Ray Kring • Mayor Sizemore called the meeting to order and noted that a quorum of the Council and the required Charter officers were present. He explained the purpose of the meeting was to hold public hearings on scheduled zoning applications and any other business as may properly come before the Council. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Sizemore announced that formal request had been received from the applicant by letter dated July 19, 1971, to withdraw the scheduled case captioned #771-3, James R. Preis, for change of zoning on Lot 3, Block 4, Cabaniss Acres. Mayor Sizemore announced the public hearing on Application #471-1, Flato Brothers, Inc., for change of zoning from "B-4" to "1-3" on a 20 -acre tract of land, being a portion of Lots 7 & 8, Section 65, Flour Bluff and Encino) Farm and Garden Tracts. He explained that the request was heard by the Planning Commission April 13, 1971, and forwarded to the Council with the recommendation that it be denied, but in lieu thereof, a Special Permit be granted for a travel trailer park subject to the plot plan approved by the Planning Com- mission. Senior City Planner Larry Wenger pointed out that the Planning Commission recommended approval of a Special Permit for a travel trailer park according to the plot plan presented realizing that they intend to develop only a portion (100 units) of the site at this time, and if concurred in by the Council, should only apply to the portion of the area on which the plot plan shows actual development. He stated the ordinance granting the Special Permit should be written to encompass only that portion of the area shown on the approved plot plan for actual development and should be described by metes and bounds. It was agreed that the remainder of the tract would automatically remain zoned "B-4" General Business District. • • Minutes Special Council Meeting August 9, 1971 Page 2 Mr. Wenger stated that a site plan for the remaining portion of the tract was discussed with the applicant on several occasions but that no site plan had been submitted. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Stark, seconded by Lozano and passed, that the hearing be closed. Motion by Lozano, seconded by Stark and passed, with Bonniwell abstaining, that the recommendation of the Planning Commission be concurred in and that Application #471-1, Flato Brothers, Inc., for change of zoning from "B-4" General Business District to "1-3" Heavy Industrial District on a 20 -acre tract of land which is a portion of Lots 7 & 8, Section 65, Flour Bluff and Encinal Farm and Garden Tracts, bounded on the north by Gateway Park Sub- division; on the east by Laguna Madre; on the south by the common boundary line of Lots 7 and 18, Flour Bluff and Encina) Farm and Garden Tracts, and on the west by Laguna Shores Road and the common boundary line of Lots 8 & 9, Flour Bluff and Encinal Farm and Garden Tracts, be denied, but in lieu thereof, a Special Permit be granted on the portion described by metes and bounds shown on the approved plot plan showing actual development, and subject to said plot plan, and that an ordinance be brought forward effectuating the change. Mayor Sizemore announced the public hearing on Application 0771-4, S. F. Crecelius, for change of zoning from "R -1B" One -family Dwelling District to a Community Unit Plan on a 26 -acre portion of Tracts 1D and 2D of the J. C. Russell Farm Partition, Block 4. He explained that the request was heard by the Planning Commission July 6, 1971, and forwarded to the Council with the recommendation that it be approved subject to the drainage ditch problem being resolved and a new site plan not to exceed 154 units, on the basis that the proposed residential development is a logical use for this area because the property is located near schools and other residential developments. City Manager Townsend explained the drainage problem in this area in relation to the construction of a drainage system by Village on the Green, stating that there is insufficient drainage through a 100 -foot strip along Bear Lane, that flooding of all the areas will result, and that the applicants have been so advised. He stated there are presently no bond funds available for improving this problem. • • Minutes Special Council Meeting August 9, 1971 Page3 No one appeared in opposition to the recommendation of the Planning Commission. Motion by Bonniwell, seconded by Lozano and passed, that the hearing be closed. Motion by Bonniwell, seconded by Gonzales and passed, that the foregoing application be tabled for further consideration. Mayor Sizemore announced the public hearing on Application #771-5, H. C. Gillespie III, for change of zoning on Lot B, Replat of Lot 26, Section 2, Flour Bluff and Encinal Farm and Garden Tracts. He stated that the request was heard by the Planning Commission July 6, 1971, and forwarded to the Council with the recommendation that it be approved on the basis that it would be a logical zoning for this property since it is surrounded on three sides by "B-4" zoning. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Bonniwell, seconded by Stark and passed, that the hearing be closed. Motion by Bonniwell., seconded by Stark and passed, that the recommendation of the Planning Commission be concurred in and that Application #771-5, H. C. Gillespie III, for change of zoning from "B-1" Neighborhood Business District to "B-4" General Business District on Lot B, Replat of Lot 26, Section 2, Flour Bluff and Encina) Farm and Garden Tracts, located in the 4800 Block of South Staples Street, be approved as requested and that an ordinance be brought forward effectuating the change. Mayor Sizemore announced the public hearing on Application of Charles R. Rapp re Special Use #71-11, for a mobile home park on the south half of Lot 2 and a portion of the south half of Lot 1, Section 53, Flour Bluff and Encina) Farm and Garden Tracts. He explained that the request was heard by the Planning Commission July 6, 1971, and forwarded to the Council with the recommendation that it be approved subject to a final plot plan for the following reasons: (1) this development would be a logical use for this property; and (2) there are other mobile home developments in this area and adjacent to the subject property. No one appeared in opposition to the foregoing request. Motion by Stark, seconded by Bonniwell and passed, that the hearing be closed. *Commission Bosquez arrived at the meeting. • Minutes Special Council Meeting August 9, 1971 Page 4 Motion by Lozano, seconded by Gonzales and passed, Bosquez abstaining, that the recommendation of the Planning Commission be concurred in and that Special Use 071-11, Charles R. Rapp, for a mobile home park on the south half of Lot 2 and a portion of the south half of Lot 1, Section 53, Flour Bluff and Encinal Farm and Garden Tracts, (approximately 8 acres), located in the 2900 Block of Waldron Road, be approved subject to a final plot plan, and that an ordinance be brought forward effectuating the Special Use Permit. Mayor Sizemore announced the public hearing on the request of K. D. Pool for Special Use Permit #71-10, for a mobile home park on a 60.24 -acre tract of land known as Parcel A of the Section Partition of Weil Lands. He stated the request was heard by the Planning Commission July 6, 1971, and forwarded to the Council with the recommendation that it be approved subject to a plot plan indicating two or more streets to be used as accessways to Leopard Street on the basis that this general area has been established for mobile home development, and the property is located on a major thoroughfare. Murray Bass, Munroe & Bass Engineers, spoke on behalf of the applicant, and stated the recommendation of the Planning Commission was acceptable. No one appeared in opposition to the foregoing request. Motion by Bonniwell, seconded by Lozano and passed, that the hearing be closed. Motion by Bonniwell, seconded by Lozano and passed, that the recommendation of the Planning Commission be concurred in and that the application of K. D. Pool, Special Use #71-10, for a mobile home park on a 60.24 -acre tract of land known as Parcel A of the Second Partition of Weil Lands, located on Leopard Street (Highway #9) immediately west and south of the Trade Winds Motel, be approved subject to a plot plan indicating two or more streets to be used as accessways to Leopard Street, and that an ordinance be brought forward effectuating the Special Use Permit. There being no further business to come before the Council, the meeting was adjourned.
