Ray Kring • Mayor Ronnie Sizemore called the meeting to order in the Council Chamber of the City Hall and stated the purpose of the meeting was to hold scheduled public hearings on five zoning applications and any other business as may properly come before the Council, Mayor Sizemore presented Application #772-3, Roy Lay, Jr,, for change of zoning from "R -1B" Ane*family Dwelling District to "4-2" Two-family Dwelling District, on all of Lots 33 through 47, Block 16, Flour Bluff park, located on the west side of Greenbay Drive north of South Padre Island Drive. City Manager Townsend explained that the request was heard by the Plann- ing Commission .7µ1y 11, 1972, and forwarded to the Council with the recommendation that it be denied on the basis that the property is located within the flight pattern of the Naval Air Station which could endanger the residents of this area and possibly cause the City to lose one of its largest industries, and that the Staff generally concurred in this recommendation. Attorney Michael Kendrick, appeared on behalf of the applicant and spoke in opposition to the recemnendation of the planning Commission. He explained that duplexes were planned for the lots, and the land was not suitable for single- family residences because financing agencies would not lend money on that property, He Pointed out other proFerty in the immediate vicinity which had been zoned for a higher density, including mobile home perks and subdivisions. He stated that the applicant intends to build the duplexes for rent and not for sale, and the occupants or tenants would have the option of moving if the noise factor became a problem. Mr. Roy Lay, applicant, spoke on behalf of the request, and pointed out land uses in the area including non -conforming uses, He stated he had canvassed the area before purchasing the prpperty to determine whether or not there would be opposition, and had preio ted 4 petition at the hearing with 20 signatures of • Minutes Special Council Meeting September 6, 1972 Page 2 persons in favor. He explained that Mr. Robert Posey, Sr., who owns five lots to the east of Dema Street had appeared at the Commission hearing in opposition, but had since formally withdrawn his objections after further consideration of the plan for an apartment complex. He stated there is a definite need and demand for low rent housing in the Flour Bluff Area, and that this development is catering primarily to the military personnel, and for that Mdan they would definitely not want to "run the Navy out of town," He stated there is no such thing as a flight pattern because, regardless of location, there is always noise from aircraft at Flour Bluff. He pointed out that in the ],oat two years over two million dollars had been spent on sanitary sewer lines and facilities which would indicate that considerable growth is expected in this area, He stated that Greenbay Drive had been paved before any sewer taps were made; that a resident had applied and paid for a sewer tap, and the assessment fee, and was refused Service. He stated he did not know if it were a City employee who had refused the tap, City Manager Townsend stated this would be investigated.. Director of Planning Wm, Anderson presented a map that indicated that the property was in an area where noise from low-flying aircraft would be objectionable. He stated there are other applications pending before the planning Commission which would increase the density, City Manager Townsend stated the question to be considered was whether the population density should be increased in this area. Mr. Bob Rica, owner of Lot 34 6 36 on Greenbay, appeared in opposition, stating he did not necessarily object to the noise, but felt the density should not be increased, and should remain single-family use, He stated he had had problems with apartment dwellers and that sewer conditions had been condemed by the Health Department; that there Were problems of unkempt yards, overgrown weeds, trash cans, and various other debris, and increasing the density would only compound mistakes already made in zoning uses,. Mr. Kendrick stated it was obvious that the poise factor does not bother residents who have 1iued in the Flour Bluff/alfatheir lives, and this should he of least consideration. He stated they feel this duplex complex is entirely compati- ble with the area and would not be a serious threat to the Navy. Mr, Lay stated a Special permit for the proposed 1404 Would be acceptable. • Minutes Special. Council Meeting September 6, 1972 Page 3 Motion by Branch, seconded by Bonniwell and passed, that the foregoing application be referred back to the Planning Commission for a master plan recom- mendation designating areas in Flour Bluff where increased density