Ray Kring Mayor Sizemore called the meeting to order in the Council Chamber of the City Hall and stated the purpose of the special meeting was to hold scheduled public hearings on five zoning applications and any other business as may properly come before the Council. Mayor Sizemore presented Application #572-10, R. F. Emmord, for change of zoning from "R -1B" One -family Dwelling District to "1-3" Heavy Industrial District on all of Lots 1 through 5, and all of Lots 7 through 10, Block 1, Colonia Hidalgo Addition, located between South Padre Island Drive and Hendricks Street, east of Holly Road. The request was heard by the Planning Commission May 23, 1972, and forwarded to the Council with the recommendation that it be approved because the applicant has agreed to deed restrict against undesirable uses such as those listed under the unclassified uses in Section 21-3 of the "1-3" District of the Zoning Ordinance. The Planning Staff recommended that "1-3" Heavy industrial District be denied, but indicated a Special Permit would not be objectionable for the intended use. Mr. R. F. Emmord, applicant, was present and confirmed his willingness to deed restrict the property against undesirable uses. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Bonniwell, seconded by Branch and passed, that the hearing be closed. Motion by Bonniwell, seconded by Gonzales and passed, that the recommendation of the Planning Commission be concurred in and that Application #572-10, R. F. Emmord, for change of zoning from "R -1B" One -family Dwelling District to "B-3" Heavy Industrial District on all of Lots 1 through 5, and all of Lots 7 through 10, Block 1, Colonia Hidalgo Addition, be approved, and that an ordinance be brought forward effectuating the change, with the understanding that the applicant will deed restrict against undesirable uses such as those listed under the unclassified uses in Section 21-3 of the "1-3" District of the Zoning Ordinance. • Minutes Special Council Meeting August 2, 1972 Page 2 Mayor Sizemore presented Application #672-7, The Planning Commission, for change of zoning from "R-2" Two -Family Dwelling District to "R -1B" One -family Dwelling District, on a 15.47 -acre tract of land out of Lots 12 & 13A, Section 17, Flour Bluff & Encinal Farm & Garden Tracts, located in the 800 Block of Egyptian Drive. The request was heard by the Planning Commission June 20, 1972, and forwarded to the Council with the recommendation that it be approved as requested. The Staff concurred in the recommendation as a logical zoning for this area, No one appeared in opposition to the recommendation of the Planning Commission, Motion by Lozano, seconded by Stark and passed, that the hearing be closed. Motion by Lozano, seconded by Stark and passed, that the recommendation of the Planning Commission be concurred in and that Application #672-7, the Planning Commission, for change of zoning from "R-2" Two-family Dwelling District to "R -1B" One -family Dwelling District, on a 15.47 -acre tract of land out of Lots 12 8.13A, Section 17, Flour Bluff & Encinal Farm & Garden Tracts, located in the 800 block of Egyptian Drive, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Sizemore presented Application #672-8, Ray Wasserman & James Kidwell, for change of zoning from "B-1" Neighborhood Business District to "B-4" General Business District on all of Lots 3, 4, & 5, Block B-1, Pope Place, Unit #1, located on the east side of South Staples Street 160 feet south of Doddridge Street. The request was heard by the Planning Commission June 20, 1972, and forwarded to the Council with the recommendation that it be approved with the owner agreeing to comply with the sign requirements of the "B-1" zoning district by restrictive covenant. The Staff felt a Special Permit for the proposed devel- opment would be a better classification than "B-4" since this district allows very large signs which would be undesirable in this area. Senior Planner Larry Wenger stated that Mr. Wasserman had complied with the request of the Planning Commission and filed restrictive covenant relative to the sign require- ments of the "B-1" zoning district. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Bonniwell, seconded by Bosquez, and passed, that the hearing be closed. • Minutes Special Council Meeting August 2, 1972 Page 3 Motion by Bonniwell, seconded by Stark and passed, that the recommendation of the Planning Commission be concurred in and that Application #672-8, Ray Wasserman and James Kidwell, for change of zoning from "B-1" Neighborhood Business District to "B-4" General Business District on all of Lots 3, 4, & 5, Nock B-1, Pope Place, Unit #1, be approved and that an ordinance be brought forward effectuating the change, with the owner agreeing to comply with the sign requirements of the "B-1" zoning district by restrictive covenant. Mayor Sizemore presented Application #672-11, R. F. Emmord, for change of zoning from "R -1B" One -family Dwelling District, "B-4" General Business District, and a Special Permit to "1-2" Light Industrial District on all of Lots 1 through 4, Block C, and all of Lots 1 & 4, Block D, Lexington Place (247.5' x 580'), located on the north side in the 2900 Block of South Padre Island Drive. The request was heard by the Planning Commission June 20, 1972, and forwarded to the Council with the recommendation that it be approved, subject to deed restrictions against certain obnoxious uses to be determined by the Commission, and the Staff concurred in this recommendation. Mr. Wenger stated the restrictive covenant had been filed against undesirable uses listed as (1) packing or processing of meat and meat products, including slaughtering; (2) slaughtering and packing of poultry; (3) processing, packing and storing of fish, shrimp, oysters, and other seafood; and (4) off -premises advertising or billboard signs. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Lozano, seconded by Bonniwell and passed, that the hearing be closed. Motion by Lozano, seconded by Stark and passed, that the recommendation of the Planning Commission be concurred in and that Application #672-11, R. F. Emmord, for change of zoning from "R -1B" One -family Dwelling District, "B-4" General District, and a Special Permit to "1-2" Light Industrial District on ail of Lots 1 through 4, Block C, and all of Lots 1 & 4, Block D. Lexington Place (247.5' x 5809, be approved and that an ordinance be brought forward, subject to deed restrictions against certain obnoxious uses as determined by the Planning Commission. • Minutes Special Council Meeting August 2, 1972 Page 4 Mayor Sizemore presented Application #672-12, Doyle G. Harris, for change of zoning from "R -1B" One -family Dwelling District to "T-1" Travel Trailer Park, Mobile Home Park, and Mobile Home Subdivision District, on Lots 15 and 16, except for an 85' x 104° area out of the southwest corner of Lot 16, Nueces Gardens #1, located in the 3700 Block of Violet Road and extending through to Leonard Street, The request was heard by the Planning Commission June 20, 1972, and forwarded to the Council with the recommendation that it be denied, but in lieu thereof, a Special Permit be granted for one mobile home only, and the Staff concurred in this recommendation. Mr. Wenger stated that a site plan had not been submitted for the intended use, and stated that the 20 percent rule is in effect. City Manager Townsend explained that the 20 percent ruie is in effect because of opposition having been expressed to the original request, but it is his understanding that those persons who expressed opposition were not opposed to the Special Permit for one mobile home only. No one appeared in opposition to the recommendation of the Planning Commission, Motion by Bonniwell, seconded by Stark and passed, that the hearing be closed. Motion by Gonzales, seconded by Bosquez and passed, that the recommendation of the Planning Commission be concurred in and that Application #672-12, Doyle G. Harris, for change of zoning from "R -1B" One -family Dwelling District to "T-1'° Travel Trailer Park, Mobile Home Park, and Mobile Home Subdivision District, on Lots 15 and 16, except for an 85' x 104' area out of the southwest corner of Lot 16, Nueces Gardens #1, be denied, but in lieu thereof a Special Permit be granted for one mobile home only and that an ordinance be brought forward effectuating the Special Permit, subject to an approved site plan.
