That the for and City Controller of the City of Carpus Christi, Texas, be, and they are hereby, authorized and directed to execute for and on behalf of said city, a lease agreement by and between the City of Corpus Christi as Lessor, and Mastoa Nixon, Lon C. Fill, Robert T. Wilson, Meredith ¢seen, Herbert S. Lowrey, George H. Jones, Leslie Wolford, Sam Braslau, and Aubrey Daly, Trustees, as Lessee; a copy of dlich said lease agreement is attached hereto and made a part hereof and reads as follows, to —t: I78'1 GROUND LBA_ STATE OF TEXAS , COUNTY OF NUECES This indenture, Made this the 4th day of April, 1945, by and between the City of Corpus Christi, a smnleipal corporation of the State of Texas, here- inafter called CITY, and kaston Nixon, Lon C. Hill, Robert T. Willson, ueredith 'usen, Herbert S. Lowery, George H. Xones, Leslie Aolrord, Sam Braslau, and Aubrey Daly, TRUSTEES for and in behalf of the local American Legion Ernest Gregg Post NC. 81 and Business and Professional Men's Post No. 248, hereinafter called TRUSTEES WITNESSETH: I. That the CITY for and in consideration of ONE DOLLAR and for the purposes, uses, covenants and agreemshts to be paid, made, kept and performed by the TRUSTEES. as herein as% out, ham demised and leased and by these presents does demise and lease unto the above named TRUSTEES and their oucoessors in trust, all that certain lot or parcel of land lying and being in the City of Corpus Christi, Nuec's County, Texas, described as follows: BEING a tract of land lying along the north end of Sherrill Park, bounded on the seat by the t;ast Drive of Shoreline Blvd„ on the east by the Nest Drive of Shoreline Blvd., and on the north by Cooper's Alley, and more particular. ly described as follows, BEGINNING at a point to the original centerline of Water Street, said point of beginning being )0.06 fast north of the interesetion of the centerline of Water Street and the north property line of Lot 7, Water Block 2, Central Wharf A Ware- house Addition to the City of Corpus Christi, Teaa; THENCE S. 76000'00" E. a distance of 444.13 feet with a line that Ss 30 fast north of and parallel to the north property line of Lot 7, 'hater Block 2, Central Wharf and Ware- house Co. Addition, to a point in maid line; THENCE S- 17029'30^ W. a distance of 40.02 feet to A Point, which is the northwest Corner of the tract hereby con - voyed; THENCE in an easterly direction a distance of 62.73 feet with a curve to the left having a radius of 262.96 feet,to the P. T. of said curve; THENCE N. 84048'20' E, a distance of 37.63 feet to the P. C. of a curve to the right having A radius of 141.12 feet; -1. THENCE in an easterly direction with a curve to the right having a radius of 147.12 feet a distance of 5E.71 feet to the P. TO HAVE 4140 TO HOLD the demised promises with appurtenances unto the said TRUSTEES and their successors in trust, from the 4th day of April, 1945, for and during and unto the and of the full tam of five (5) years next ensuing. II. It I$ understood and agreed that the TRUSTEES herein are acting under a Trust Agreement executed by the two above named lawrican Legion Posts, wherein they are duly authorized to obtain this lease from the viii for the purposes of creating thereon a substantial and suitable building to be maintained and used solely for the benefit and in the interest of returning service personnel, and to be known as the American Legion Placement Centers and in which building suitable office facilities will be provided without rental charge for the Director of Veteran's Service and his staff, whose salaries are paid by Clty and idascoa County; and business and professional man serving without compensation from time to time in interviewing and advising the service personnel and sasieting in re- establishing them in their Former jobs or businesses commensurate with business developments and promotions therein or in getting them placea in work or businesses in which they are interested and for which qualified. III. That the IRUSTEIS have submitted to the CITY a blue print of the building they propose to erect on the lot heroin leased, which blue print and specifications have been checked and approved by the Planning and Zoning Bard of the City. IV. This lease is given by the CITY with the understanding that the TRUSTEES will erect on the leased lot a building, substantially of the kind and -8. character as shorn in the blue print and specifications submitted to the CITY and approved by Its Zoning board{ and used for the purposes as above set out, said building to be Greeted in accordance with all City Ordinances in regard to the mama, and said building shall be operated during the period of this lease in accordance with all City Ordinances. 9. It 12 further agreed between the parties hereto that TRUST5:ES may remove the building and other improvements on the lot at any time during the five -year period of this lease and Jr. such event, upon their ceasing to use, the lot for the purposes herein leaned, this less* shall terminate and be of no further force and effect. Upon written notice from CITY at expiration of five - year lease period, TRUSTEES mall within sixty (60) days following the expiration of the lease remove from said leased premises the building and improvements then situated thereon, leaving the ground so far as practical in as good a condition as before removal. IN WITNESS WHEREOF, the CITY of CORPUS CHRISTI has caused this lease to be signed with its corporate nam by its Mayor, who in thereto duly authorized, and the TRUSTELS aforesaid have thereto duly authorised their B• rd Chairman, aaeton Nixon, to execute this lease contract for and in their behalf. The fact that there are many men being discharged from the armed services of the United States who reside in the City of Corpus Christi and the territory adjacent thereto who are =' need of the services to be provided by the American Legion Placement Center, and that it is necessary for the welfare of the inhabitants of the City of Corpus Christi that such American Legion Placement Center be immediately established to aid such returned service personnel and assist them in rwstablishing themselves in their former positions or businesses, and to aid them in readjusting themselves to their changed conditions, create a public emergency sad imperative public necessity requiring the suspension of the Charter rule or requirement that no Ordinance or Resolution shall be passed finally on the date it is introduced, and that such Ordinance or Regp lution shall be read at three several meetings of the City Council, and the Mayor having declared, in writing, that such public emergency and imperative necessity exist and having requested that such Charter rule be suspended, and that this Ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS, ACCORDINGLY, SC C•RDAIW-M. D., 194; TO THE hd WER5 OF THE CITY COUNCIL OF THE CITY OF CORPUS Ci-RLM Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and an imperative necessity exist fcr the suspension of the ;:-carter rule or requirement that no Ordinance or Resolution shell be passed finally on the date it is introduced and that such Ordinance or Resolution shall be read at three several meetings of the City Council, I, therefore, hereby request that you suspend said Charter rule or requirement and teas this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