should not be allowed. Mayor Sizemore departed the meeting at this time. Mayor pro Tem Bounty's/1 presented Application #772-8, William DeWitt Alsup, for change of zoning from "R-2" Two-family Dwelling District to "AB" Professional Office District on all of Late 55 & 56, Block 814, Port Aransas Cliffs, located on the east side of South Alameda Street, City Manager Townsend explained that the request had been heard by the Planning commission July 25, 1972, and forwarded to the Council with the recommenda- tion that it be approved as a logical extension of professional office uses across South Alameda Street and due to the increase in traffic along this major thorough- fare as well as the changing character of this neighborhood. Re stated the Planning Staff's recommendation was that "AB" be denied and in lieu a Special Permit be approved since this is an isolated request surrounded on three sides by residential uses, and there has been a trend to rezone the lots facing South Alameda to "AB" with every indication that there Wi,11 be more such requests in the future. One person spoke in favor of the request and none in opposition to the recommendation of the Planning Commission. Motion by Stark, seconded by Gonzales and passed, that the hearing be closed. Motion by Gonzales, seconded by Stark and passed, that the recommenda- tion of the Planning Commission be concurred in and that Application #772-8, William pewitt Alsup, for change of zoning from "R-2" Two-family Dwelling District to "Ad" Professional Office District on all of Lots 55 & 56, Block 814, Port Aransas C1ifis, be'approved, and that an ordinance be brought forward effectuating the change. City Manager Townsend presented Application #772-10, E. C. Peterson, for change Pg zo4ing from "A -N" Apartment Rouse District to "B-4" General Business District on all of Lot 5, Frederick Tract, located along the west side of the 500 Block of Old Robstown Road, south of UpRiver Road. He explained that the request Was heard by the Planning Commission July 25, 1972, and forwarded to the Council • Minutes Special Council Meeting September 6, 1972 Page 4 with the recommendation that it be approved as a logical extension of the "B-4" zoning adjacent to the north along Old Robstown Road. Mr. Odell Ingle, realtor representing the owners, stated it was his opinion that this was a logical extension of the "B-4" zoning and that a laundromat and drycleaning establishment are proposed. No one appeared in opposition to the recommendation of the Planning Com- mission, closed. Notion by Stark, seconded by Boequez and passed, that the hearing be Motion by Branch, seconded by Lozano and passed, that the recommendation of the planning Commission be concurred in and that Application #772-10, E.C. Peterson, fpr change of zoning from "A+2" Apartment House District to "B-4" General Business District on all of Lot 5, Frederick Tract, be approved, and that an ordinance be brought fcxward effectuating the change. City Manager Townsend presented Application #772-12, A. L. Rankin, for change of zoning, TRACT A - from "R-16" One -family Dwelling District to "A-1" ,Apartment House District; 'TRACT 6 - from "R -1B" One -family Dwelling District to "R-4" General Business District, both tracts being a portion of Lots 25 & 26, Section 18, Flour Bluff & Encinal Farm & Garden Tracts, located on the northeast corner of Airline Road and Holly Road. The request was heard by the Planning Commission July 254 1972, and forwarded to the Council with the recommendation that it be approved as a logical zoning for these properties since they are located across the street from similar uses and because a railroad tract is located immediately to the south across Holly Road, and the Staff concurred in this recommendation. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Stark, seconded by Branch and passed, that the haring he clpsed. ORDINANCE NO, 11071 AMENDING THE ZONING ORDINANCE OF TLS: CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORD`, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF WILLIAM DE WITT ALSUP BY AMENDING THE ZONING MAP BY CH&NGING THE ZONING ON ALL OF LOTS 55 & 56, BLOCK 814, PORT ARANSAS CLIFFS, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R-2" TWO-FAMILY DWE,LING DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance. was passed by the following vote: Sizemore, Bonniwell, Bosquez, Branch, Gonzales, Lozano, and Stark, present and voting "Aye.' ORDINANCE NO, 11.072 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING O.2 RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO, 6102, AS AMENDED, UPON APPLICATION OF E. C. PETERSON TRUSTEE BY AMENDING THE ZONING YAP BY CHANGING THE ZONING ON ALL OF LOT 5, FREDERICK TRACT SITUATED IN THE CI?'
