SPECIAL COUNCIL MEETING
September 22, 1971

Mayor Ronnie Sizemore called the Special Meeting to order and stated
the purpose of the meeting was to hold public hearings on scheduled zoning appli-
cations and any other business as may properly come before the Council. He
explained the procedure to be followed, and asked that it be noted that a quorum
of the Council was present.
City Manager Townsend presented Application #871-7, G. F. Bayder, for
change of zoning from "B -IA" Tourist Court District to "B-1" Neighborhood Busi-
ness District on a 2.870 -acre tract of land out of Lot 9, Section 13, Flour, Bluff
& Encinal Farm & Garden Tracts. He explained that the request was heard by the
Planning Commission August 17, 1971, and forwarded to the Council with the recom-
mendation that it be approved as a logical use for this area and an expansion of
the "B-1" zoning adjacent to the east.
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Bonniwell, seconded by Lozano and passed, that the hearing be
closed.
Motion by Gonzales, seconded by Bonniwell and passed, that the recom-
mendation of the Planning Commission be concurred in and that Application #871-7,
G. F. Bayder, for change of zoning from "B -1A" Tourist Court District to "B-1"
Neighborhood Business District on a 2.870. -acre tract of land out of Lot 9, Sec-
tion 13, Flour Bluff & Encinal Farm & Garden Tracts, located on the southeast
corner of Candlewood Drive and in the 6300 Block of South Padre Island Drive, be
approved as requested, and that an ordinance be brought forward effectuating the
change.
Mayor Sizemore presented Application #871-8, Maverick Markets, Inc., for
change of zoning from "F -R" Farm -Rural District to "B-4" General Business District,
on a .80 -acre portion of land out of a 74.185 -acre tract, located near the north-
east corner of Rand Morgan Road and Highway #F9. He explained that the request
was heard by the Planning Commission August 17, 1971, and forwarded to the Council

with the recommendation that it be approved as a logical use for this area.
The purchaser of the property was present and stated the purchase was
subject to the requested rezoning which expires in 120 days.
No one appeared in opposition to the foregoing request.
Motion by Gonzales, seconded by Bosquez and passed, that the recommenda-
tion
ecommendstion of the Planning Commission be concurred in and that Application #871-8,
Maverick Markets, Inc., for change of zoning from "F -R" Farm -Rural District to
"B-4" General Business District, on a .80 -acre portion of land out of a 74.185 -acre
tract known as Survey 416, Abstract 572, Nueces County, Texas, being out of Share 2,
George Frank Partition D, located near the northeast corner of Rand Morgan Road
and Highway #9, be approved as requested, and that an ordinance be brought forward
effectuating the change.
Mayor Sizemore presented Application #871-10, Jim W. Machlan, for change
of zoning from "A-1" Apartment House District to "AB" Professional Office District,
on the north 50' of the east 100' of Lot 2, Block 1, South End Addition. He stated
that the request was heard by the Planning Commission August 17, 1971, and forwarded
to the Council with the recommendation that it be approved as a logical use in this
area.
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Lozano, seconded by Bosquez and passed, that the hearing be
closed.
Motion by Lozano, seconded by Gonzales and passed, that the recommenda-
tion of the Planning Commission be concurred in and that Application #871-10, Jim
W. Machlan, for change of zoning from "A-1" Apartment House District to "AB" Pro-
fessional Office District, on the north 50' of the east 100' of Lot 2, Block 1,
South End Addition, located on the southwest corner of Park Avenue and in the
600 Block of South Carancahua, be approved as requested, and that an ordinance
be brought forward effectuating the change.
Mayor Sizemore announced the public hearing on Application 871-11, Tom
Brundage, for change of zoning from "R -1B" One -family Dwelling District and
"B -1A" Tourist Court District to "I-2" Light Industrial District, on a 2 -acre
portion of Lot 2, Byron Willis Addition, having a frontage of 170' on South Padre

