SPECIAL COUNCIL MEETING
March 27, 1974

Mayor Jason Luby called the meeting to order in the Council Chamber
of the City Hall, stating the purpose of the special meeting was to hold public
hearings on zoning applications and any other business as may properly come before
the Council. It was noted that all members of the Council were present.
City Manager Townsend presented Application #274-1, W.J.B. Brown, for
change of zoning from "R -1B" One -family Dwelling District to "B-1" Neighborhood
Business District on Lots 45 and 46, Block 1601, Bay Terrace No. 2, located on the
east side of the 1400 Block of 19th Street between Crosstown Expressway and Elizabeth
Street. The request was heard by the Planning Commission February 19, 1974, and
forwarded to the Council with the recommendation that it be approved on the basis
that it is justified because the applicant would be unable to use all of his
property as it is now zoned and it would be an opportunity to stimulate the economy
in this area of the City. The Staff recommended denial on the basis it would be a
further intrusion into a residential area and would be a matter of where to "draw
the line". Mr. Townsend reported that three letters had been received since the
Commission hearing in favor of the request and three in opposition.
Mr. W.J.B. Brown, applicant, explained his plans for development of the
lots, stating he plans to tear down the existing single-family dwelling which is
deteriorated and would cost too much to repair, and construct a new building on all
four lots including the lots already zoned "B-1".
No one appeared in opposition to the recommendation of the Planning
Commission.
Motion by Stark, seconded by Ricardo Gonzalez and passed, that the
hearing be closed.
Motion by Stark, seconded by Ricardo Gonzalez and passed, that the
recommendation of the Planning Commission be concurred in and Application #274-1,
W.J.B. Brown, for change of zoning from "R -1B" One -family Dwelling District to "B-1"
Neighborhood Business District on Lots 45 and 46, Block 1601, Bay Terrace No. 2, be
approved, and an ordinance be brought forward effectuating the change.

City Manager Townsend presented Application #274-2, Roland Garcia, for
change of zoning from "R -1B" One -family Dwelling District to "B-4" General Business
District on Tract A (7.67 acres); and from "R -1B" One -family Dwelling District to
"A-1" Apartment House District on Tract B (11.82 acres), both tracts being a portion
of Block 11, Partition of the J. C. Russell Farm Blocks, located on the east side
of Navigation Boulevard, between Highway #44 and Old Brownsville Road. The request
was heard by the Planning Commission February 19, 1974 and forwarded to the Council
with the recommendation that it be approved. The Staff's opinion was that "A-1"
zoning would be logical for Tract B, however, a large area bas been approved for "B-4"
immediately to the south and therefore the Staff recommends that "A-1" also be
approved for Tract A in lieu of "B-4". Mr. Townsend reported that one letter had
been received since the Commission hearing in favor of the request and none in
opposition.
No one appeared in opposition to the recommendation of the Planning Commission.
Motion by Tom Gonzales, seconded by Ricardo Gonzalez and passed, that the
hearing be closed.

being a portion of Block 11, Partition of the J. C. Russell Farm Blocks, be approved,
and an ordinance be brought forward effectuating the change.
City Manager Townsend presented Application #274-3, Eliseo Trevino, Jr., for
change of zoning from "R -1B" One -family Dwelling District to "R-2" Multiple Dwelling
District on the south one half of Lot 11, Block 22, Meadow Park Addition, located
on the east side of the 400 Block of Cheyenne Street between Navajo and Chippewa
Streets. The request was heard by the Planning Commission February 19, 1974, and
forwarded to the Council with the recommendation that it be approved as a practical
use of the property. The Staff's opinion was that approval would be detrimental to
adjacent residents because as many as three units could be developed on the lot
which is small and would add to the congestion in this area. One letter was received
after the Commission hearing in opposition.

