Riggs City Secretary T. Ray Kring Mayor Jack R. Blackmon called the meeting to order. The Invocation was given by The Reverend R. L. Brown, Pastor of Brooks Chapel AME Church. City Secretary T. Ray Kring called the roll of those in attendance. The Minutes of the Regular Council Meetings of May 12, and of May 19, 1971, were approved as submitted to the Council. Mayor Blackmon announced that a proclamation had been issued designating the month of June, 1971, as DAIRY MONTH. Public Works Director Jack McDaniel opened and read bids for Hurricane Celia Repairs to Memorial Coliseum from the following firms: Roofcraft, Inc., (Higgins Corp.); Manson Industries; and B. E. Beecroft. The foregoing bids were tabled for 48 hours pursuant to the requirements of the City Charter and referred to the City Manager for tabulation and recommendation. City Manager Townsend presented the pending item relative to a request presented at the May 19, 1971, Council Meeting by Mr. Jack Kelso, representing Mr. Dan Brown of the Dockter Pet Center, to amend the Animal Control Ordinance to permit certain animals in the City without regulation. He stated it was the recommendation of the Staff that the ordinance not be so amended, but stated if it is the desire of the Council to amend the ordinance, it would be his recommendation that it include regulations concerning rabies vaccinations, caging, leashing, quarantine period, and other health considerations. Motion by de Ases, seconded by Bradley and passed, that the recommendation of the City Manager be concurred in and that the request to amend the Animal Control Ordinance be denied. Mayor Blackmon called for the City Manager's Reports. Motion by Roberts, seconded by Sizemore and passed, that the City Manager's Reports, Items "a" through "c" be accepted, and that the requests and recommendations be granted and approved as follows. • • Minutes Regular Council Meeting May 26, 1971 Page 2 a. That the zoning application of Mr. E. L. Delgadillo which was with- drawn by the applicant's attorney prior to its scheduled January 4, 1971 hearing before the City Council, be considered as not properly disposed of and that he be allowed to resubmit his application without fee in view of the apparent misunder- standing between Mr. Delgadillo and his attorney as to the course of action to be followed; b. That a resolution be passed authorizing the City Manager to make appli- cation, and the Transportation Study Committee to proceed with submissions to the Texas Highway Department requesting approval of the Federal Air for Urban Systems map, and requesting that a number of streets included on the map be included in the first year program; that the only bid received on Ayers Street improvements from Port to Norton be rejected, and that Ayers Street from S. H. 358 to Norton and South Staples from Padre Island Drive to Saratoga be included in the first year program request to the Texas Highway Department; c. That an application be authorized to Housing and Urban Development (HUD) for an urban beautification and improvement grant of $106,010 for Federal assistance in initially developing or improving 20 park areas, which program is based on 50/50 participation in those costs in excess of the average park improve- ment costs of the two previous fiscal years. ORDINANCE NO. 10264 REDECLARING, UNDER ART. 5890e, V.A.C.S., TEXAS AND ARTICLE 1175, V.A.C.S., TEXAS AND FOR IMPLEMENTATION OF THE CITY -HUD CONTRACT OF AUGUST 12, 1970, UNDER AUTHORITY OF PUBLIC LAW 70 AND PUBLIC LAW 875,U.S. CONGRESS, AS AMENDED, AND THE DISASTER RELIEF ACT OF 1969, AS AMENDED, THE STATE OF CIVIL EMERGENCY CONTINUING IN THE CITY OF CORPUS CHRISTI AS A RESULT OF HURRICANE CELIA AND AUTHORIZING THE ESTABLISHMENT BY THE CITY OF MOBILE HOME PARK ACCOMMODATIONS FOR DISASTER HOUSING PURPOSES WITHIN THE CITY AS HERETOFORE AUTHORIZED BY THE CITY COUNCIL, TO CONTINUE THE SAME; PRO- VIDING SEVERABILITY; PROVIDING NOTICE AND PUBLICATION; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Blackmon, Lozano, Bradley, de Ases, McDaniel, Roberts and Sizemore, present and voting "Aye." RESOLUTION NO. 10265 AUTHORIZING THE CITY MANAGER TO MAKE APPLICATION TO THE TEXAS HIGHWAY DEPARTMENT FOR FEDERAL ASSISTANCE FOR THE CONSTRUCTION OF AYERS STREET FROM NORTON TO PORT AVENUE, AND SOUTH STAPLES STREET FROM PADRE ISLAND DRIVE TO SARATOGA BOULEVARD, PURSUANT TO THE FEDERAL -AID HIGHWAY ACT OF 1970 FOR URBAN SYSTEMS; .AND FURTHER AUTHORIZING THE CORPUS CHRISTI TRANSPORTATION STUDY COMMITTEE TO HANDLE THE NECESSARY SUBMISSIONS TO 116 HIGHWAY COMMISSION AND PREPARE PLANS FOR CONSTRUCTION; AND DECLARING AN EMERGENCY. • • Minutes Regular Council Meeting May 26, 1971 Page 3 The Charter rule was suspended and the foregoing resolution was passed by the following vote: Blackmon, Lozano, Bradley, de Ases, McDaniel, Roberts and Sizemore, present and voting "Aye." RESOLUTION NO. 10266 EXPRESSING THE WILLINGNESS OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TO MAKE APPLICATION UNDER TITLE IX OF THE ROUSING AND URBAN DEVELOPMENT ACT OF 1965 FOR A FEDERAL GRANT FOR URBAN BEAUTIFICATION AND IMPROVEMENT; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing resolution was passed by the following vote: Blackmon, Lozano, Bradley, de Ases, McDaniel, Roberts and Sizemore, present and voting "Aye." ORDINANCE NO. 10267 CANVASSING RETURNS AND DECLARING THE RESULTS OF THE RUNOFF ELECTION FOR THE PURPOSE OF ELECTING THE MAYOR AND COMMISSIONERS OF THE CITY OF CORPUS CHRISTI HELD ON THE 22ND DAY OF MAY, 1971; AND DECLARING AN EMERGENCY. The Charter rule was suspended and the foregoing ordinance