INTO THE CITY or CORPUS CHRISTI AND SHOULD TR& CITY ASSUME ALL BONDED INDEBTEDNESS ON SUCH TERRI- TORY 0711210 BY THE NUECES COUNTY WATER IMPROVE- ?BENT DISTRICT NUMBER ONE, AND IF THERE SHOULD BE ANNUALLY LEVIED AND COLLECTED ON AIL TAX-. ABLE PROPERTY WITHIN THE CITY, LIMITS A. TAT SUFFICIENT TO PAY OFF AND DISCHARGE SAID BONDED INDEBTEDNESS= DEFINING THE TERRITORY TO BE.ADMITTED . PURSUANT TO SUCH ELECTION; DESCRIBING THE POLLING PLACE FOR HOLDING SUCH ELECTION IN THE CITY OF CORPUS CHRISTI, AND NAMING THE OFFICERS THEREFOR; PRESCRIBING FORM OF NOTICE OF . ELECTION; ENACTING PROVISIONS IN- CIDENT AND RELATING TO THE PURPOSE OF THIS .,ORDINANCE. AND DECLARING AN EMERGENCY.. WHEREAS, on the 15th day pf November, 1914y there was filed with the city council, and scterwprd emended, a petition signed by Willard H. .Perkine-'and 1,au others, alleging themselves to be a majority of duly qualified resident voters re- aiding in the territory desoribed in such petition, and praying this Counoil to admit said territory into the City of Corpus Christi, Texas; and WHEREAS, this Council, upon due investigation, bas ascertained and determined that said petition is signed by a majority of the duly qualified resident voters residing within said territory, and that suoh territory adjoins the limits of said City; THEREFORE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF 30110011 CHRISTI, TEXAS; SECTION 1. That an election be held on the 28th day of December, 19174, within the City of Corpus Christi for the purpose of determining whether or not such territory should be ad- mitted to the City of Corpus Christi, Texas, and whether or not the /I7Lko City of Corpus Christi Should assume all bonded indebtedness awing by the Nueces County Water Improvement District Number One, and if there should be annually levied and collected on all taxable property within the City limits a tax sufficient to pay off and discharge said bonded indebtedness; such territory being herein described as follows; BEGINNING at the Northwest ooxner of Blook 610 of the Port Aransas Cliffs Subdivision, as shown on the recorded map, whioh corner is a point on the boundary line of Nueoes County Water Improvement District No. 1 as established by the Seoond Called Session of the Forty - first Legislature of the State of Texas, in House Bill No. 199; THENCE along the boundary line of said Water Im- provement District No. 1, in a Southeasterly direction along the East side of Austin Street as recorded in the Nap Heoords of Nueoes County, to the Southwest corner of Block 622 4.; THENCE in a Southwesterly direotion along the South- east line of Blocks 723,823, 923 and 1023 to the inter- section of the Southeast line of said blocks with the Southwest line of Section 1 of the Flour Bluff and Encino]. Farm and Garden Tracts; THENCE in a Southeasterly direction along the South- west line of Seetione 1 and 15, of the Flour Sluff and Enoinal Farm and Garden Tracts to the South corner of Lot 413, Section 15, which is also the North corner of Lot 49, Section #L4, of the Flour Bluff and Enoinal Farm and Garden Tracts; THENCE in a Southwesterly direction with the North- west line of said Lot 5, Section 11;, to its West corner; THENCE with the Southwestern boundary line of said Lot 45, Seotion 14, to its South cornet; THENCE with the Southeast boundary line of Lot 5, Seotion 11+, in a Northeasterly direotion to its inter - eeotion with the Southwestern boundary line of Seotion 15 of the Flour Bluff and Enoinal Fern and Garden Tracts; THENCE with the Southwestern boundary line of said Section 15, and Seotion 16 in a Southeasterly direction to the Western shoreline of Oso Creek at mean low tide; THENCE in a Northeasterly direotion with the meanders of the Western shoreline of Oso Creek to the moat Easterly point of said Western shoreline of said Oso Creek at or near its intersection with the shoreline of Corpus Christi Bay at the mouth of the creek sometimes oalled the Blind Oso; THENCE due Borth one mile; THENCE in a Northwesterly direction to the most Easterly Southeast corner of the boundary line of the City of Corpus Christi as of September 15, 1944; THENCE with the meanders of the Southeast boundary line of the City of Corpus Christi in a Westerly direction to an intersection with the Shoreline of Corpus