Page 84 The work shall be exeouted in oonformity therewith and the Con'. tractor shall do no work without proper drawings and instructions. The Contraotor and the Arohiteot, if either so requests, shall ;;ointly prepare a schedule, subject to ohange from time to time in ao- ccrdanoe with the progress of the work, fixing the dates at which the rerioua detail drawings will be required, and the Arohiteot shall furnish them in a000rdanoe with that aohedule. Under like conditions, a sohe- 0.12e shall be prepared, fixing the dates for the submission of shop draw - .'rigs, for the beginning of manufaoture and installation of materials and for the oompletion of the various parts of the work. Art. 4. Omelet Furnished.-- Unless otherwise provided in the Contract Documents the Arohiteot will furnish to the Contraotor, free of charge. all oopies of drawings and speoiPioatione reasonably neoeasary for the execution of the work. ilrt. 54 Shop Dr@winsee..The Contractor shall submit with suoh promptness as to cause no delay in hie own work or in that of any other Contraotor, two oopies of all shop or setting drawings and sohedules required fOr the work of the various trades, and the Arohiteot shall pass upon them with reasonable promptness. making desired oorreotions, inoluding all necessary oorreotions relating to artistio effect. The Contraotor shall make any oorreotions required by the Arohiteot, file with him two oorreoted oopies and furnish such other copies as may be needed. Art. 7. Ownership of Drawines and Models. --811 drawings, specifioatioas and oopies thereof furnished by the Arohiteot are his property. They era not to be used on other work and, with the exooption of the signed Coir rat. S et, are to be returned to him on request, at the completion of the work. All models are the property of the Owner. grt, 8. Samples.- -The Contraotor shall furnish for approval all sampler as directed. The work shall be in a000rdafoe with approved samples. Art. 9. Materials. Appliances. Emnloveel. -- Unless otherwise etipulatac.; the Contraotor shall provide and pay for all materials, labor. water, tools. equipment, light power, transportation and other facilities n • - oeseary for the execution and oompletiea of the work. Unless otherwise specified, all materials, shall be new and workmanship and materials shell be of good quality. The Contraotor pi;a:' t., if required, furnish satisfactory evidence as to the kind and quality of materials. The Contraotor Shall at all times enforce strict d3eoipline and General Conditions. Royalties and Patents.- -The Contractor &hall pay all royalties and lioonso fees. He shall defend all suite or claims for infringement of -any patent rights and &hall save the-Owner harmless from loss on ac- count thereof. except that the Owner shall be responsible for all such loss when a partioular process or the produot of a particular manufaoturer or manufacturers is, specified. but if the Contractor has information that the prooess or artiole speoified is an infringement of a patent he shall be responsible for suoh lose unless he promptly gives suoh information to the Arohiteot..or Owner. Art, 11. Surveys. Fermite..and- Regulations.« -The Owner &hall furnish all surveys unless otherwise speoified. Permite,and licenses of a temporary nature necessary for the proaeoution of the work shall be eeoured and paid for by the Contractor. Permits, licenses and easements for permanent struotures or permanent ohangee in existing faoilities shall be secured and paid for by the Owner, unless otherwise specified. The Contractor shall give all notices and oomply with all laws, ordinances, rules and regulations bearing on the conduct of the work as drawn and specified. If the Contractor observes that the drawings and speoifioat /one are at verianoe therewith, he shall promptly notify the Arohiteot in writing, and any necessary ohangea shall be adjusted as pro- vided in the Contract for changes in the work. If the Contractor performs any work knowing it to be contrary to such laws, ordinanoes, rules and regulations, and without such notice to the Arohiteot. he shall bear all costs arising therefrom. Vt. 1?. Proteotion of Work and yToperty.- -The Contractor shall oontin- couslyrosintaln adequate protection 01' all hie work.from_demage and shall proteot the Owner's property from injury or lose arising in oonneotion with this Contraot. He shall make good any suoh damage, injury or lose, except such as may be directly due to errors in the Contraot Doouments or paused by agents or employees of the Owner. He shall adequately protect adjacent property as provided by law and the Contraot Documents. The Contraotor ahall take all necessary precautions for the safety of employees on the work, and shall comply with all applioable provisions e° Federal, State, and Munioipal safety laws and building oodes to pre- vont aooidente.or injury to persona on, about or adjacent to the promises were the work is being performed. Art. 14. luterintendenGSI' 4yervision. -.The Contractor shall keop on hf.s work, during its progress, a oompetent superintendent and any neueseary assistants. all aatiefaotory to the Arohiteot. The superintendent shall not be changed except -with the oonsent.of the Arohiteot, unless the su2er. intendent proves to be unsatisfactory to the Contractor and °eases to be in • his employ. The superintendent shall represent the Contractor in his ab- sence and all directions given to him shall be as binding as if given to the Contractor. Important dirsotions shall to eonfimed in writing to the Contractor. Other directions shall be so confirmed en written request in each case. The Contraotor shall give efficient supervision to the work, using his beet skill and attention. He