PRESENT: Mayor Ronnie Sizemore *Mayor Pro Tem Chas. A. Bonniwell Commissioners: Thomas V. Gonzales Gabe Lozano, Sr. J. Howard Stark City Manager R. Marvin Townsend City Attorney James R. Riggs City Secretary T. Ray Kring Mayor Sizemore called to order and reconvened the recessed Meeting of July 17, 1972, in the Council Chamber of City Hall. City Secretary T. Ray Kring called the roll of those in attendance. Mayor Sizemore asked that it be noted that a quorum of the Council was present to conduct a valid meeting. Mayor Sizemore read the following statement: "Corpus Christi has conscientiously pursued a course of preserving and guaranteeing a safe water supply of high quality for its neighbors and its own citizens. "The annexation today continues that policy and it is a policy that this City Council will pursue and a policy I hope every city council in the future will pursue regardless of the objections and the problems. "The Nueces River is our fresh water supply line and has been so approved for many years by the Texas Water Rights Commission. The City does not object to development along the River but, because it is a water transmission line, development must be controlled. "We seek the support of every county and every city along the River to safeguard the area's water supply by positive actions. It is unfortunate that there have been very few actions taken by other governmental agencies. If they had pursued a positive program of regulation then the action today would not have been necessary. We continue to ask that each and every county and city along the River pursue a positive program of pollution control and development regulation and we hope the standards they set will be more severe than our standards so that it will become unnecessary for Corpus Christi to directly regulate the area along the River. "We look forward to working together with our neighboring govern- mental agencies for the betterment of the area. "But, let there be no misunderstanding or doubt, Corpus Christi is going to take the positive actions necessary to protect the area's water supply and to regulate development in the flood plain and along the River, whatever those actions might be." City Manager Townsend presented the following ordinance. ORDINANCE NO. 10968 ANNEXING TO THE CITY OF CORPUS CHRISTI CERTAIN PUBLIC LANDS AND TERRITORY WITHIN THE NUECES RIVER, CONSISTING OF 30.5 ACRES OF LAND AND WATER CONTIGUOUS AND ADJACENT TO THE PRESENT CITY LIMITS, EXTENDING APPROXIMATELY FIVE (5) AIR MILES UPSTREAM ON SAID RIVER FROM THE PRESENT CITY LIMITS; PROVIDING SEVERABILITY; AND DECLARING AN EMERGENCY. 11111 Minutes Recessed Special Council Meeting July 18, 1972 Page 2 The Charter Rule was suspended and the foregoing ordinance was passed by the following vote: Sizemore, Gonzales, Lozano and Stark, present and voting "Aye." Motion by Gonzales, seconded by Lozano and passed, that the meeting be adjourned. *Mayor Pro Tem Bonniwell reported at the meeting at this time. Motion by Gonzales, seconded by Stark and passed, that the meeting be reconvened. Mayor Pro Tem Bonniwell requested that the record show that he voted "Aye" on the ordinance (No. 10968) annexing to the City certain public lands within the Nueces River. Mayor Sizemore requested that the record reflect that the absent members of the Council concurred in this action and agreement was unanimous. There being no further business to come before the Council, motion by Gonzales, seconded by Lozano and passed, that the meeting be adjourned at 10:40 a.m., July 18, 1972.
