Howard Stark MINUTES CITY OF CORPUS CHRISTI, TEXAS SPECIAL COUNCIL MEETING May 3, 1972 3:30 P.M. City Manager R. Marvin Townsend City Attorney James R. Riggs City Secretary T. Ray Kring Mayor Sizemore called the Special Meeting to order in the Council Chamber of City Hall, and stated the purpose of the meeting was to hold scheduled public hearings on zoning applications and any other business as may properly come before the Council. He explained the procedure to be followed and asked that it be noted that a quorum of the Council and required Charter Officers Were present to conduct a valid meeting. City Manager Townsend reported that formal notice had been received from the applicant requesting that Application #372-7, Pier 'I Imports, for change of zoning from "B-1" Neighborhood Business District to "B-4" General Business District on all of Lot 2, Block A, Manor Terrace, be withdrawn, and that this item is no longer before the Council. City Manager Townsend presented Application #372-8, Roy Smith, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on an approximate 2,41 -acres located at 5339 Everhart Road at the north- west corner of Curtis Clark Drive and Everhart Road, a portion of land out of Lot 4, Oso Farm Tracts. He explained that the Planning Commission had heard the request March 28, 1972, and forwarded to the Council with the recommendation that it be approved as a logical use for the property; that the Staff was of the opinion that to insert a commercial use between two residential areas would be an intrusion of commercial use into a residential area and recommended denial. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Lozano, seconded by Bosquea and passed, that the hearing be closed. Motion by Gonzales, seconded by Lozano and passed, that the recommendation of the Planning Commission be concurred in and that Application #372-8, Roy Smith, for change of zoning from "R -1B" One -family Dwelling District to "8-1" Neighborhood Business District on an approximate 2.41 -acre tract out of the northeast portion of Lot 4, Oso Farm Tracts, be approved as requested, and that an ordinance be • Minutes Special Council Meeting May 3, 1972 Page 2 brought forward effectuating the change. Mayor Sizemore asked that he be temporarily excused from the meeting at this time. Motion by Stark, seconded by Gonzales and passed, that Commissioner Lozano be elected Mayor Pro Tem and assume the Chair as Presiding Officer in the absence of Mayor Sizemore and Mayor Pro Tem Bonniwell. Mayor Pro Tem Lozano presented Application #372-11, Poindexter & Wharton Sales Corporation, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on all of Lot 1, Block 9, Molina Addition #2, located on the northwest corner of West Point Road and Molina Drive. City Manager Townsend explained that the request was heard by the Planning Commission on March 28, 1972, and forwarded to the Council with the recommendation that it be approved as a logical use for this property on the basis that the pro- posed laundromat and convenience market is needed in the neighborhood. He pointed out that the subject area is located immediately adjacent to an area included in the Code Enforcement Program, but that the Staff is not in a position to determine whether or not the requested zoning change would affect this Program. He stated the Staff had recommended denial on the basis that they have not found sufficient changes in this area to warrant the change from "R -1B". Planning Director Wm. Anderson stated that the Staff feels this is a classic example of spot zoning; that the Staff had been asked by the Planning Com- mission to initiate and make application for rezoning of the adjoining properties on both sides of West Point Road in order to avoid the stigma of spot zoning. Mr. Anderson stated the Staff saw no indication that this was needed, but that it was the Commission's judgment that it would be good zoning. City Manager Townaend described the present status of the Code Enforcement Program, stating it was not possible at this point to forcast future developments; explained that the reason these streets were omitted from the program was partially because of the condition of the houses, but a more important factor was the large lots. No one appeared in opposition to the recommendation of the Planning Commission. • • Minutes Special Council Meeting May 3, 1972 Page 3 Motion by Stark, seconded by Bosquez and passed, that the hearing be closed. Motion by Stark, seconded by Gonzales and passed, that the recommendation of the Planning Commission be concurred in and that Application #372-11, Poindexter and Wharton Sales Corporation, for change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood Business District on all of Lot 1, Block 9, Molina Addition #2, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Pro Tem Lozano presented Application #372-12, Poindexter & Wharton Sales Corporation, for change of zoning from "A -l" Apartment House District with a Special Permit (for the operation of a drive=in grocery and gas pump), to "B-1" Neighborhood Business District on all of Lots 11, 12 & 13, Block B, Diaz Addition, located on the south side at 1517 Winnebago Street, east of Brownlee Boulevard. City Manager Townsend pointed out the location of the land stating that it contained an approximate 13,500 square foot area located adjacent to the Police Station, presently zoned "A-1" with a Special Permit with an approved site plan for operation of a coin-operated laundry and retail grocery store; that the grocery store was built but the laundromat was not. He stated that Mr. Poindexter had stated at the Commission hearing that the Special Permit granted in 1970 was for operation of a drive -in -grocery and gas pumps. Mr. Townsend explained that the request was heard by the Planning Commission March 28, 1972, and forwarded to the Council with the recommendation that it be approved as a logical use for this property and because a grocery store is now in existence, and that the Staff recom- mended denial of the zoning change to "B-1" but recommended that an amendment to the Special Permit be granted to facilitate the installation of a coin-operated laundromat. Mr. Townsend stated it was his opinion that any zoning change that would permit the on -premise consumption of alcohol should not be granted because of the close proximity to the Police Station. Planning Director Anderson stated the applicant had indicated he would not object to the amendment to the Special Permit, and presented a site plan. No one appeared in opposition to the foregoing request. Motion by Stark, seconded by Gonzales and passed, that the hearing be closed. • Minutes Special Council Meeting May 3, 1972 Page 4 Motion by Bosquez, seconded by Gonzales and passed, that Application #372-12, Poindexter & Wharton Sales Corporation, for change of zoning from "A-1" Apartment House District with a Special Permit (for the operation of a drive-in grocery and gas pump) to "B-1" Neighborhood Business District on all of Lots 11, 12 and 13, Block B, Diaz Addition, be denied, but in lieu thereof an amendment to the Special Permit for the installation of a coin-operated Laundromat be granted on the condition that there be no on -premise consumption of alcohol and according to an approved site plan, and that an ordinance bebrought forward effectuating the special permit. There being no further business to come before the Council, motion by Stark, seconded by Bosquez and passed, that the Special Meeting be adjourned at 4:15 p.m., May 3, 1972.
