CITY OF CORPUS CHRISTI, TEXAS
SPECIAL COUNCIL MEETING
August 9, 1972
4:30 P.M.

Mayor Pro Tem Chas. A. Bonniwell called the meeting to order in the
Council Chamber of the City Hall and stated the purpose of the special meeting
was to hold scheduled public hearings on five zoning applications and any other
business as may properly come before the Council.
Mayor Pro Tem Bonniwell presented Application #472-7, Mrs. Demetrio
Tovar, Jr., for change of zoning from "R -1B" One -family Dwelling District to "B-1"
Neighborhood Business District on all of Lot 12, Block 2, Midway Addition, located
on the southwest corner of Horne Road and Prescott Street. The request was heard
by the Planning Commission April 25, 1972, and forwarded to the Council with the
recommendation that it be denied, but in lieu thereof, a Special Permit be granted
for a florist shop.
City Manager Townsend stated that an approved site plan had been submitted.
No one appeared in opposition to the recommendation of the Planning
Commission.
Mrs. Demetrio Tovar, Jr., applicant, was present and stated the Special
Permit was acceptable.
Motion by Lozano, seconded by Bosquez and passed, that the hearing be
closed.
Motion by Gonzales, seconded by Lozano and passed, that the recommendation
of the Planning Commission be concurred in and that Application #472-7, Mrs.
Demetrio Tovar, Jr., for change of zoning from "R -1B" One -family Dwelling District
to "B-1" Neighborhood Business District on all of Lot 12, Block 2, Midway Addition,
be denied but in lieu thereof, a Special Permit be granted for a florist shop,
subject to the approved site plan, and that an ordinance be brought forward effec-
tuating the Special Permit.
Mayor Pro Tem Bonniwell presented Application #672-1, Hutch Bryan, et al,
for change of zoning from "A-1" Apartment House District, on all of Lot 38, Block 1,

Lexington Subdivision, located at 2534 Johanna Street, east of Ayers Street. The
request was heard by the Planning Commission on June 6, 1972, and forwarded to
the Council with the recommendation that it be denied, but in lieu thereof, a
Special Permit be granted according to the site plan approved by the Commission
July 7, 1972. The Planning Staff recommended denial because "A-2" would create
too high a density for this area and would constitute spot zoning because there
is no other "A-2" zoning in this vicinity.
City Manager Townsend stated that written opposition to this request
invoked the 20 percent rule.
Mr. Hutch Bryan was present and stated the Special Permit as recommended
by the Planning Commission was acceptable. He explained that the existing "A-1"
zoning allows only 9-2/3 units, and nine units and a storage room are already
under construction; that the storage room will be converted into another unit which
will allow 10 units instead of nine and a fraction. He stated that adequate
parking will be provided, and that the storage space will be used for storing
equipment, such as garden tools and some furniture.
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Lozano, seconded by Stark and passed, that the hearing be
closed.
Motion by Lozano, seconded by Gonzales and passed, that Application
#672-1, Hutch Bryan, et al, be tabled for one week.
Mayor Pro Tem Bonniwell presented Application #772-1, Frank P. Zoeh, Jr.,
for change of zoning as follows: Tract A - from "F -R" Farm Rural District to
"B-4" General Business District on the southwest 1/2 of Lot 17, Section 12, Flour
Bluff & Encinal Farm & Garden Tracts; and Tract B - from "F -R" Farm Rural District
to "A-1" Apartment House District on the southwest 1/2 of Lots 18 & 19, and all
Of Lot 20, Section 12, Flour Bluff & Encinal Farm & Garden Tracts, both tracts
located 640 feet south of Wooldridge Road fronting on South Staples Street. The
request was heard by the Planning Commission July 11, 1972, and forwarded to the
Council with the recommendation that it be approved as requested on the basis that
the present "F -R" zoning is considered a holding zone; and the applicant's pro-
posed plan of development is a logical land use for this property. It was the

