Mayor Jason Luby called the meeting to order in the Council Chamber
of City Hall.
The invocation was given by Commissioner Branch in the absence of the
invited Guest Chaplain.
City Secretary T. Ray Kring called the roll of those in attendance.
Motion by Acuff, seconded by Lozano, and passed, that the Minutes of
the Regular Meeting of February 13, 1974 be approved as submitted to the
Council.
Mayor Luby announced the issuance of a proclamation designating the
month of March, 1974 as CEREBRAL PALSY MONTH.
Mayor Luby presented a list of nominees for the Sister City Committee
membership (See list in Boards & Committees file -containing names).
Motion by Acuff, seconded by Stark, and passed, that the nominations
for membership in the Sister City Committee presented by the Mayor be approved
and confirmed.
Mayor Luby announced the scheduled public hearing on a request of First
Savings Association for the contractual annexation of Flyway Unit 1, located
east of Everhart Road and south of Saratoga Blvd. The area is included within
the Wastewater (Sewer) Master Plan and can be served with utilities. The owners
desire to annex in order to acquire City water service.
Motion by Lozano, seconded by Acuff, and passed that the hearing be
closed.
Motion by Lozano, seconded by Ricardo Gonzalez, and passed to accept the
City Manager's proposal to annex this portion of the City.
Mayor Luby called for the City Manager's Reports and City Manager Town-
send presented requests and recommendations with related explanations and
comments as follows:

a. That bids be received at 11:00 a.m. on Tuesday, March 26, 1974
for the following:
1) A self propelled hydraulic hammer for the Gas Division.
2) Storage and parts racks for van type vehicles for the Building
Maintenance Division.
3) A 12" trailer mounted brush chipper far the Park Division.
b. That plans and specifications for the second phase improvements to
Greenwood Park be approved and bids be received on March 27, 1974. This phase
includes grading, landscaping, an irrigation system, a foot bridge, walkways, a
maintenance building, and a pavilion building with barbecue and rest room facilities
in an area of approximately 18 acres adjacent to and behind the existing pool. This
project is to be partly financed by the Department of Housing and Urban Development.
Plans and specifications are so drawn that contractors can bid on the general con-
struction work, the irrigation system, and the landscaping work separately or al-
together.
c. That the Preliminary Assessment Roll for street improvements to Nueces
Bay Blvd, Interstate 37 to Leopard, as prepared by the Department of Engineering &
Physical Development be approved and a public hearing on the assessments be held on
Wednesday, March 27, 1974, at 3:00 p.m. The assessments have been prepared based
on the low bid of $89,243.95 submitted by Asphalt Paving and Construction Company.
The proposed assessment roll is for $33,145.73 and involves 14 owners.
d. That the City's voluntary street improvement.participation procedure
be amended to provide that, if 50% of the owners of the lots in any subdivision join
in the petition of group of petitions, then the entire subdivision will be included
even if some blocks have not otherwise qualified.
e. That the Land Drilling Ordinance be amended to provide that the re-
quirement that no well shall be drilled less than 400' from any cemetery or public
park be reduced to no less than 200' from any cemetery or public park.
f. That Ordinance No. 9472, as amended, be amended to provide an un-
treated water rate of 6C per 1000 gallons per month for all water consumed and to
change the minimum charges for industrial and municipal customers and to add a mini-
mum charge for commercial users. Presently, the rates are 6c per 1000 gallons for
the first 60,000,000 gallons consumed per month and 5c per 1000 for gallons consumed
in excess of 60,000,000.