Motion by Acuff, seconded by Ricardo Gonzalez and passed, Luby voting "Nay",
that Application #274-3, Eliseo Trevino, Jr., for change of zoning from "R -1B" One -
family Dwelling District to "R-2" Multiple Dwelling District on the south one half of
Lot 11, Block 22, Meadow Park Addition, be denied, but in lieu thereof a special
Council permit be granted to allow extension of the existing structure to include
living quarters, and that an ordinance be brought forward effectuating the special
permit.
City Manager Townsend presented Application #274-4, John D. Hawn, et al,
for change of zoning from "I-2" Light Industrial District to "B-4" General Business
District on 51 acres out of Lot 1, Section 12, Bohemian Colony Lands, located south
of Saratoga Boulevard and west of Weber Road. The request was heard by the Planning
Commission February 19, 1974, and forwarded to the Council with the recommendation
that it be denied. The Planning Staff concurred in this recommendation.
Mr. John Keltner, property manager of the Hawn Brothers on this particular
tract of land spoke on behalf of the applicant and stated the land was purchased as
an investment in 1960. He stated the tract was annexed by contract along with several
other tracts in February 1972 with the "I-2" zoning classification which allowed the
flexibility of all uses up through the "I-2" zoning district. He stated they were
unaware of the City's plans to change the "I-2" regulations which limited the oppor-
tunity to build residences on the property, and his clients asked for "B-4" zoning
in order to maintain the same flexibility for 50 of the original 71 acres zoned "I-2".
He stated if residences within the Zone 3 rated area are restricted, then they are
requesting that the zoning request be considered. He pointed out on a map where
Zone #3 cuts through the land, and is now requesting that the application be reduced,
by the area which falls within the line,if the ordinance is changed. Mr. Keltner
requested that the Council defer action on this application until a decision is made
on the Zone 3 rated area.
No one appeared in opposition to the recommendation of the Planning Commission.
Motion by Acuff, seconded by Lozano and passed, that the hearing be closed.

Hawn, et al, be tabled for further consideration.

of zoning from "R -1B" One -family Dwelling District to "A-1" Apartment House
District on Carrolleton Annex #3 and Hancock Tract and the City -owned property
(containing approximately 4.91 acres), located along the west right of way line of
Carroll Lane, south of Houston Street and north of Copus Street. The request was
heard by the Planning Commission February 19, 1974 and forwarded to the Council
with the recommendation that it be denied. The Staff recommended "R-2" Multiple
Dwelling District in lieu of the "A-1", that while the property is located in a
residential area, it has been vacant for some time and warrants some type of zoning
that will encourage development. Mr. Townsend reported that two letters had been
received in favor of the request since the Commission hearing and 26 in opposition,
and that the 20 percent rule is in effect.
Mr. Jack Solka, architect, representing the applicant, presented the
proposal stating a 54 unit low density apartment project is planned with sidewalks
and landscaping suitable for apartment developments with underground drainage, fencing,
and everything relating to HUD criteria, including the site. He stated the complex
would generate approximately 100 cars. He pointed out that this property has been
vacant for some time which indicated that it is not going to be developed with single-
family residences and the zoning should be changed.
Mr. H. D. Arbuckle, Jr., 3501 Copus, and Mr. Marcel Poirrier, 3505 Copus,
spoke in opposition generally on the basis that it would congest the narrow streets,
and crowd the area schools. Mr. Arbuckle, Jr., "suggested that this property be
purchased by the City and developed as a public park since the children in this area
have no place to play.
Mrs. Pat Duaine, realtor, representing the applicants, spoke in favor of
the request stating the owners should be allowed to develop the property since there
has not been an offer of purchase for any other use in several years.
Mrs. Jean Wyatt, president of the Unitarian Church congregation, stated the
Church was not in a position to provide a park for the residents, and felt the ownem
of this property should be allowed to develop the property.
Mr. Solka stated the applicants preferred "A-1" but would accept the Planning
Staff's recommendation for "R-2" Multiple Dwelling District in lieu of the "A-1"

City Manager Townsend stated the Staff should be instructed to abandon the
dedicated right of way running through the subject property, but would recommend that
this be, heldin abeyance at this time.

BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON. LOTS 45 AND 46, BLOCK 1601,
BAY TERRACE NO. 2 SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM

The Charter rule was suspended and the foregoing ordinance was passed by
the following vote: Luby, Acuff, Branch, Tom Gonzales, Ricardo Gonzalez, Lozano
and Stark, present and voting "Aye".
