Ray Kring Mayor Sizemore called the meeting to order in the Council Chamber of City Hall, and stated the purpose of the meeting was to hold scheduled public hearings on zoning applications and any other business as may properly come before the Council. Mayor Sizemore presented Application #672-2, Paul R. Aston, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District on all of Lots 7 through 18, Block 4, Naval Center Subdivision. The request was heard by the Planning Commission June 6, 1972, and forwarded to the Council with the recommendation that it be denied, but in lieu thereof, "R-2" Two-family Dwelling District be granted. The Staff concurred in this recommenda- tion. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Gonzales, seconded by Lozano and passed, that the hearing be closed. Motion by Stark, seconded by Lozano and passed, that the recommendation of the Planning Commission be concurred in and that Application #672-2, Paul R. Aston, for change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House District, on all of Lots 7 through 18, Block 4, Naval Center Subdivision, be denied, but in lieu thereof, "R-2" Two-family Dwelling District be granted, and that an ordinance be brought forward effectuating the change. Mayor Sizemore presented Application #672-6, Bill Bell, for change of zoning from "A-2" Apartment House District to "I-2" Light Industrial District on the south 200 feet of Lot 2, Jaime Subdivision_, located on the west side of the 1200 Block of 25th Street, south of Buford. The request was heard by the Planning Commission June 6, 1972, and forwarded to the Council with the recommendation that Minutes Special Council Meeting July 19, 1972 Page 2 it be approved as a logical extension of the "I-2" zoning on the properties adjacent to the north and west, and the Staff concurred in this recommendation. No one appeared in opposition to the recommendation of the Planning Commission, Motion by Bosquez, seconded by Branch and passed, that the recommendation of the Planning Commission be concurred in and that Application #672-6, Bill Bell, for change of zoning from "A-2" Apartment House District to "I-2" Light Industrial District on the south 200 feet of Lot 2, Jaime Subdivision, be approved, and an ordinance be brought forward effectuating the change. Mayor Sizemore presented Application #672-3, Henry Tucker, for change of zoning, TRACT A, from "F -R" Farm -Rural District to "B-4" General Business District; TRACT g, from "F -R" Farm -Rural District to "A-2" Apartment House District, both tracts being an approximately 8.94 -acre portion out of Lots 15 & 16, Section 19, Flour Bluff & Encinal Farm & Garden Tracts, located on the northeast corner of Airline Road and Wooldridge Road. The request was heard by the Planning Commission June 6, 1972, and forwarded to the Council with the recommendation that "B-4" zoning on TRACT A, and "A-2" zoning on TRACT B, be approved because the distance between South Padre Island Drive and Saratoga Boulevard is about two miles and additional business is needed in this area; and most of this area is farm -rural and the loca- tion is right for "B-4" zoning. The Planning Staff's recommendation was that "8-1" be granted in lieu of "B-4" on Tract A because it could provide all the business gees needed in this area; and that "R-2" be granted in lieu of "A-2" on Tract B because it is a lower density. Dr. D. F. Segler, 6620 Wooldridge Road, spoke in opposition to the recom- mendation of the Planning Commission, stating that his home is adjacent to the east of the apartment portion of the request and is concerned with the recommended "A-2" zoning for Tract B. He stated that when he purchased his property it had been his understanding that this area was in the long-term plan for residential development, and that he favored the recommendation of the Planning Staff for "R-2" instead of the Planning Commission's recommendation for "A-2" on Tract B. He also stated it was his understanding that a plan of proposed development be submitted before approval of a zoning change which had not been done. He stated he is strongly opposed to having an apartment complex in such close proximity to his property. • Minutes Special Council Meeting July 19, 1972 Page 3 Mr, John Waller, attorney representing the applicant, pointed out that the surrounding area is vacant and undeveloped, and the apartment houses would be in line with the present development. He stated that Mr. Tucker's plans are for about 24 units per acre which is allowed in the "R-2" classification; that if the applicant waits until other properties in the area are developed into single-family dwellings, there would be more opposition, and he feels the zoning pattern should be established before the area is developed. He stated that water and gas facilities are available now, and he understands that the sanitary sewer lines will be included in the current proposed bond issue to be submitted in October of this year; that a previous Council had recognized that "F -R" in this area was a "holding district pattern" and that the area could never be developed for residential uses. He stated the applicant would accept the "B-1" but there are no uses allowed in the "B-4" which would be offensive to the residents. He pointed out the tremendous demand for apart- ment dwellings throughout the City, and indications are that this trend will continue. He stated he did not understand the "R-2" zoning and felt the ordinance should be changed to more clearly define this classification. He further stated it was his thinking that apartment development is the logical transition from residential to business zoning. He pointed out other business establishments in this area which back up to expensive residentialdevelopments with no evident devaluation of properties. He stated they would accept the "B--1" and that his client would not object to filing deed restrictions limiting the number of units to 24. Motion by Stark, seconded by Branch and passed, that the hearing be closed. Motion by Stark, seconded by Branch and passed, that the request of Mr. Henry Tucker, Application i'672-3, for change of zoning on TRACT A, from "F -R" Farm - Rural District to "B-4" General Business District, be denied, but in lieu thereof, "B-1" be approved; that the request for change of zoning from "F -R" Farm -Rural District to "A-2" Apartment House District on TRACT B, be approved, subject to restrictions being filed limiting the number of units to 24 - both tracts being an approximately 8.94 -acre portio» out of Lots 15 and 16, Section 19, Flour Bluff and Encinal Farm & Garden Traots. • Minutes Special Council Meeting July 19, 1972 Page 4 Mayor Sizemore presented Application #572-12, Richard Haas & Jack Dumphy, for change of zoning from "R -1B" One -family Dwelling District to "R-2" Two-family Dwelling District on all of Lots 2 & 3, Block 5, Naval Center Addition, Unit #2, located 105 feet south of Navy Drive on the west side of Anchor Street. The request was heard by the Planning Commission May 23, 1972, and forwarded to the Council with the recommendation that it be approved as requested, and the Staff concurred in this recommendation. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Bosquez, seconded by Gonzales and passed, that the hearing be closed. Motion by Branch, seconded by Gonzales and passed, that the recommenda- tion of the Planning Commission be concurred in and that Application #572-12, Richard Haas & Jack Dumphy, for change of zoning from "R -1B" One -family Dwelling District to "R-2" Two-family Dwelling District on all of Lots 2 & 3, Block 5, Naval Center Addition, Unit #2, located 105 feet south of Navy Drive on the west side of Anchor Street, be approved as requested and that an ordinance be brought forward effectuating the charge. ORDINANCE NO. 10982 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOI3JME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF PAUL R. ASTON BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON ALL OF LOTS 7 THRU 18, BLOCK 4, NAVAL CENTER SUBDIVISION, LOCATED ON THE EAST SIDE OF AVIATION DRIVE BETWEEN SKIPPER LANE AND JESTER STREET SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R -1B" ONE -FAMILY DWELLING DISTRICT TO "R-2" TWO-FAMILY DWELLING DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was passed by the following vote: Sizemore, Bo,niwell, Bosquez, Branch, Gonzales, Lozano and Stark, present and voting "Aye."