Staff opinion that the Planned Unit Development would be a more suitable type
of development for this property.
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Gonzales, seconded by Bosquez and passed, that the hearing be
closed.
Motion by Lozano, seconded by Gonzales and passed, that the recommendation
of the Planning Commission be concurred in and that Application #772-1, Frank P.
Zoch, Jr. for change of zoning from "F -R" Farm Rural District to "B-4" General
Business District on Tract. A, being the southwest 1/2 of Lot 17; and from "F -R"
Farm Rural District to "A-1" Apartment House District on Tract B, being the
southwest 1/7 of Lots 18 & 19, and all of Lot 20, Section 12, both tracts in Sec-
tion 12, Flout Bluff & Bncinal Farm & Garden Tracts, be approved as requested and
that an ordinance be brought forward effectuating the change.
Mayor Fro Tem BonniWell presented Application #772-4, Roland Garcia, for
change of zoning from "R-2" Two-family Dwelling District to "AB" Professional
Office District on all of Lot 11, Block A, Maretta Terrace, located on the north-
east corner of Lynch Street and Baldwin Boulevard. The request was heard by the
Planning Commission July 11, 1972, and forwarded to the Council with the recom-
mendation that it be approved as a logical extension of the existing "AB" district
across Lynch Street. The Staff concurred in the recommendation with the comment
that because of the 45' width and 123' long lot, the applicant would have to go
before the Board of Adjustment for utilization of the property.
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Stark, seconded by Bosquez and passed, that the hearing be
closed.
Motion by Stark, seconded by Gonzales and passed, that the recommendation
of the Planning Commission be concurred in and that Application #772-4, Roland
Garcia, for change of zoning from "R-2" Two-family Dwelling District to "AB" Pro-
fessional Office District on all of Lot 11, Block A, Maretta Terrace, be approved
as requested, and that an ordinance be brought forward effectuating the change.

Mayor Pro Tem Bonniwell presented Application #772-5, Walter Wisznia, for
change of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House
District, on Lots 33 & 34, Block 14, Port Aransas Cliffs, located between Denver
Street and Ocean Drive on the south side of Rossiter Street, The request was heard
by the Planning Commission July 11, 1972, and forwarded to the Council with the
recommendation that it be denied, but in lieu thereof a Special Permit be granted
in accordance with the site plan presented at the public hearing. The Staff con-
curred with this recommendation.
Reverend Lowell Ryan, 3405 Ocean Drive, appeared and stated he was the
owner of adjacent property, and was concerned as to the number of townhouses
proposed.
City Manager Townsend explained that under the Special Permit only three
townhouses can be constructed; that the back tract of land has been the subject
of several zoning requests, and the applicant has gradually reduced the number of
units; that he could build two under the present zoning and is actually only ask-
ing for one additional. Mr. Ryan stated that Mr. Townsend had answered his question
and that he had no objection.
No one appeared in opposition to the recommendation of the Planning Com-
mission.
Motion by Stark, seconded by Lozano and passed, that the hearing be closed,
Motion by Lozano, seconded by Gonzales and passed, that the recommendation
of the Planning Commission be concurred in and that Application #772-5, Walter
Wisznia, for change of zoning from "R -1B" One -family Dwelling District to "A-1"
Apartment House District, on Lots 33 & 34, Block 14, Port Aransas Cliffs, be
denied, but in lieu thereof, a Special Permit be granted in accordance with the
approved site plan, and that an ordinance be brought forward effectuating the
Special Permit.

AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH
DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE
ORDI*LANCE AND RESOLUTION RECORDS, AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED,
UPON APPLICATION OF MRS. DEMETRIO TOVAR, JR., BY GRANTING A SPECIAL PERMIT FOR
A FLORIST SHOP ACCORDING TO THE SITE PLAN APPROVED RY THE PLANNING COMMISSION,
A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A", SAID FLORIST SHOP TO BE
SITUATED ON ALL OF LOT 12,BLOCK 2, MIDWAY ADDITION, LOCATED ON THE SOUTHEAST
CORNER OF HORNE ROAD AND PRESCOTT STREET, IN THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE
AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN
EMERGENCY.

The Charter Rule was suspended and the foregoing ordinance was passed
by the following vote: Bonniwell, Bosquez, Branch, Gonzales, Lozano and Stark,
present and voting "Aye"; Sizemore absent.

AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH
DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE
ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY
AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF ROLAND GARCIA
BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOT 11, BLOCK A, MARETTA
TERRACE SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R-2"
TWO FAMILY DWELLING DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT KEEPING IN
EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.

AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF WALTER WISZNIA,
BY GRANTING A SPECIAL USE PERMIT FOR A TOWNHOUSE COMPLEX ON ALL OF LOTS 33 AND
34, BLOCK 14, PORT ARANSAS CLIFFS, ACCORDING TO THE SITE PLAN ATTACHED, LOCATED
ON THE SOUTHEAST CORNER OF ROSSITER AND DENVER STREETS, IN THE CITY OF CORPUS
CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO THE CONDITIONS SET FORTH HEREINAFTER;
KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY.

There being no further business to come before the Council, the Special
Meeting was adjourned at 5:00 p.m., August 9, 1972.
