PRESENT: Mayor Ronnie Sizemore Mayor Pro Tem Chas. A. Bonniwell Commissioners: Robert Bosquez, M.D. Rev. Harold T. Branch Thomas V. Gonzales Gabe Lozano, Sr. City Manager R. Marvin Townsend City Attorney James R, Riggs City Secretary T. Ray Rring Mayor Ronnie Sizemore called the meeting to order in the Council Chamber of the City Hall for the purpose of holding scheduled public hearings on five zoning applications. He explained the procedure to be followed. City Manager Townsend presented Application #1072-1, Mrs. Harold M. Layton, for change of zoning from "R-2" Two-family Dwelling District to "AB" Professional Office District, on Lots 49, 50 and 51, Block 812, Port Aransas Cliffs, being 9,375 square feet in area, located in the 3200 Block of South Alameda Street, between Glazebropk and Texan Trail. The request was heard by the Planning Commission October 3, 1972, and forwarded to the Council with the recommendation that it be approved as a logical use of this area. The Staff concurred in this recommendation. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Lozano, seconded by Bonniwell and passed, that the hearing be closed. Motion by Bonniwell, seconded by Gonzales and passed, that the recom- mendation of the Planning Commission be concurred in and that Application #1072-1, Mrs. Harold M. Layton, be approved as requested, and that an ordinance be brought forward effectuating the change. City Manager Townsend presented Application #1072-2, Mrs. Grace Dobson Lutz, for change of zoning from "R-2" Two-family Dwelling District to "AB" Pro- fessional Office District on Lot 9, Block 1, Alameda Place, being 7,500 square feet in area, located in the 3100 Block of South Alameda Street between Hoffman and Glazebrook Streets. The request was heard by the planning Commiasion October 3, 1972, and forwarded to the Council with the recommendation that it be approved as a logical extension of "AB" zoning on either side. Motion by Bonniwell, seconded by Gonzales and passed, that the hearing be closed. Motion by Lozano, seconded by Branch and passed, that the recommendation of the Planning Commission be concurred in and that Application #1072,2, Mrs. Grace Dobson Lutz, be approved as requested, and that an ordinance be brought forward effectuating the change. Mayor Sizemore presented Application #1072r3 Franciscan Poor Claret; of Corpus Christi (Poor Clare Nuns), for change of zoning from "R -1B" One -family Dwelling District to "A-2" Apartment House District, on Lot 22 & Lot 27, Section 51, Flour Bluff & Encinal Farm & Garden Tracts, being 40 acres, located west of Waldron Road, fronting on the south side of Yorktown Boulevard, The request was heard by the Planning Commission October 3, 1972, and forwarded to the Council with the recommendation that it be denied, but in lieu thereof "A-1" Apartment House District be approved with the density being limited by deed restriction to 14 units per acre on the basis that it will meet their needs. The Staff's opinion of this request was that it is a very fine project, but there would be a noise provlem created by the aircraft in this area; the density would be increased somewhat from that of the single-family pone and the Staff had been unable to find any criteria to increase density under the runway or approach of an ,airport; that upon observing the proposal, it was felt that "R-2" Two-family Dwelling District should take care of the applicant's needs and therefore the Staff recommends "g.2" Two-family Dwelling District or 14 units per acre. Attorney John Brooke, representing the applicants, was present and stated the recommendation of the Planning Commission was acceptable and that the requested deed restrictions have been submitted and approved by the City Attorney. He presented a sketch prepared by ADI Architects and pointed out the location of the buildings. Mayor Pro Tem Bonniwell noted that Mr. Brooke had stated at the Commission hearing that construction was not proposed on that Portion of the property located in the aerial easement fronting on Yorktown Boulevard, but would be used as open space area even though the request was made for the entire tract. • r • Minutes Special Council Meeting November 1, 1972 Page 3 Senior City Planner Larry Wenger presented an aerial photograph of the Naval Air Station showing location of runways and flight patterns and the loco* tion of the property of request, Mr. Brooke pointed out thet the proposed development for the elderly would generate less density than the normal "R -1B" use because there would be no more than one or two persons living in each unit. Mr. Irving Dietz, Planning Engineer of Naval Training Command, N.A.S., presented photographs showing that the north 1/4 of Lot 22 of the property Of request had been acquired as a flight clearance easement which prevents erection of any structures above 19 feet at Yorktown Boulevard to 35 feet at the south boundary of the flight clearance easement. He stated he wished to