g. That the City Manager be authorized to submit a proposal and
entar into an agreement with the Nueces County Community Action Agency to
assume responsibility for preparation and delivery of meals to the elderly
presently being served by the CAA Nutrition Program in compliance with Title
VII of the Older Americans Act. The City would accept the staff presently
eaployed.under the Nutrition Program and all related equipment. Most of the
vans in use by the Community Action Agency would be loaned, leased or trans-
ferred by mutual agreement. Approximately 250 persons are now being served
by the CAA Program.
City Manager Townsend explained the proposed agreement with the Nueces
County Community Action Agency and reported that the contract with the CAA
could be for the equipment and the staff presently employed under the Nutrition
Program.
Emanuel. Saldana, a member of the CAA Board, came before the Council and
inquired as to why the City could not extend the program instead of paying West
Oso. He explained CAA was not entirely out of funds and the poor were being
fed and would be fed one way or another.
Mayor Luby commented that if the City took over the CAA,the City Council
would appoint a new Board.
Councilman Ricardo Gonzalez requested a complete report from CAA to see how
much had been collected, how much had been epent, haw much has been spent for the
staff, etc.
h. That the proposal of Chuck Wagon Catering Service to prepare and
deliver a maximum of 400 meals per day, with the daily number of meals and the
sites to be specified by the City, at a cost not to exceed $1.50 per meal be
accepted on a day to day basis and bids be received on March 19, 1974 for the
:e_ wining 8 months of the program beginning April 1, 1974. The meals will be
served at Woodlawn Presbyterian Church, First United Methodist Church, and the
First Lutheran Church.
i, That the City Manager be authorized to negotiate an agreement with
the Corpus Christi Independent School District for the use of the Washington
Elementary School as a possible site for the north side senior citizens center-

j. That the following steps be taken to protect the flight paths of
the Naval Air Station and Waldron Field:
1) That the 1972 bond program project for the construction of
laterals and a lift station to serve the area south of the
Tropic Isles Channel which is scheduled for construction
near the end of this year be deferred until 1975. The de-
ferral of this project will avoid encouraging growth in this
area thus helping to protect the Waldron Field flight paths,
2) That the Planning Commission be requested to hold public
hearings on changing the zoning on unplatted property adjacent
to the Naval Air Station and Waldron Field runways which are
in noise zone 3 to F -R, Farm -Rural District, or to I-2, Light
Industrial District.
3) That fourth entitlement (7-1-73 to 6-30-74) revenue sharing
money be used to acquire land in Flour Bluff at the southeast
end of the main NAS runway up to $500,000.
Mr. Willie (?) , residing at 3317 Tahiti appeared before the Council
and informed the Council he has resided in this area for 20 years and had been
in limbo. He was in favor of the City Manager's recommendation if the Council
would ago ahead with the project.
Mr. Dave Coover, attorney representing a number of property owners in the
Flour Bluff area appeared before the Council and advised that they were all in
favor of the NAS getting what it needs and the City helping them, however, he
requested the Council study the area to be zoned very thoroughly.
k. That an ordinance be passed to prohibit an owner from removing natural
ground cover in such a way that blowing sand or dirt is
deposited or interferes with the use of abutting or nearby private or public
property or streets.
Motion by Acuff, seconded by Branch, and passed, that the City Manager's
Reports, Items "a" through "k" be accepted, and the requests and recommendations

Mayor Luby announced the scheduled public hearing on six zoning cases.

City Manager Townsend presented Application #174-6, Mother Teresa Santoyo
from change of zoning from "R -1B" One -family Dwelling District to "AB" Professional
Office District, located west of Calallen Drive and north of the Calallen School
property, being 20.50 acres out of the F.J. Smith 225.2 acre tract out of the
Mariano Lopez de Herrera Grant, State Abstract No. 606, Nueces County, and for-
warded to the Council with the recommendation that "AB" be denied but in lieu
thereof a special permit be approved according to the site plan presented for the
overall development and recommending the screening fence requirement be waived.
Jack Kelso, attorney representing Mother Teresa Santoyo, appeared before
the Council and informed them that Mother Teresa Santoyo was in agreement with
the zoning change.
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Acuff, seconded by Lozano and passed, that the hearing be
closed.
Motion by Acuff, seconded by Lozano, and passed, that the recommendation
of the Planning Commission be concurred in and Application #1174-6, Mother Teresa
Santoyo, for change of zoning from "R -1B" One -family Dwelling District to "AB"
Professional Office District, located west of Calallen Drive and north of the
Calallen School property, be approved as recommended, and an ordinance be brought
forward effectuating the change.
City Manager Townsend presented Application #1073-13, Sir Goony Golf of
Corpus Christi, Inc., for change of zoning from "B-4" General Business District
to "I-2" Light Industrial District, located on the south side of South Padre
Island Drive, west of Kostoryz Road, being the rear 110 feet of Lot E-1, Boulevard
Acres, and forwarded to the Council with the recommendation that the "I-2" be
denied, but in lieu thereof a special permit be approved for the go-kart operation.
Councilman Lozano and Mayor Luby commented that a child had died following
a go-kart accident and they felt somebody should enforce safety rules.
Motion by Stark, seconded by Acuff, and passed that the hearing be closed.
Motion by Stark, seconded by Ricardo Gonzalez, and passed, that the special
permit be granted in lieu of change of zoning; that the City Manager take steps to
see that the City does make safety checks in this area.