Christi Bay and the North line of Louisiana Street, whioh is the moat Northerly corner of Nueoes County Water Improvement District No. 1; - .9'ffi2$- .'in- a_Soutimesterly direction with the City _Matte. eu the boindary line or said Water Improvaaent ]Hatrigt to the weaker line of Sent* Fs Streett .._._ MAYS. Such election shall be held in conformity with the general laws of the State regulating elections for submitting questions to the qualified voters of the City, and in conformity with the provisions of Artiole1182 -A of the Revised Civil Statutes of the State of Texas, 1925. SECTION 4. All qualified voters who reside within the City of Corpus Christi and who awn taxable property therein, and who have duly rendered the same for taxation, may vote in such election; and all of such voters who favor the admission of said territory to the City of Corpus Christi and the assumption by the City of Corpus Christi of all bonded indebtedness owing by Nusoes Water Improvement District Number One, and who favor the annual levy and collection on all taxable property within the City limits of a tax sufficient to pay off and discharge said bonded indebtedness, Shall have written or printed upon their ballots the worder "FOR ANNEXaTION OF ADDITIONAL TERRITORY AND ASSUMPTION BY TEE CITY OF ALL BONDED INDEBTEDNESS AND FLAT RATES OWING TO SUCH WATER CONTROL AND IMPROVEMENT DISTRICT ON THE TERRITORY TO BE ANNEXED AND THE LEVYING AND COLLECTING OF A TAX ON ALL PROPERTY WITHIN THE CITY LIMITS SUFFICIENT TO PAY OFF AND DIS- CHARGE SAID BONDED INDEBTEDNESS AND FLAT RATES." and those opposed shall have written or printed upon their ballots the words: "AGAINST ANNEXATION OF ADDITIONAL TERRITORY AND ASSDMPTION BY THE CITY OF ALL BONDED INDEBTED- NESS AND FLAT RATES OdING TO =HEATER CONTROL AND IMPROI01ENT DISTRICT ON THE TERRITORY TO BE ANNEXED AND THE LETTING AND COLLECTING OF A TAX ON ALL PROPERTY WITHIN THE CITY LIMITS SUFFICIENT TO PAY OFF AND DISCHARGE SAID BONDED INDEBTEDNESS AND FLAT RATES." SECTION 5. It is further ordered that an eleotion be held on the 218# day of Deoember, 19114, within the City of Corpus Christi for the purpose of determining whether or not such territory should be admitted to the City of Corpus Christi, Texas, and whether or not a majority of the legally qualified tax- paying voters residing in said territory proposed to be annexed favor the annexation of said territory proposed to be annexed, such territory being herein designated and described as follows; BEGINNING at the Northwest corner of Block 610 of the Port Arousal' Cliffs Subdivision, as shown on the recorded map, which corner is a point on the boundary line of Nueoes County Water Improvement Dietriot No. 1 ae established by the Seoond Called Session of the Forty - first Legielatere of the State of Texas, in Rouse Sill No. 199; THENCE along the boundary line of said Rater Im- provement District No. 1, in a Southeasterly direction along the East side of Austin Street as recorded in the Map Records of Nueoes.. It is the intent of these field notes to inolude all of Nueoes County Eater Improvement District No. 1, as established by the aforesaid Aot, and a portion of Corpus Christi Bay adjacent thereto, and a strip of land being the South half of Chamberlin Street, as shown on the re- oorded map of Port Aransas Cliffs Addition between the oenter line of Santa Fe Street and the East line of Austin Street. - - SECTION 6. The said eleotion ordered in the preceding eeotion Shall be held in the City of Corpus Christi, Nuecee County, Texas, as aforesaid, at a convenient plane within said pity limits, said convenient plaoe being at the polling place hereinafter designated, said polling plaoe and presiding officer and clerks for the holding of said election to be as follows; POLLING PLACE OFFICERS M. Such election provided in the two next preceding section, shall be held in conformity with the general laws of the State regulating elections for submitting questions to the legally qualified tax- paying voters, and in conformity with the provisions of Article 1182 -A of the Revised Civil Statutes of the State of Texas, 1925, as amended. SECTION 8. 