correct the statement made that Waldron Field its not used as much as the other Navy facilities: He stated that although the Field has not been heavily used recently, the runways are being repaired and is expected to be complete by mid November and traffic will increase and the noise more pro, pounced with the wind from the north. He pointed out that the field is not lighted at the present time and therefore no night flying, but there is no assurance that it will not be lighted in the future and night flying begun. He stated that the property is located approximately 600 feet from the end of the pavement of one of the field's runways; the area is definitely in a high level noise area, and they want to make sure all concerned are made aware of this, and the elderly would be particularly concerned. No one appeared in opposition to the recommendation of the Planning Commiasion. Motion by Lozano, seconded by Branch and passed, that the hearing be closed. Motion by Bonniwell, seconded by Branch and passed that the recommender tion of the Planning Commission be concurred in and Application #1072-1, Franciscan Poor Clares of Corpus Christi (Poor Clare Nuns), for change of arming from "R-18" One -family Dwelling District to "A-2" Apartment House District Pn Lot 22 & Lot 27, Minutes Special Council Meeting November 1, 1972 Page 4 Section 51, Flour Bluff & Encinal Farm & Garden Tracts, being 40 acres located west of Waldron Road, be denied, but in lieu thereof "A-1" Apartment House District be approved with the understanding that if the projept is not approved by the Department of Housing and Urban Development, the land will be rezoned to its original designation, at no cost to the applicants, and that an ordinance be brought forward effectuating the change. Mayor Sizemore presented Application #1072,4, Firat State Bank, for change of zoning from "R -1B" One -family pwelling District to "p-4" General Bµaineas District, on Zots 13 through 21, Block 23, Del Mar Addition, being 21,000 square feet in area, located in the 400 Block of Palmero and Clifford Streets, The request Was heard by the Planning Commission October 3, 1972, and forwarded to the Council with the recommendation that it be approved on the basis that it would lessen the traffic congestion along Alameda and Clifford Streeta and the response from the neighborhood indicated that it would not be offensive to the area, The Staff concurred in this recommendation, but pointed out that Six Points area is one of the most planned areas of the City and least accomplished; that when the Corpus Christi Transporta- tion Plan was prepared in 1963 a great deal of study was given to solving the traffic problems; an alternate plan was to loop the area and make a mall -type area inside abandoning the streets; that this was thought to be a good plan until financing problems were discussed; that the Council removed from the bond election the $380,000 estimate because they felt the program Was needed where there was a definite commitment on the part of property owners and necessary improvements on private properties would be accomplished; that there has been no initiative either by the City or the property owners to accomplish this or any other pian; and in the Staff's recommendation for approval of this request, it is assumed that this plan hap been abandoned. No one appeared in opposition to the recommendation of the Planning Commission, Motion by Bonniwell, seconded by Branch and passed, that he hearing be closed. Motion by Lozano, seconded by Bonniwell and passed, that the recommenda, tion of the Planning Commission be concurred in and Application #1072-4, First State Bank, be approved, and that an ordinance be brought forward effectuating the change. • Minutes Special Council Meeting November 1, 1972 Page 5 Mayor Sizemore presented Application #1072-5, Thomas -Spann Building Corporation, for change of zoning from "R -1B" One -family Dwelling District and "A-2" Apartment House District to "AB" Professional Office District, on Lots 7 thru 16, 57 thru 60, Block 1102, all of Blocks 1002-A and 902, Bay Terrace #2, Lots 23 thru 27, Block 3, Hughes Addition, located in the 1500 Block of 14th Street, Brownlee Boulevard and 10th Street; and between Brownlee, Booty Street and McKenzie Street. The request was heard by the Planning Commission October 3, 1972, and forwarded to the Council with the recommendation that it be approved as requested. The Staff concurred in thin recommendation. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Bosquez, seconded by Bonniwell and passed, that the hearing be closed. Motion by Lozano, seconded by Branch and passed, that the recommendation of the Planning Commission and the Staff be concurred in and that Application #1072-5, Thomas -Spann Building Corporation, be approved as requested and that an ordinance be brought forward effectuating the change. ORDINANCE NO. 11150 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF MRS. HAROLD M.