shall carefully study and compare all . drawings, speoifioationa and other instructions and shall at enos report to the Arohiteot any error, inoonsistenoy or omission which he may discover, but he shell not be held responsible for their existence or discovery. The value of any suoh extra work or ohange shall be determiaed in one or norm of the following wayas (a) By estimate and aooeptanoe in a lump sum. (b) By unit prioea named in the oontraot or subsequently agreed upon. (o) By coat and percentage or by ooat and a fixed foe. If none of the above methods is agreed upon. the Contraotor, pro- vided he reoeiven an order as above, shall proceed with the work. In suoh oase and also under case (o), he shall keep and present in suoh form as the Arohiteot may direct, a oorreot a000unt of the ooat, together with vouohere. In any oase, the Arohiteot shall certify to the amounts inoluding reasonable allowance for overhead and profit, due to the Contractor. Pending final determination of value, payments on amount of ohanges ehall be made on the Arohiteot's oertificate. Should oonditions encountered below the surface of the ground be at varianoe with the oonditions indioated by the drawings and speoifications the oontraot sum shall be equitably adjusted upon olaim by either party made within a reasonable time after the first observanne of the oonditions. . 18. Claims for Extra Cost% If the Contractor claims that any inetruo- tions by drawings or otherwise• involve extra post under this oontraot, ho shell give the Arohiteot written notioe thereof within a reasonable time after the receipt-of euoh.indtruetiona. ancLin any went before prooeeding to execute the work. except in emergency endangering life or property, and the :precedere shall then be sa provided for changes in the mork.- No suoh claim shall be valid unless so made. Art. 17. Deduction for Unoorreoted «orjc. - -If the Architect and Owner deem it inexpedient to oorreot work injured or done not in a000rdanee with the Contraot, an equitable deduo #ion from the oontraot price shall be made therefor, .Art, 18 DelaPs and Ext nsion of Time„ - -If the Contractor be delayed at any time in the progress of the work by any aot or neglect of the Owner or the Arohiteot, or of any employee of either, or by any separate Con- tractor employed by the Owner, or by changes ordered in the work, or ty strikes, lookouts, fire, unusual delay in transportation, unavoidable casualties or any causes beyond the Contractor's control, or by delay aut.'zorized by the Arohiteot pending arbitration, or by any cause which the Aro0.teot shall deoida to justify the delay, then the time of completion shall be extended for suoh reasonable time as the Arohiteot may decide. No such extension shall be made for delay 000urring more than seven . days before olaim therefor is made in writing to the Arohiteot. In the oase of a oontinuing oause Of delay, only one olaim is necessary. If no sohedule or agreement stating the dates upon which drawings shall be furnished is made, then no claim for delay shall be allowed on General Conditions. Fifth Edition. Wootton of WorlidWore Ping,j'avm .. -The Contraotor shall promptly remove from the premises all materials oendned by the Arohiteot ae failing to conform to the Contract, whether inoorporated in the work or not, and the Contractor shall promptly replaoe and re- execute his own work in a000rdanoe with the Oontraot and without expense to the Owner and shall bear the expend. of making good all work of other oontraotora destroyed or damaged by suoh removal or replaoement. If the Contraotor does not remove auoh condemned work and materials within a reasonable time, fixed by written notioe, the Owner may remove them and may store the material at the expense of the Contraotor; If the Contractor does not pay the expensee of such removal within ten days' time thereafter. the Owner may, upon ten days' written notice, sell auoh materials at auction or at private sale and shall a000unt for the net pro - oeeds thereof, after deducting all the costs and expenses that should have been borne by the Contractor. Art. O. Correotion of Worker After Fipal Payment. -- Neither the final oerti- fieata nor payment nor any provision in the Contraot Documents shall re- lieve the Contractor of responsibility for faulty materiala or workmanship and, unless otherwise specified, he shall remedy any defects due thereto and pay for any damage to other work resulting therefrom, whioh ahallappear within a period of one year from the date of substantial completion. The Owner shall give notice of observed defects with reasonable promptness. All questions arising under this artiole shall be deoided by the Arohi- teot subject to arbitration. Art. )1. Damaaest - -If either party to this Contract should suffer damage in any manner because of any wrongful act or neglect of the other party or of anyone employed by him, then he shall be reimbursed by the other party for such damage. If any lien remain unsatisfied after all payments are made, the Contractor shall refund to the Owner all moneys that the latter may be compelled to pay in discharging such a lien. inoluding all costs and a reasonable attorney's fee. Suboontraots.. -The Contraotor shall, as soon as praotioable after the exeoution of the oontreat. notify the Architect in writing of the names of subeentraotora proposed for the prinoipal parts of the work and for suoh others as the Architect may direct and shall not employ any that the Architeot may within a reasonable time object to as incompetent er unfit. If the Contraotor has submitted before exeoution of the contract a list of suboontraotore. and the ohange of any name on suoh list is required General Conditions. Fifth Edition.
