5. Motion approving a supply agreement with Ergon Asphalt & Emulsions, Inc., of
Austin, Texas for emulsified polymerized asphalt ~HFRS-2~ in accordance with
Bid Invitation No. BI-0123- 09 based on only bid for an estimated semi-annual
expenditure of $289,450. The term of the agreement shat! be for six months
with options to extend for up to five additional six-month periods, subject to the
approval ofthe supplier and the City Manager or his designee. Funds have been
budgeted by the Street Department for FY 2009-2010.

I, the Director of Financial Services of the City of Corpus Christi, Texas for hislher duly authorized
representative},hereby certify to the City Council and other appropriate officers that the money required for
the current fiscal year's portion of the contract, agreement, obligation or expenditure described below is in
the Treasury to the credit of the Fund specified below, from which it is to be drawn, and has not been
appropriated for any other purpose. Future payments are subject to annual appropriation by the City
Council.
