section 1203 of Chapter XII, Southern Standard Building Code, 1969 Edition, of an item following paragraph 1203.1, relating to cantilevered projections, be changed to include the provision that building exteriors "shall be designed for not less than 60 pounds per square foot live load or 200 pounds per linear foot live load applied at the outer edge." 14. Amending Section 18 of the Ordinance, relating to adoption of new Subsection 1707.9 - ROOF COVERINGS, 1707.9(A) - General, by amending she wording under subparagraph (A), said subparagraph to hereafter read as follows: PERMITS: (a) A permit shall be required for the erection, con- struction, fabrication, application, or repair of any roof covering as set forth in this Code." Deleting subparagraph ( B) in its entirety. • • Minutes Regular Council Meeting February 10, 1971 Page 10 15. That subparagraph (D) Nailing: Under Section 1707.9(D) - BUILT-UP FELTS AND GRAVEL, be amended by deleting the words "or •ring- shanked nails having not less than 20 rings per inch." 16. Amending Item 7, RESISTANCE TO UPLIFT: under Section 1707.9(j) ROOF TILE, to hereafter read as follows: "7. RESISTANCE TO UPLIFT: Roof tile shall be secured to the roof surface to resist uplift forces as calculated in Chapter XII of the Code." 17. That all sections of the said Ordinance, as hereby amended, be and the same are accordingly renumbered to correspond with the revised number- ing necessitated by the changes herein adopted. 18. Adding a new section, Section 15, concerning approved materials or devices, rules and standards. 19. Adding a new Section 16, providing that the ordinance amending the Building Code as herein provided, shall be filed in the office of the City Secretary as a part of and as the authenticated amendment of the aforesaid Corpus Christi City Code, 1958, as amended, of the aforesaid Southern Standard Building Code, 1969 Edition as amended, with the 1970 Revision, and of the Appendices thereto, for all purposes, and shall be integral to the "Building Code" of the City, commonly called. 20. Providing for repeal of all ordinances or parts of ordinances in conflict with the provisions of this ordinance by adding a new Section 17. 21. Adding a new Section 18 providing for severance clause. 22. Adding a new Section 19 providing for publication. Motion by Roberts, seconded by Bradley and passed, that the recommendation of the Planning Commission be concurred in and that Application #770-3, Roy Smith and E. 5. Joslin, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District on a 13.1 -acre tract of land out of Lots 2, 3 and 4, Section 3, Flour Bluff & Encinal Farm & Garden Tracts, bounded by Mt. Vernon Drive, South Padre Island Drive, Holmes Drive and Prinston Drive, be approved as requested, and that an ordinance be brought forward effectuating the change. Motion by Roberts, seconded by de Ases and passed, that the recessed public hearing relative to Urban Renewal be further recessed for one week.