City Manager Townsend presented Application #174-5, Victor Gonzalez
and Dr. Ernesto Sierra, for change of zoning from "R -1B" One -family Dwelling
District to "AB" Professional Office District, located on the southeast corner
of Green Grove Drive and Gollihar Road, being Lots 1 & 2, Block C, Stasa Sub-
division, and forwarded to the Council with the recommendation that it be approved.
E. V. De Leon of 2220 Morgan appeared before the Council and spoke in
favor of the zoning change stating they were only following a growth pattern.
Motion by Acuff, seconded by Stark, and passed that the hearing be closed.
Motion by Ricardo Gonzalez, seconded by Lozano, Branch voting "Aye", that
the Planning Commission's recommendation be accepted and allow the zoning change
from "R -1B" One Family Dwelling District to "AB" Professional Office District,
failed to pass with Luby, Stark, and Acuff, voting "Nay". Councilman Thomas
Gonzales declined to vote because of a possible conflict of interest this would
have caused.
City Manager Townsend presented Application #273-7, James C. Avant, for
change of zoning from "R -1B" One -family Dwelling District and "AB" Professional
Office District to "B-1" Neighborhood Business District, located on the north
right-of-way line of Saratoga Blvd. and east of Everhart Road, being a 1.495 acre
tract of land known as Lot #3, Section 1, Tract D, Country Club Estates, and for-
warded to the Council with the recommendation that it be denied but in lieu
thereof "AB" Professional Office District be approved as a logical extension of
the existing "AB" adjacent to the west.
Cliff Avant and Tim Clower appeared before the Council and reported they
were in favor of the zoning change.
Charles Steen, President of C. C. Country Club and Leon Gravelle, repre-
senting the homeowners -in the Country Club area, spoke in opposition of the
zoning change due to the number of apartment buildings in the immediate area.
John Keltner, representing Saratoga Land Company spoke in opposition of
the "B-1" change but were in favor of "AB".
Motion by Acuff, seconded by Ricardo Gonzalez, and passed that the hearing
be closed.

Commission's recommendation that "AB" Professional Office District be approved

as an extension of the existing "AB" adjacent to the west, failed to pass,
with Stark and Lozano voting "Nay". Six votes were needed for passage of the
ordinance making the change due to 20% rule being in effect.
City Manager Townsend presented Application #174-4, Auto Motor Exchange,
for change of zoning from "A-2" Apartment House District to "I-2" Light Indus-
trial District, located on the south side of Marguerite Street between Bluntzer
Street and South Port Avenue, being Lots 15, 16, and 17, Block 8, Steele Addition,
and forwarded to the Council with the recommendation that it be denied. City
Manager Townsend read the names of the residents who had returned their notices
and were opposed to the zoning change.
Arnold Dullnig, attorney representing the applicant, appeared and presented
a plan for development of the property.
Motion by Stark, seconded by Acuff, and passed to recess this public
hearing and refer back to the Planning Commission for new material to be pre-
sented by Mr. Dullnig.
Ricardo Gonzalez stated the Council should look into the case because the
people who had come to the hearing scheduled at this time had probably missed
work to be able to attend the meeting and report their oppositions.
Motion by Acuff, seconded by Ricardo Gonzalez, and passed to reopen the
zoning case.
Arnold Dullnig, attorney representing Pat Nicholas, owner of Auto Motor
Exchange, Vernon Smith, architect, and Pat Nicholas appeared before the Council
and presented their request to change from apartment -house district to light
industrial district three lots on the south side of Marguerite between Bluntzer
and South Port, supported & submitted their pian for development and stating
that the parking and drainage would be improved by their proposed development.
Two Marguerite residents, Louis Soto residing at 2725 Marguerite and
Mrs. Rodriguez, residing at 2709 Marguerite appeared before the Council and
opposed the change alleging too much industrial development in the area and
noise problems.
Motion by Acuff, seconded by Thomas Gonzales, and passed, that the
hearing he closed.