Island Drive and a depth of 422 feet. He explained that the request was heard
by the Planning Commission on August 17, 1971, and forwarded to the Council with
the recommendation that it be approved as requested because the applicant's
option will expire prior to the City Council's action on the proposed amendment.
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Lozano, seconded by Bonniwell and passed, that the recom-
mendation of the Planning Commission be concurred in and that Application #871-11,
Tom Brundage, for change of zoning from "R -1B" One -family Dwelling District and
"B -1A" Tourist Court District to "I-2" Light Industrial District, on a 2 -acre
portion of Lot 2, Byron Willis Addition, having a frontage of 170' on South
Padre Island Drive and a depth of 422 feet, be approved as requested, and that
an ordinance be brought forward effectuating the change.
Mayor Sizemore announced the public hearing on Application $71-12, A. Ybarra,
for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighbor-
hood Business District, on Lot 32, Block 1, Parklane Addition. He stated the request
was heard by the Planning Commission April 27, 1971, and forwarded to the Council
with the recommendation that it be denied, but in lieu thereof a Special Permit
be granted for doctors' offices according to a plot plan approved by the Planning
Commission indicating the location of the building, screening and parking, meeting
all the necessary requirements for a professional office use.
Mr. Gene Thornton, 4725 Alice Street, spoke in opposition to the granting
of the special permit, stating that it would be an encroachment into an established
residential neighborhood; would increase traffic; and that there would be insuffi-
cient praking space for professional offices. He stated there are other avail-
able lots already zoned for the proposed use, and that they feel the request is
not justified.
Mr. Sam Ferris, 602 Harrison, spoke in opposition, stating he owned the
property immediately adjacent to the subject property, and felt that the parking
was not adequate; that the street was very narrow, and that the increased traffic
would be a hazard for the small children living in the area residences.
Mr. Lewis Lanfear, Flour Bluff Road, spoke in opposition, stating the
parking area was too small for the proposed use, and would be objectionable to the
area residents.

Senior City Planner Larry Wenger stated that the opposition registered
before the Planning Commission hearing envoked the 20 percent rule in this case.
Motion by Lozano, seconded by Bonniwell and passed, that the hearing
be closed.
Motion by Lozano, seconded by Bonniwell and passed, that the action on
the foregoing request be deferred until all members of the Council were present.
Mayor Sizemore announced the public hearing on the proposed Text Amend-
ment to the Zoning Ordinance, Article 6-A, establishing a new zoning district,
"R -1C" One -family Dwelling District. He stated it was the recommendation of the
Planning Commission that this amendment be approved with modifications, with the
maximum height changed to 35 feet, stories changed to 2-1/2 stories, and the word
"maximum" depth of front, side and rear yards be changed to "minimum." He pointed
out that the Staff was not in favor of the "R -1C" district because the lot reduc-
tion would only add to the congestion in a single-family detached development
without increasing the open space benefits; that they were only in favor of a
lot reduction when an area is developed under the concept of the Community Unit
Plan which is the cluster type development with yard areas combined into very
large common green areas; and if the "R -1C" is approved, then the Platting Ordinance
should be amended to coincide with the Zoning Ordinance and also to increase the
percentage required for park areas. Mayor Sizemore stated he felt since the
Staff did not favor the amendment, the Council should hear the Commission's reason
for their recommendation.
Mr. Wenger reviewed the background and explained that in 1952 the Plat-
ting Ordinance was amended to recognize an area south of Agnes and west of Port
to allow for reduction of space to take care of these particular lots. He stated
that some developers had approached the Council stating that this amendment is
needed as a matter of economics, and expressed their views about their concern and
the hardship placed on developers. He stated the proposed amendment establishing
an "R -1C" District would allow lot size reduction anywhere in the City.
Dr. Joseph Rupp, 4509 Coventry Lane, spoke in opposition stating the
proposed amendment would be bad for Corpus Christi, and that it was just another
"scheme by developers to make more money." He stated it would turn otherwise nice
neighborhoods into potential slums and should only be allowed in exceptional hardship

cases. He urged the Council to give serious consideration to the recommendation
of the Planning Staff.
Mrs. Robert Clark, 3902 Mueller, spoke in opposition to the proposed
amendment, and requested that action be deferred until there has been more open
discussion.
Mrs. N. E. Sullivan, 3714 Liberty, opposed the amendment, stating she
lives in an area of small lots and urged the Council to visit the Village on the
Green Community Unit Development, which she stated does not have the green areas
as were projected in the original plans.
Mr. Lewis Lanfear, Flour Bluff Road, opposed the amendment, stating the
economic savings gained by the developers would not compare with the eight to ten
feet reduction in living space.
City Manager Townsend stated that the basic question involves amending
the Platting Ordinance.
Motion by Bonniwell, seconded by Gonzales and passed, that the hearing
be recessed until a full Council is present.
Motion by Bonniwell, seconded by Bosquez and passed, that the foregoing
motion be amended to reflect that the hearing will be recessed to reconvene on
October 13, 1971.
There being no further business to come before the Council, the Special
Meeting was adjourned.
