following business was transacted:
Mr. Mireur presented for the consideration of the Council
an ordinance. -
The k'ayor presented to the Council a communicat?.on in
writing pertaining to said proposed ordinance, as follows:

Gentlemen:
For the reason set forth in the emergency clause,
Section 2 of an ordinance entitled 'Ordinance canvassing returns
and declaring the results of an election on the question of the issu-
ance of x1,500,000.00 of bonds of said City of Corpus Christi, Texas,
for the purpose of constructing seawalls and breakwaters, or either,
to be located wholly within the City limits of the City of Corpus
Christi, and declaring an emergency', the proposed ordinance meets
a public emergency and I request that it be passed finally on the
date introduced.

Jommissioner made a motion that the
Charter provisions prohibiting ordinances from being finally passed on the
date introduced be suspended for the reasons stated in the written request of
the Mayor and stated in the emergency clause of the ordinance. The motion
was seconded by Commissioner The motion carried by the
unanimous vote of the Council, viz:

City Council of the City of Corpus Christi, Texas, passed an ordinance calling j
an election to be held in said City on the 25th day of November, 1944, on the
following proposition:
"Shall the City Council of the City of Corpus Christi,
Texas, be authorized to issue the bonds of the said City in the am
of `1,500,000.00, maturing serially in such installments as the City
Council may prescribe, provided that the final installment shall
mature not later than August 1, 1956, and bearing interest not to

City Council of the City of Corpus Christi, Texas, passed an ordinance calling j
an election to be held in said City on the 25th day of November, 1944, on the
following proposition:
"Shall the City Council of the City of Corpus Christi,
Texas, be authorized to issue the bonds of the said City in the am
of `1,500,000.00, maturing serially in such installments as the City
Council may prescribe, provided that the final installment shall
mature not later than August 1, 1956, and bearing interest not to
exceed the rate of three per cent (3 %) per annum from the date thereof,
payable semiannually, and whether a tax shall be levied on ail taxable
property therein sufficient to pay the annual interest and provide a
sinking fund to pay the bonds at maturity, in accordance with Title
22 of the Revised Statutes of T®xas (1925) as amended, with provisions
for creating an interest and sinking fund sufficient to pay the prin-
cipal and interest of said bonds out of money to be received under and
by virtue of the Act of the 37th Legislature of the State of Texas in
its Regular Session, 1921, being Chapter 138 of the General Laws of
said Session, donating to the City of Corpus Christi for a period of
25 years the State ad valorem taxes collected on all property and from
all persons in the counties of Jim )bells, Jim Hog:,, brooks, Nleberg,
aillacy and Duval, and all of the State ad valorem taxes collected on
all property and from all persons in Nueces County not theretofore
donated to the City of Corpus Christi by the Act of the 35th Legis-
lature of the State of Texas, Chapter 116, General Laws, Regular
Session, as said Chapter 138, of the General Laws of the 37th Legis-
lature of the State of Texas, Regular Session, 1921, .ras amended by the
46th Legislature, Regular Session, 1939, by house Bill Number 52 of
such Session, extending the donation period to September, 1956, and
out of funds received by the City of Corpus Christi from the State
of Texas, under any amendments to such acts of said Legislature, said
bonds and the money derived from the same to be used for the purpose
of constructing seawalls and breakwaters, or either, to be located
wholly within the City Limits of the City of Corpus Christi, provided
that to the extent that such donated funds shall be sufficient and
available to pay such principal and interest, taxes shall not be
collected."

notice of said election was actually given as
required by law and as directed in the ordinance calling the election, as is
shown by affidavits properly filed in the office of the City Secretary; and

fore passed by this Council and the result of said election has beer. certified I

25th day of November, 1944; and

1. That the proposition to issue the bonds
was sustained
by a majority of the resident, qualified
electors who o^n taxable property
in said City and who have duly rendered the same for taxation voting at said
election and the City Council of the City of Corpus Christi, Texas, is hereby
authorized to issue said bonds in accordance with said proposition,
2. The facts: that the improvements contemplated by
reason of the bonds authorized in such election are essential to the pro-
tection of the property and health of the inhabitants of the City of Corpus
Christi, and that there is an urgent need for i— ediate protection of the
property and lives; that tae improvements to be derived from the sale of the
bonds authorized in such election are necessary for the orderly development
and growth of the Port and City of Corpus Christi; and that such improvements
are essential, crate a public emergency and a public imperative necessity
requiring the suspension of the Charter Rule providing that no ordinance or
resolution shah be passed finally on the date it is introduced, and that
such ordinance or resolution shall be read at three several mestings of the
City Council, and the Mayor having declared that such public emergency and
i.mnerative necessity exist, and having requested that said Charter Yule be
