Howard Stark MINUTES CITY OF CORPUS CHRISTI, TEXAS SPECIAL COUNCIL MEETING October 6, 1971 3:30 P.M. City Manager R. Marvin Townsend City Attorney James R. Riggs Assistant City Secretary Bill G. Read Mayor Ronnie Sizemore called the Special Meeting to order in the Council Chamber of City Hall, and stated the purpose -of the Special Meeting was to hold pcheduled public hearings on zoning applications and any other business as may properly borne before the Council. He explained the procedure to be followed. Mayor Sizemore announced the public hearing on Application #871-13, G. E. Gibbons, for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on all of Lots 3 and 4, Block 7, Del Mar Subdivision. He explained that the request was heard by the Planning Commission August 31, 1971, and forwarded to the Council with the recommendation that it be approved on the basis that this use as proposed would not break down the residential character of the neighborhood. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Stark, seconded by Branch and passed, that the hearing be closed. Motion by Stark, seconded by Bosquez and passed, that the recommendation of the Planning Commission be concurred in and that Application #871-13, G. E. Gibbons, for change of zoning from "R -1B" One -family Dwelling District to "AB" Professional Office District, on all of Lots 3 and 4, Block 7, Del Mar Subdivision, located at 1743 Third Street, be approved as requested and that an ordinance be brought forward effectuating the change. Mayor Sizemore announced the public hearing on Application #871-14, Mrs. Freda G. Rednick, for change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business District on all of Lots 17 and 18, and the west 9 feet of Lots 7 and 8, Block 5, Broad- moor Park #1. He explained that the request was heard by the Planning Commission August 31, 1971, and forwarded to the Council with the recommendation that it be approved as requested on the basis that it is a logical extension of existing business in the area and its location on Port Avenue. • • Minutes Special Council Meeting October 6, 1971 Page 2 No one appeared in opposition to the recommendation of the Planning Commission. Motion by Lozano, seconded by Bosquez and passed, that the hearing be closed. Mayor Sizemore announced the public hearing on Application #871-15, George Hoelscher, for change of zoning from "R-2" Two-family Dwelling District to "AB" Professional Office District on all of Lots 57 & 58, Block 815, Port Aransas Cliffs. He explained that the request was heard by the Planning Commission August 31, 1971, and forwarded to the Council with the recommendation that it be approved as a logical extension of the "AB" zoning to the north . No one appeared in opposition to the foregoing request. Motion by Stark, seconded by Bosquez and passed, that the hearing be closed. Mayor Sizemore presented Application #871-16, The Planning Commission (W.H.Stahl) for change of zoning from "R -1B" One -family Dwelling District and "AB" Professional Office.. District to "B-1" Neighborhood Business District, on all of Lots W-1 and W-2, Lexington Place. He explained that the request was heard by the Planning Commission August 31, 1971, and forwarded to the Council with the recommendation that it be approved as requested. No one appeared in opposition to the recommendation of the Planning Commission. Stahl), for change of zoning from "R -1B" One -family Dwelling District and "AB" Professional Office District to "B-1" Neighborhood Business District, on all of Lots W-1 and W-2, Lexington Place, located at 4901 Kostoryz Road, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Sizemore presented Application #871-17, D. Joe Myers, for change of zoning from "A -l" Apartment House District to "AB" Professional Office District, on all of Lot 44,Block 1, South Park. He explained that the request was heard by the Planning Com- mission August 31, 1971, and forwarded to the Council with the recommendation that it be approved as requested. No one appeared in opposition to the foregoing request. Motion by Lozano, seconded by Branch and passed, that the hearing be closed. Motion by Lozano, seconded by Gonzales and passed, that the recommendation of the Planning Commission be concurred in and that Application #871-17, D. Joe Myers, for change of zoning from "A -l" Apartment House District to "AB" Professional Office District on all of Lot 44, Block 1, South Park, located in the 5000 Block of Anthony Street, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Sizemore announced the public hearing on Application #871-18, Tim Clower, for change of zoning from "R-18" One -family Dwelling District to "1-2" Light Industrial District, on a 10 -acre