SPECIAL COUNCIL MEETING
June 28, 1972

Mayor Sizemore called the Special Meeting to order in the Council Chamber
of City Hall, and stated the purpose of the meeting was to hold scheduled public
hearings on zoning applications and any other business as may properly come before
the Council. He explained the procedure to be followed and asked that it be noted
that a quorum of the Council and the required Charter Officers were present to
conduct a valid meeting.
City Manager Townsend presented Application #1271-1, Manuel N. Cantu, Jr.,
for change of zoning from "R -1B" One -family Dwelling District to "8-1" Neighborhood
Business District on all of Lot 11, Phillips 66 Subdivision, located in the 2400
Block of Baldwin Boulevard. He explained that the request was heard by the Planning
Commission December 7, 1971, and forwarded to the Council with the recommendation
Permit
that it be denied, but in lieu thereof, a Speciall be granted for a funeral parlor
subject to the site plan approved by the Commission May 23, 1972. He stated the
Staff recommended that "AB" be approved as an extension of the existing "AB" in
the block in lieu of the "B-1" requested,
Mr, Manuel N. Cantu, Jr., applicant, was present and stated the Special
Permit as recommended by the Planning Commission was acceptable. He stated that he
plans to purchase the adjacent property, and at that time, would probably apply for
a change of zoning.
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Lozano, seconded by Bosquez and passed, that the hearing be
closed.
Motion by Lozano, seconded by Bosquez and passed, that the recommendation
of the Planning Commission be concurred in and that Application #1271-1, Manuel N.
Cantu, Jr, for change of zoning from "R -1B" One -family Dwelling District to "B-1"

denied, but in lieu thereof a Special Permit be granted for a funeral parlor subject
to the site plan approved by the Commission May 23, 1972, and that an ordinance be
brought forward effectuating the change.
City Manager Townsend presented Application #572-11, February Investments,
Inc., for change of zoning from "R -1B" One -family Dwelling District to "A-2" Apart-
ment House District on a 12 -acre tract of land out of Lots 2 & 7, Sections 5,
Range VIII, Gugenheim & Cohn's Farm Lots, located northeast of South Padre Island
Drive and northwest of Old Brownsville Road. He explained that the request was heard
by the Planning Commission May 23, 1972, and forwarded to the Council with the
recommendation that it be approved because the applicants have indicated that garden -
type apartments will be developed, this is an undeveloped area which has been ignored,
and this may be one way to get it developed and get a tax base for the West Oso '
School District. He stated the Staff's opinion is that "A-1" would be a more desir-
able density and from the standpoint of land use and intensity, "A-1" would be the
more desirable zoning district.
No one appeared in opposition to the recommendation of the Planning COmr
mission.
Motion by Lozano, seconded by Bosquez and passed, that the hearing be
closed.
Motion by Lozano, seconded by Gonzales and passed, that the recommenda-
tion of the Planning Commission be concurred in and that Application #572-11,
February Investments, Inc. for change of zoning from "R -1B" One -family Dwelling
District to "A-2" Apartment House District on a 12 -acre tract out of Lots 2 & 7,
Section 5, Range VIII, Gugenheim & Cohn's Farm Lots, be approved, and that an
ordinance be brought forward effectuating the change,
City Manager Townsend presented Application #572-9, Morris Lichtenstein,Jr.,
for change of zoning as follows: TRACT A - from "R -1B" One -family Dwelling District
and "B-1" Neighborhood Business District to "B-4" General Business District; and
TRACT B - from "R -1B" One -family Dwelling District to "A-1" Apartment House District;
both tracts being approximately 10 acres out of Tract 1, Block 1, Paisley Subdivi-
sion of the Hoffman Tract, located at 4134 South Staples Street southeast of Carmel
Village Shopping Center. He explained that the request was heard by the Planning
Commission May 23, 1972, and forwarded to the Council with the recommendation that

"B-4" be approved as requested on TRACT A, and that "A-1" be denied on TRACT B,
but in lieu thereof "R-2" Two-family Dwelling District be approved on the basis
that it would serve as a buffer between the business and residential and would
reduce the density. He stated that the Staff's recommendation was that "B-4"
be approved on TRACT A, and that "R-2" along Grossman Drive is an appropriate
zoning for TRACT B.
Mr. Tom McDowell, attorney representing a group of property owners
abutting Pope Place #5 Subdivision, stated these residents were not opposed to the
recommendation of the Planning Commission for "B-4" zoning on TRACT A because it is
across from Carmel Village which is already zoned "8-4", but that there was some
question about TRACT 8 which divides the residential area from Carmel Village. He
stated these are $30,000 to $40,000 homes and the subdivision has not deteriorated
since it was developed; that they would like some development which would safeguard
any invasion of the privacy or depreciation of the property values and continue
the same character of Pope Place. He stated if it could be determined that the
proposed shopping center would be a mall with enclosed stores similar to Cullen
Mall, this would not be objectionable and would serve as a buffer zone. He pointed
out that deed restrictions which the City had been made a party to, had been filed
several years ago on property abutting Grossman Drive, and that these deed restrictions
had been violated. He stated his clients are concerned that a compatible buffer
area such as duplexes with deed restrictions on the building height to one-story,
be continued, and that the "B-4" zoning not be projected farther than the same
depth as that of Carmel Shopping Center, and that if the applicant is willing to
enter into such a covenant, there would be no objection to the granting of "R-2"
zoning as recommended by the Planning Commission.
Others appearing and indicating concurrence with statements of Mr.
McDowell, were: Mr. J. 3, O'Brian, 4130 Pompano, Mrs. Billy C. Koy, 4125 Harry;
Mr. R. M. Hurt, 4102 Harry; Mrs. Val Dixon, 3109 Harry; Mr. C. B. Robbins, 4134
Harry; and Mr. M. T, Alexander, 4121 Harry.
Motion by Branch, seconded by Lozano and passed, that the hearing be
closed.

Application #572-9, Morris Lichtenstein, Jr. be tabled, and that the applicant
be asked if he is willing to file a voluntary covenant restricting the develop-
ment to one-story buildings.
There being no further business to come before the Council, the Special
Meeting was adjourned at 5:30 p.m., Wednesday, June 28, 1972,