was passed by the following vote: Blackmon, Lozano, Bradley, de Ases, McDaniel, Roberts and Sizemore, present and voting "Aye." Mayor Blackmon announced that the passage of the foregoing Ordinance No. 10267, constituted the official canvass of the votes cast in the May 22, 1971, City Runoff Election in accordance with the official returns submitted and certified by City Secretary Ray Kring, and are available for review by those who may desire. Mayor Blackmon announced that Certificates of Commendation to the Corpus Christi Area News Media for their distinguished service in disseminating the news and emergency reports before and during Hurricane Celia, had been prepared and signed on behalf of the citizens of Corpus Christi in appreciation for this service, and were now available in the office of Mayor Sizemore. Mayor Blackmon congratulated the newly elected Mayor and Council members and invited them to join the Council at the Council Table for swearing-in ceremonies. He introduced the Honorable Noah A. Kennedy, Judge of 148th District Court who administered the Oaths of Office to Mayor Ronnie Sizemore, and to Commissioners, J. Howard Stark, Roberta Basques, M.D., Gabe Lozano, Sr., Charles A. Bonniwell, Reverend Harold T. Branch, and Thomas V. Gonzales. Judge Kennedy declared the foregoing to be the duly elected Mayor and Council of the City of Corpus Christi for the term 1971-73. • • Minutes Regular Council Meeting May 26, 1971 Page 4 Mayor Sizemore presented outgoing Mayor Blackmon with the gavel which he had used for conducting the Council meetings during his terms as Mayor from 1967 to 1971, and commented that "during the last four years the gavel had seen at least twenty years of service." He also expressed his pleasure and appreciation on having had the opportunity of serving on the Council with the other Commissioners, and presented to each of them the name plates which had identified them at the Coucil Table during their terms of office. He expressed confidence that their retirement Council from the City/would not terminate their activities as community leaders. Mayor Sizemore read and presented, on behalf of the citizens of Corpus Christi, a resolution commending Mayor Blackmon for his outstanding devotion and. services rendered to the City of Corpus Christi, and in recognition of this faithful service and the many permanent improvements occasioned during his tenure as mayor, officially appointing him to the honorable position of Mayor Emeritus. Mayor Emeritus Blackmon humorously pointed out that the Council had had some difficulty in always finding parking space available around City Hall, and stated that for one day at least the City Hall Driveway would be reserved for their parking, and proclaimed the City Hall Driveway to bear the names of the six Council - Lozano Lane, men simultaneously for the day. The street signs bearing their names,/Bradley Boule- vard, de Ases Lane, McDaniel Driveway, Roberts Road and Sizemore Street, were presented respectively to them. Mayor Sizemore reciprocated by presenting another sign bearing the name "Blackmon Boulevard" and commented "may it always rest in peace." Mayor Emeritus Blackmon also presented the footstool to Mr. de Ases, facetiously stating that its use had contributed to his comfort at Council meetings which explained his patience and ability to endure the long sessions and make prompt decisions. Mayor Sizemore and each of the newly elected Commissioners madd brief acceptance speeches and introduced members of their families and friends who were present for the occasion. Others in the audience recognized were former Mayor Ben F. McDonald, unsuccessful candidate for Mayor in the Runoff Election; his People's Party running mate, George E. Clower, Jr., and unsuccessful independent candidates, Tom Ducote and Joe Moreno, all of whom congratulated Mayor Sizemore and the new Council. • Minutes Regular Council Meeting May 26, 1971 Page 5 Mayor announced the first item of business of the new Council was the election of mayor pro tem, and called for nominations. Mr. Gabe Lozano, Jr., approached the Council Table stating that he was aware that in all probability the Council had made its decision relative to the selection of mayor pro tem, and that traditionally, the position went to the member polling the most votes, and that his father would probably make the nomination. He stated that with all due respect to Mr. Bonniwell, he was requesting that this Council break that tradition and reconsider its decision and elect his father, Gabe Lozano, Sr. He stated the mayor pro tem should be experienced and that he felt his father met that qualification. Commissioner Lozano stated heves proud that his son felt he was qualified, but that he "could be a little biased." Commissioner Lozano nominated Commissioner Bonniwell as Mayor Pro Tem and urged that he be elected. The nomination was seconded by Commissioner Branch and unanimously passed. Mayor Sizemore commended Commissioner Lozano for following tradition and expressed praise for him as a person and as a Councilman. Mr. Lozano received a standing ovation from the audience. The following Resolution was signed by Mayor Sizemore, Mayor Pro Tem Bonniwell, and Commissioners Bosquez, Branch, Gonzales, Lozano and Stark. RESOLUTION NO. 10268 EXPRESSING GRATITUDE TO JACK R. BLACKMON ON THE OCCASION OF HIS RETIREMENT' FROM OFFICIAL DUTIES AS MAYOR AND _APPOINTING HIM TO THE POSITION OF "MAYOR EMERITUS" OF THE CITY OF'CORPUS CHRISTI. The Benediction was delivered by The Reverend Elliott Grant, Pastor of St. Matthew's Missionary Baptist Church.