911 qualified voters who reside within said territory and who am taxable property therein, and who have duly rendered the same for taxation, may vote in suoh election provided for in the next preoeding three sections; and all such voters who favor the annexation of said territory to the City of Corpus Christi shall have written or printed upon their ballot& the words: "FOR ANNEXATION OF ADDITIONAL TERRITORY AND ASSUMPTION BY THE CITY OF ALL BONDED INDEBTEDNESS AND FLAT RATES OWING TO SUCH WATER CONTROL AND IMPR0VEMENT DISTRICT ON THE TERRITORY TO BE ANNEXED AND THE LEVYING AND COLLECTIN1 OP A TAX ON ALL PROPERTY WITHIN THE CITY LIMITS SUFFICIENT TO PAY OFF AND DIS- CHARGE SAID BONDED INDEBTEDNESS AND FLAT RATES." and those opposed shall have written or printed upon their ballote the words; "AGAINST ANNEXATION OF ADDITIONAL TERRITORY AND ASSUMPTION BY THE CITY OF ALL BONDED INDEBTED- NESS AND FLAT RATES DINING ID SUCH WATER CONTROL AND IMPROVEMENT DISTRICT ON TIE TERRITORY TO IN ANNEXED AND THE LEVYING Affil COLLECTIRG OF A TAX ON ALL PROPERTY WITHIN THE CITY LIMITS SUFFICIENT TO PAY OFF AND DISCHARGE SAID BONDED INDEBTEDNESS AND FLAT RATES." SECTION 9. If at the election provided for in Section 1 of this Ordinance, a majority of the legally qualified tax- paying voters residing within the territorial limits of such City, and if at the election to be held under the terms of Sections 5, 6, 7, and 8 of this Ordinance, a majority of the legally qualified tax - paying voters residing within the territorial limits proposed to be annexed, shall vote in favor of the annexation of such additional territory, the City Counoilshall,by Ordinance, receive such territory as a part of said Citypnd shall assume e11 of said bonded indebtedness and flat rates on the territory thus annexed, and due such Nueces County Water Improvement District Number One. SECTION 10. Sai& elections provided by this Ordinance shall be separate elections and the returns thereof shall be canvassed and the results declared, as is provided by law in other elections pertaining to acid City. SECTION 11. A copy of this Ordinance signed by the Mayor of the City of Corpus Christi and attested to by the City Secretary of the City shall serve as proper notice of the said election and the Mayor is directed to cause notioe of the election to be posted at three publio places within the territory hereinabove described, such date of posting to be for at least fifteen full days prior to the date of the election. A oopy of this Ordinance signed by the Mayor of the City of Corpus Christi and attested to by the City Secretary of the City shall be posted in each of the election precincts hereby provided for at least fourteen days prior to the date of the election, and a copy of this Ordinance signed by the Mayor of the City of Corpus Christi and attested to by the City Secretary of the City shall be caused to lie published in the Corpus Christi Caller, the official newspaper of the City, on the same day for each of two successive weeks, the first of which shall be at least fifteen full days prior to the date Of Said election. SECTION 12. Tho fact that the property sought to be admitted, and described herein, is not protected at the present time, in that it has no polioe or fire proteotion accorded to residents of the City of Corpus Christi, and the further fact that such territory is not subject to or under the proteotion of the Boning regulations of the City of Corpus Christi at the present time, and the fact that there is, at the present time, an effort is being made on the part of property owners in the terri- tory to depreciate such property as residence property by erecting thereon structures for uses other than those contemplated by a majority of the residents, and that there is a dire necessity for Boning regulations, creates a public emerge/soy and a publio imperative necessity requiring the suspension of the Charter rule providing that no Ordinance or Resolution shall be passed finally on the date it is introduced, and that such Ordinance or Resolution shall be read at three several meetings of the City Council, and the Mayor having deolared that auoh public emergency and pnblio imperative necessity exist, and having requested that said Charter rule be suspended and that such Ordinanoe be passed finally on the date it is introduced, and take effect and be in full force and effect from and after its passage, IT 1S, ACCORDINGLY, S0 ORDAINED.
