SECTIG. 2. 1,,o existing buildimS within any territory rowdy annexed to u.e City of Cor_rus Christi not now lawfully used for busi- nor:; p -poses shall be altered, remodeled or ccnstracted for business gurposes without a permit from the City Council of Corpus Christi, nor shall any existing building in any territory that may be hereafter annexed to the City of Corcus Christi that is not :awfully used for business purposes at the time of such annexation be altered, remodelec. or aonstructod for business p..rposos without a perult from the City Council of the City cf Corpus Chri at-. Tai. permit shall be obtained under the same prpoedure at out in section 1 of this Ordinance. 32CTION j. That the o3mer, lessee, or any other person, firm or corporation owning, controlling, constructing, sups rvi sing, or directing the construction of any building or structure now in process of construction and which is incomplete at the time the land upon which it is situated is annexed to the City of Comus Christi, before proceeding further with the construction, alteration or completion thereof, shall apply to the City Engineer of Corpus Christi for a permit authorizing farther work on said buildirg or structure, and shall attach to said appliontion for such permit pla= and specifications relating to the constr Lion of said bu'ld- ing or structure, which said application for bu:ldin;, vomit shall be promptly referred to the City Planning Co.=sission for consideration, and said Commission shall promptly thereafter file with said gov., n ing body its recommendation as to granting, modifying or rejecting said permit, said recommendation to be advisory, as stated in Section 1 hereof. Said construction wore shall be suspended until the permit provided for herein has been issued, or until final zoaing regulations have been adopted, which permit the construction, use, and occupancy of the str'cature or builddn}-. SECTIOIi 4- That anyone violating the provisions of this Ordinance shall be guilty of a misdemeanor, and upon conviction thereof shall be fined in any sum not to exceed Two Hundred Dollars (VOO.00), and each day such violation shall exist, or be permitted, shall constitute a separate offense, and provided, further, that in case the violator of any part of this Ordinance shall be a corporation, then, in that - event, the officers, manager, agents and servants of such corporation shall be severally liable for the penaltiea provided herein. SECTION 5. If any section, or provision of any section, of this Ordinance be declared to be void, ineffectdve;or unconstitutional, the holding of such section, o. provision of any section, to be void, ineffactdve or Unconstitutional for any cause whatever shall not affect the validity of the remaining sections and provisions of this Ordinance. 3ECTIOE 5. The fact that territory has been newly annexed to the City of Corv'as Christi, Texas, and that elections have been held and will be held to annex additional territory to the City of Corpus Christi, Texas, and that zoning regulations are necessary in such territory to promote the health, welfare, safety and morals of the citizens of Corpus Christi, Texas, and there now exists no provision for the zonira of such newly acquired territory, and it is neoessary that temporary rules be promulgated for such newly acquired territory to have effect until such territory can be carefully considered by the City Planning Commission and oarefully zoned in accordance with such consideration, creates a public emergency and imperative public necessity requiring the suspension of the Charter rule or requirement that no Ordinance or Resolution shall be passed Finally on the date of its introduction, an3 that said Ordinance or Resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and imperative public necessity exist, and requested that said Charter role be suspended, and that this Grdinance be passed finally on the date of its introduction, and take effect and be in full force and effect from. and after its passa6s, IT IS SO ORDAINED.
