ON THIS, the 3rd day of 1"wbeE, 1944, the City Council
of the City of Corpus Christi, Texas, convened in special
session meeting, with the following members of said
Council present, to -wit:

with the following absent: None, constituting a quorum, at
which time the following, among other business, was transacteds
Mr. Mireur presented for the consideration of the Council
an Ordinance.
The Mayor presented to the Council a communication in
writing pertaining to said proposed ordinance, as follows:
"CORPUS CHRISTI, TEXAS

Corpus Christi, Texas
Gentlemen:
Due to the fact that it is essential and
necessary that the City of Corpus Christi, Texas,
call as election oa the issuance of its Seawall and
Breakwater Bonds under and by virtue of Title 22 of
the Revised Civil Statutes of Texas of 1925, as
amended, and the provisions of Chapter 138, Act$ of
the Regular Session of the Thirty - Seventh Legislature
as further amended by the Forty -Sixth Legislature by
what is known as House Bill No. 52, in the sum of
$1,500,000.00, bearing interest not to exceed three
per cent (j%), for the purpose of obtaining funds to
provide additional facilities for the protection of
property and lives from tropical storms, the pro-
posed ordinance calling said election meta a public
emergency, and I request that it be passed finally on
the date introduced.

Mr. Mireur made a motion that the Charter provisions pro-
hibiting ordinances from being finally passed on the date intro-
duced be suspended for the reasons stated in the written request
of the Mayor and stated in the emergency clause of the ordinance.
The motion was seconded by Mr. Williams. The motion carried by
the unanimous vote of the Council, viz:
AYS: Commissioners Mireur, Williams, Segrest, and
Moffett.
NAYES: None.
Dr. Segrest made a motion that the ordinance be passed
finally. The motion was seconded by Yr. Moffett. The motion
carried by the following vote:
AYES: Commissioners Mireur, Williams, Moffett, and
Segrest.
NAPES: None.
The Mayor requested to be recorded as voting "AYE ", which
was done.
The Mayor announced that the ordinance had been passed.

BE IT ORDAINED BY THE CITY COUNCIL OF TEES CITY OF CORPUS CHRISTI,
TEWi .
1. An election is hereby ordered to be held on the
Lday of November, 1944, in the City of Corpus Christi, Texas,
at which election there shall be submitted to the resident, quali-
fied electors of the City of Corpus Christi, idw own taxable prop-
erty in said City and who have duly rendered same for taxation, the
following propositions
°Shall the city Council of the City of Corpus
Christi, Tams, be authorised to issue the bonds of
the said City in the sum of $1,500,x.30, maturing
serially in such installments as the City Council may
prescribe, provided that the final installment shall
mature act later than August 1, 1956, and bearing
interest not to exceed the rate of three per cent (3 %)
per annum from the date thereof, payable semianually,
and whether a tax shall be levied on all taxable
property therein sufficient to pay the annual interest
and provide a sinking fund to pay the bonds at maturity,
in accordance with Title 22 of the Revised Statutes
of Tams (1925) as amended, with provisions for
creating an interest and sinking fund sufficient to
pay the principal and interest of said bonds out of
money to be received under and by virtue of the Act of
the 37th Legislature of the State of Texas in its Regular
Session, 1921, being Chapter 138 of the General laws of
said Session, donating to the City of Corpus Christi for
a period of 25 years the State ad valorem taxes collected
on all property and from all persona in the counties of
Jim Wells. Jim Hogg, Brooks, Nlebarg, Wil]acy and
Duval, sad all of the State ad valorem taxes col-
lected on all property and from all persons in Nueoes
County not theretofore donated to the City of Corpse
Christi by the Act of the 35th legislature of the
State of Texas, Chapter 116, General Laws, Regular
Session, as said Chapter 138, of the General Lem of
the 37th Legislature of the State of Texas, Regular
Session, 1921, was amended by the 46th Legislature,
Regular Session, 1939, by House Bill Number 52 of
such Session, extending the donation period to Sep-
tember, 1956, and cut of funds received by the City
of Corpus Christi from the State of Texas, under
aqy amendments to such acts of said Legislature,
said bonds and the money derived from the same to
be used for the purpose of oonstraoting seawalls and
breakwaters, or either, to be located wholly within
the City Limits of the City of Corpus Christi, pro-
vided that to the extent that such donated funds shall be
sufficient end available to pay such principal and int-
erest, taxes shall not be collected."
2. Said election shall be held in the City of Corpus Christi,
Texass at the following places and the following named persons are

3. That said election shall be held in accordance
with the provisions of Chapter 1, Title 22 of the Revised Civil
Statutes of 1925, as amended, including the provisions of
Article 704, as amended by Chapter 382, passed at the First
Called Session of the lalth Legislature, and the City Charter
of the City of Corpus Christi, Texas, and only legally quali-
fied electors who own taxable - property in the City and who
have duly rendered the same for taxation shall be qualified
to vote. The polls shall be open from 8;00 o'clock A. M. to
7:00 o'clock P. M.
All voters desiring to support the proposition to
issue said bonds shall have printed on their ballots the
words:
"FOR THE ISSUANCE OF THE BONDS ",
and those opposing the said proposition to issue bonds shall
have printed on their ballots the words:
"AGAINST THE ISSUANCE OF THE BONDS".
4- A substantial copy of this ordinance signed by
the Mag•or of the City of Corpus Christi shall constitute the
notice of ordering said election, and the Mayor is directed
to cause a copy of this ordinance signed by him to be posted
at the City Hall and at each of the voting places in each
bond election precinct not less than fifteen (15) days prior
to said election, and to have a copy of this ordinance signed
by him published in the Corpus Christi Caller, the official
newspaper, and in the Corpus Christi Press; both being news-
papers of general circulation, published within the City of
Corpus Christi; said publication to be made on the same day
in each of two successive weeks prior to the date of the
election and the date of first publication to be not less than
fourteen (14) days prior to the date of said election.
5. The fact that the greater portion of the
business part of the City of Corpus Christi, and all of the
shipping district, is located on the edge of Corpus Christi Bay
only a few feet above sea level, and the facts that the improve-
ments contemplated herein are essential to the protection and
health of the inhabitants of the City of Corpus Christi and that
there is an urgent need for the immediate protection of the
property and lives from the tropical storms, and the fact that
such improvements are necessary for the orderly development and
growth of the City of Corpus Christi and the Port of Corpus Christi,
and the fact that property, a great number of lives and boats in
the shipping district of the City of Corpus Christi were destroyed
by prior storms, and the fact that the Port of Corpus Christi and
the properties thereof need protection for all shipping industries,
create a public emergency and an imperative public necessity requir-
ing the suspension of the Charter rule providing that no Ordinance
or Resolution shall be passed finally on the date it is intro-
duced, and that such Ordinance or Resolution shall be read at
three several meetings of the City Council, and the Mayor having
declared that such public emergency and imperative necessity exist,
and having requested that said Charter rule be suspended, and that
this Ordinance take effect and be in full force and effect from
and after its passage, IT IS, ACCORDINGLY, SO ORDAEM.
