Howard Stark Mayor Sizemore called the meeting to order in the Council Chamber of the City Hall and stated the purpose of the special meeting was to hold scheduled public hearings an five zoning applications and any other business as may properly come before the Council. He explained the procedure to be followed, City Manager Townsend presented Application 0972-4, John Mendleski, for change of zoning from "R-2" Two-family Dwelling District to "B-4" General Business District, on all of Lots 4 & 5, Block 5, Alameda Pork, located on the southwest corner of Roberts Drive and Avalon Street. The request was heard by the Planning Commission on September 5, 1972, and forwarded to the Council with the recommendation that it be denied, but in lieu thereof a Special Permit be granted for a parking lot subject to the site plan approved by the Commis- sion October 17, 1972, and the Staff was opposed to "B-4" but did not oppose the special permit for a parking lot. The applicant, Mr, John Mendleski, appeared and stated the special permit was acceptable with the exception of the requirement for a standard screening fence. He stated the cedar fence would cost approximately $1500 more than the redwood fence; that he felt the requirement is unreasonable; that the 6' redwood fence would be adequate; and that there were other parking lots which have been built this year in this area that do not have the standard screening fence. City Manager Townsend explained that any violations should be reported and charges would be filed, He explained that there is no legal authority under the terms of the ordinance to grant a special permit for a parking lot which abuts residential property without the standard screening fence requirement, Motion by Lozano, seconded by Gonzales and passed, that the hearing be closed. Motion by Bonniwell, seconded by Branch and passed, that the recommendation • • Minutes Special Council Meeting November 22, 1972 Page 2 of the Planning Commission be concurred in and that Application '972-4, John Mendlesjd, for change of zoning from "R-2" Two-family Dwelling District to "B-4" General Business District on all of Lots 4 & 5, Block 5, Alameda Park, be denied, but in lieu thereof, a Special Permit be granted for a parking lot subject to the site plan marked "B", and that an ordinance be brought forward effectuating the change. City Manager Townsend presented Application #972-11, Graford Rogers, for change of zoning from "11-1" to "B-4" General Business District on a 2.988 acre portion of Lot 8, Section 13, Flour Bluff & Encino' Farm & Garden Tracts, located an the south side of the 6300 Block of McArdle Road. The request was heard by the Planning Commission September 17, 1972, and forwarded to the Council with the recommendation that it be denied, but in lieu thereof a special permit be granted for a mini -storage warehouse subject to the site plan approved by the Commission October 17, 1972, and the Staff concurred in this recommendation. Mr. Townsend stated the Staff had been advised by telephone by both the applicant and his representative that they wish to withdraw this application, but that written notice hod not been received. Ed Shaw of the Planning Department stated he had personally talked with the applicant, stating he definitely does not wont the mini -storage warehouse as applied for. Attorney Jim Riggs advised that the application be considered withdrawn. No one appeared in opposition. City Manager Townsend presented Application 01072-8, Iris Powell Grant, Trustee, for change of zoning from "R -1B" One -family Dwelling District to "AB" Pro- fessional Office District on a 10 -acre tract of land, more or less, known as Lot 2, Share 2, of McKenzie Partition out of B,S. & F, Surveys 417 and 419, located in the 10,000 Block of UpRiver Road and adjoining Rolling Acres 02 on the west. The request was heard by the Planning Commission October 17, 1972, and forwarded to the Council with the recommendation that it be approved as a logical use of this area. Mrs. Mary Paul, realtor representing the applicant, stated a nursing home is proposed to be located on UpRiver Road, and that possibly the owners of the operation would build a single-family home an the rear of the tract at a later date. She explained that the hospital building would be an 8,000 square foot building for confined patients • • Minutes Special Council Meeting November 22, 1972 Page 3 arod had hoped they could use the other part of the property for Facilities for ambulatory patients. Mr. Townsend explained that there was concern that apartments can be constructed in the "AB" district which would produce a high density type of use and would not be desirable within this immediate area; that it would generate a greater volume of traffic on UpRiver Road and this portion of Up River Road is only a residential type street; and that if