tract out of Section 3, Lot 5, Bohemian Colony Lands. He explained that the request was heard by the Planning Commission August 31, 1971, and forwarded to the Council with the recommendation that R be approved as requested. No one appeared in opposition to the recommendation of the Planning Commission . Motion by Branch, seconded by Stark and passed, that the hearing be closed. Motion by Branch, seconded by Gonzales and passed, that the recommendation of the Planning Commission be concurred in and that Application #871-18, Tim Clower, for change of zoning from "R -1B" One -family Dwelling District to "1-2" Light Industrial District, on a 10 -acre tract out of Section 3, Lot 5, Bohemian Colony Lands, located in the 2600 Block of Holly Road • • Minutes Special Council Meeting October 6, 1971 Page 4 and having a frontage of 518 feet, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Sizemore announced the public hearing on proposed Text Amendments to Zoning Ordinance No. 6106, including establishment of a new zoning District Article 7A "T-1" Travel Trailer Park, Mobile Home Park, and Mobile Home Subdivision Regulations. Senior City Planner Larry Wenger presented a summary of the proposed Text Amend- ments, as follows: (1) Adding a new article 7A to be designated as "T-1" Travel Trailer Park, Mobile Home Park, and Mobile Home Subdivision Regulations and other amendments relating to this new article. (2) Amending Article 25, Supplementary Use Regulations - Special Uses, by deleting entirely the section dealing with special uses and renaming this article "Special Permit Regulations" and other amendments relating to this article. (3) Amending Article 16, "B-4" General Business District Regulations, by adding a new item to allow for storage -type warehouses with a limitation on size and use. (4) Amending Article 30, Changes and Amendments, Section 30-5, to conform with the State Zoning Law, Article 1011e, regarding the procedures for determining the 20% rule. (5) Amending Article 33, Permits, Plats, and Filing Fees, Subsection 33-3.01, by raising the Board of Adjustment fee from $40 to $60. Mr. Wenger explained that the Planning Commission hearing on Amendments (1) and (2) was held on July 27, 1971, at which time there was considerable discussion by members of the Commission concerning certain sections of the proposed text pertaining to travel trailers, mobile home parks, and mobile home subdivision amendments, and some differences of opinion between the Staff and the Commission; that at their meeting of August 31, 1971, the Planning Commission recommended that the amendments eliminating mobile home developments from the special use section, Article 25, of the Zoning Ordinance and creating a new district for these uses be approved as submitted. Mr. Wenger stated that the Planning Commission hearing on proposed amendments (3), (4), and (5), was held on August 31, 1971, and forwarded to the Council with the recommendation that they be approved. • Minutes Special Council Meeting October 6, 1971 Page 5 Mr. Ralph Emmord, 611 South Tancahua, former Planning Commission member, appeared and stated that he felt the proposed amendment regulating mobile home parks as to spacing is not stringent enough in requiring 20 feet unobstructed clearance between mobile homes. He stated he felt there should be a minimum of thirty feet. He stated he shared the Commission's reservations regarding the standard screening fence requirement, and it is his opinion that it is too expensive and impractical; and also stated that the require- ment for paved streets should be spelled out as to type. Mr. Bob Rice, 2919 Waldron Road, appeared and stated he was in agreement with the proposed amendment requiring a minimum of twenty feet clearance between mobile homes, which he stated is more than sufficient at this time provided the cars are parked in front of the trailers, and if parked 6lehind the trailers, then wider lots are needed. He stated that occupants of trailers are not interested in maintaining any more area around the trailers. Mayor Sizemore suggested that the hearing on the foregoing proposed Text Amend- ments be recessed until October 13, 1971, to be heard jointly with the Council, a repre- sentative of the Planning Commission, and the Staff, along with the proposed amendments establishing the "R -1C" District which was recessed from September 22, 1971, and the amendment relative to Permits, Plats, and Filing Fees, scheduled to be heard October 13. Motion by Stark, seconded by Bosquez and passed, that the hearing be recessed until October 13, 1971, as suggested by Mayor Sizemore. There being no further business to come before the Council, the Special Meeting was adjourned at 4:30 p.m.
