4. Motion approving a supply agreement with Ergon Asphalt & Emulsions, Inc., of
Austin, Texas for emulsion oil, in accordance with Bid Invitation No. BI-0221-08
based on only bid for an estimated six-month expenditure of $66,235. The term
of the contract will be for six months with an option to extend for up to five
additional six month periods subject to the approval of the supplier and the City
Manager or his designee. This material is used by Street Services for
maintenance of city streets. Funds have been budgeted by Street Services in FY
2008-2009.

I, the Director of Finance of the City of Corpus Christi, Texas (or his/her duly authorized representative);
hereby certify to the City Council and other appropriate officer that the money required for the contract,
agreement, obligation or expenditure described below is in the Treasury to the credit of the Fund specified
below, from which it is to be drawn, and has not been appropriated for any other purpose.

Austin, Texas for emulsion oil in accordance with Bid Invitation No. BI-0221-08, based on only
bid, for an estimated six month expenditure of $66,235.00. The term of the contract will be for