the "AB" zoning is granted, access to the subject property should be prohibited from Wagonwheel Drive. He stated the 20% rule is in effect. He inquired of Mrs. Paul if the entire tract need be involved in this application, stating that the concern would not be as great if less percentage of the tract were not included in the request. It was suggested that a Special use permit could possibly serve the needs of the appli- cant, or as an alternative, file deed restrictions qs to the use of the property. Mrs. Paul stated she was concerned about the expense involved in the special permit since there would have to be an approved site plan and that she was not sure the Small Business Association would approve. She stated if the Special Permit con be extended, then it probably would be satisfactory with the applicant and urged the Council to grant the permit. No one appeared in opposition to the recommendation of the Planning Commission, Motion by Bonniwell, seconded by Stark and passed, that the hearing be closed. Motion by Bonniwell, seconded by Bosquez and passed, that the foregoing application 01072-8, Iris Powell Grant, be tabled for one week pending determination of the applicant's decision for a Special Permit or deed restricting the property against certain uses. City Manager Townsend presented Application #1072-9, Orthmed Building Corpora- tion, for change of zoning from "R -IB" & "AB" to "B-1", located on west side of 3800 Block of Weber Road. The request was heard by the Planning Commission Oct. 17, 1972, and for- warded to the Council with the recommendation that it be approved as a logical use for this area, and the Staff concurred in this recommendation. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Lozano, seconded by Branch and passed, that the hearing be closed, Motion by Bosquez, seconded by Bonniwell and passed, that the recommendation of the Planning Commission be concurred in and that Application #1072-9, Orthmed Building Corporation, for change of zoning from "R -1B" One -family Dwelling District and "AB" Pro- fessional Office District to "B-1" Neighborhood Office District on the N,W. 50' of Lot 3, Unit 1, Washburn Meadows, Part of Lot 7, Unit 2, Washburn Meadows, and an ,82 -acre area out of Lot 4, Section A and Section J, Paisley Subdivision of the Hoffman Tract, be approved, and that an ordinance be brought forward effectuating the change, • Minutes Special Council Meeting November 22, 1972 Page 4 City Manager Townsend presented Application #1072-12, City of Corpus Christi, for change of zoning from "R-2" Two-family Dwelling District to "R -1B" One -family Dwelling District on all of Lots 2 and 3, and the northwest 1/2 of Lot 4, Block 2, Southland Estates, located in the 2900 Block of Sokol Drive. The request was heard by the Planning Commission October 17, 1972, and forwarded to the Council with the recommendation that it be approved, and the Staff concurred in this recommendation. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Bosquez, seconded by Gonzales and passed, that the hearing be closed. Motion by Lozano, seconded by Gonzales and passed, that the recommendation of the Planning Commission be concurred in and that Application 01072-12, City of Corpus Christi, for change of zoning from "R-2" Two-family Dwelling District to "R -1B" One - family Dwelling District on all of Lots 2 and 3, and the northwest 1/2 of Lot 4, Block 2, Southland Estates, be approved as requested and that an ordinance be brought forward effectuating the change. ORDINANCE NO. 11182 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD.IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF JOHN MENDLESKI BY GRANTING A SPECIAL USE PERMIT FOR A PARKING LOT ACCORDING TO THE APPROVED SITE PLAN, ON ALL OF LOTS 4 AND 5, BLOCK 5, ALAMEDA PARK, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO ALL OTHER CONDITIONS OF "B-4" ZONING DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLAR- ING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was passed by the Following vote: Sizemore, Bonniwell, Bosquez, Branch, Gonzales, Lozano, and Stark, present and voting "Aye". • Minutes Special Council Meeting November 22, 1972 Page 5 ORDINANCE NO. 11183 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO, 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOTS 2 & 3, AND N.W, 1/2 OF LOT 4, BLOCK 2, SOUTHLAND ESTATES, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R-2" TWO FAMILY DWELLING DISTRICT TO "R -1B" ONE FAMILY DWELLING DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY, The Charter Rule was suspended and the foregoing ordinance was passed by she following vote; Sizemore, Bonniwell, Bosquez, Branch, Gonzales, Lozano, and Stark, present and voting "Aye" There being no further business to came before the Council, the Special Meeting was adjourned at 5;15 p.m., November 22, 1972.