Motion by Acuff, seconded by Ricardo Gonzalez, and passed that the
Planning Commission's recommendation be concurred in and Application #174-4,
Auto Motor Exchange, for change of zoning from "A-2" Apartment House District
to "1-2" Light Industrial District on the south side of Marguerite Street
between Bluntzer Street and South Port Avenue, Lots 15, 16, and 17, Block 8,
Steele Addition be denied.
City Manager Townsend presented Application #174-3, Candystick Homes,
for change of zoning on: 1
Tract A - (5.5 Acres) from "R -1B" One -family Dwelling
District to "B-4" General Business District.
Tract B - (38 Acres) From "R -1B" One -family Dwelling
District to "A-2" Apartment House District.
Tract C - (40`Acres) From "R -1B" One -family Dwelling
District to "R-2" Two family Dwelling District.
All tracts being a portion of Lots 1 & 2, Section 9,
Bohemian Colony Lands, located on the south side of
Holly Road, west of Weber Road.
This application was forwarded to the Council with the recommendation
that "A-2" on Tract B and "R-2" on Tract C be approved as requested; and that
"B-4" on Tract A be denied but in lieu thereof "AB" Professional Office District
be approved on the basis that these zonings will provide logical transitions
between apartments and future residential uses in the area.
Roger Seaman, President of Candystick Homes, presented their plan for
development of the property.
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Lozano, seconded by Acuff, and passed, that the hearing be
closed.
Motion by Ricardo Gonzalez, seconded by Stark, and passed, that the
Planning Commission's recommendation be accepted and that "A-2" on Tract B and
"R-2" on Tract C be approved as requested; and that "B-4" on Tract A be denied
but in lieu thereof "AB" Professional Office District be approved on the basis
that these zonings will provide logical transitions between apartments and future
residential uses in the area.
Mr. Steve Morales came before the Council and presented a letter stating

Mr. Dave Lain, non -practicing attorney, appeared before the Council and
made some derogatory remarks to the Council stating the Mayor had the people
behind him.
Mr. Clay Moore appeared before the Council requesting to know "what was
going on" because he had been out of town for a month and had read in the paper
about the ordinance request to take the mayor's powers of appointment away from
the Mayor.
Councilman Thomas Gonzales informed Mr. Moore there was no intention to
take the mayor's powers away but an ordinance request had been made to clarify
this issue.
Lonnie M, King, residing at 1510 Ramirez, came before the Council requesting
their assistance. Mr. King reported that he had a piece of property at 2817 W.
Broadway that had been condemned by Neighborhood Improvement Division. He ex-
plained he had begun to tear down the house on the property but before he had
finished, the City had sent a bulldozer to tear down the house and carry out all
the material he had intended to save; the City was now charging him $550 for demo-
lishing this house and intend to sue him if it is not paid. He explained he felt
he had been "wronged" and asked for assistance from the Council.
City Manager Townsend reported he would check and see if all the proper
notices had been sent Mr. King informing him of his right to appeal.
Ray Ridgeway, residing at 537 Crain, came before the Council and commented
he had been present since 9:00 a,m. and had heard them discuss co-operation; that
the decision made was that the mayor had the power to appoint members of the Sister
City Committee.
Mrs. Helen Bluntzer commented to the Council she appreciated their consi-
dering her for Chairman of the Sister City Committee but explained she had with-
drawn her name for the betterment of the community. She explained she felt the
Sister City Committee should be headed by a married man.

FIRST READING/AMENDING ORDINANCE NO. 9472, PASSED AND APPROVED ON AUGUST 27, 1969,
AS AMENDED, SO AS TO PROVIDE AN UNTREATED WATER RATE OF SIX CENTS (6e) PER THOUSAND
GALLONS PER MONTH FOR ALL WATER CONSUMED AND TO CHANGE THE MINIMUM CHARGES OF IN-
DUSTRIAL AND MUNICIPAL CUSTOMERS AND TO ADD A COMMERCIAL MONTHLY CHARGE; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SEVERANCE CLAUSE; AND PROVIDING
FOR PUBLICATION.

DRILLING ORDINANCE", AS AMENDED, BY AMENDING SUBSECTION 4.5 OF SAID ORDINANCE
SO AS TO PROVIDE THAT NO WELL SHALL BE DRILLED AT ANY LOCATION WHICH IS ON OR
MORE THAN 200 FEET FROM THE EXTERIOR BOUNDARY LINE OF THE LANDS UTILIZED FOR

THE FIRST ONE-THIRD (1/3) OF A MILE OR FRACTION THEREOF, AND TEN CENTS (10c)
