'AMEBAS, notice of the closing of that portion of Topeka Street, Corpus Christi, Texas, lying and being situated between Harrison and Chamberlain Streets, Corpus Christi, has been given by publication and by mail to the last known address of all owners abutting upon said portion of Topeka Street and within our hundred fifty feet (450 ) thereof, and thereafter, pursuant to said notice, to-wit: On the 9th day of April, 1945, a public hearing was held by the City Council of the City of Corpus Christi, Texas, in accordance with the provisions of Section 6, Article 2, of the City Charter of the City of Corpus Christi, Texas; and WHEEAS, it has been duly determined by the City Council after such public hearing that the hereinafter described portion of Topeka Street should be closed upon the performance of the oonditions hereinafter • set out, and that it will be advantageous to the public to have such portion of Topeka Street closed, and that no owners of property adjacent to said portion have appeared to sake objections to such closing. NCB, THEREFORE, BE IT ORDAINED BY TEE. CITY COUNCIL CF THE CITY OF CORPUS CHRISTI, IMAS: SECTION 1e That the following described portion of Topeka Street in the City of Corpus Christi, Texas., lying and being situated be- tween garrison and Chamberlain Streets in said City, after the performance of the hereinafter prescribed conditions, be closed to publio use, to -nit: That portion of Topeka Street lying and being situated between Blocks 809 and 709, Port Aransas Cliffs Addition, Corpus Christi, Texas, batmen Harrison. and Chamberlain Streets, and described by metes and bounds as follows: BEING a rectangular tract of land 70 feet in width and 760 feet in length and more particularly described as follows: BEGINNING at a point in the west boundary line of Topeka Street, said point of begiroieg bears north _31 06' west 20 feet from the southeast corner of Block 809, Port Aransas Cliffs; TBENCE, north 31006' west with the west boundary line of Topeka Street a distance of 760 feet to a point in the west boundary line of Topeka Street, said point being south 31006' at , a distance of 20 feet, from the northeast corner of said Block 809, Fort Aransas Cliffs; 08520E, north 58054' east a distance of 70 feet crossing Topeka Street to a point in the east boundary line of Topeka Street, said point bears south 31 °06' east 20 feet from the northwest corner of Block 709, Fort Aransas Cliffs; THENCE, south 31006' east a distance of 760 feet with the east boundary line of Topeka Street to a point in said lino, said point bears north 31006, west 20 feet from the scutinsest corner of Block 709, Port Aransas Cliffs; THENCE, south 58054 west a distance of 70 feet crossing Topeka Street to the place of beginning SECTION 2. That the above portion of Topeka Street be, and the sane is hereby, oancelled and that the portion thereof so cancel], d be returned to the abutting property owners entitled to the same. SECTION 3. That the Sisters of the Incarnate Word and Blessed Sacrament, whose corporate title is "Convent Academy of the Incarnate Word of Corpus Christi, Texas ", as owner cg said abutting property is authorized to file an instrument in writing with the clerk of the County Court of Nueces County, Texas, for recording in the Deed Records of said county, cancelling the above described portion of Topeka Street, which said instrument shall incorporate therein a certified copy of this ordinance. SECTION 14. That such closing of said portion of Topeka Street ie conditioned upon the performance of the hereinafter prescribed con- ditions and shall not be effective until said conditions are fully per- formed, and after the said performance of said conditions said portion of Topeka Street shall be closed as hereitbe£ ore provided. Said conditions being as follows, to-mite - 2 - (a) That the Sisters of the Incarnate Word and Blessed Sacrament, whose corporate title is "Convent Academy of the Incarnate Word cf Corpus Christi, Texas ", joined therein by the Most Reverend Emmanuel B. Ldevina, as Bishop of the Roman Catholic Diocese of Corpus Christi, Texas, shall execute and deliver to the City of Corpus Christi, Texas, proper instruments, said instruments to be subject to the soprov- al of the C;grldmsylif0eoity of Corpus Christi, conveying to said City the following described tracts of lead for all street and utility purposes, to „its (1) A tract of land for the widening of Chaorberlein Street in Block 809, Port Aransas Cliffs, Corpus Christi, Texas: BEING a treat of lend 250 feet in length and 20 feet in width and consisting of the south 20 feet of Lots 1 and 64, Blook 809, Port Aransas Cliffs, and sore particularly described as follows: BEGINNING at the southwest corner of Block 809, Port Aransas Cliffs, Corpus Christi, Texas; THENCE, north 310060 west 20 feet with the southwest pro- perty line of Lot 64, Block 809, Port Aransas Cliffs, to a point for corner in said property line; THENCE, north 58 °54' east a distance of 250 feet with a line that is 20 feet northwest of and parallel to the southeast property line of Lota 1 and 64, Block 809, Port Aransas Cliffs, to a point for a corner in the northeast property line of Lot 1, Block 809, Port Aransas Cliffs; THENCE, south 31 °06' east a distance of 20 feet with the north- east property line of Lot 1, Block 809 Port Aransas Cliffs, to the southeast corner of said Lot 1; THENCE, south 58 °54' west a distance of 250 feet with the south- east property line of Lots 1 and 64, Block 809, Port Aransas Cliffs, to the place of beginning. (2) A tract of land for the widerie1 of Harrison Street in Block 809, Port Aransas Cliffs, Corpus Christi, Texas; BEING a strip of land 20 feet in width and 250 feet in length and being the northwest 20 feet of Lots 32 and 33, Block 809, Port Aransas Cliffs, and more particularly described es follows, BEGINNING at the northwest corner of Lot 33, Block 809, Port Aransas Cliffs; THENCE, north 58 °54' east a distance of 250 feet with the northwest property lino of Lots 33 and 32, Block 809, Port Aransas Cliffs, to the northeast corner of said Lot 32, Block 809; THENCE, south 31 °06' east a distance of 20 feet with the north- east property line of Lot 32, Block 809, to a point in the said lire for a corner; THENCE, south 58 °54' west a distance of 250 feet with a line that is 20 feet southeast of and parallel to the northwest property line of Lots 32 and 33, Block 809, Port Aransas Cliffs, to the place of beginning. - 3 A tract of land for the widening of (3) Chamberlain and for Harrison. and :. That said portion of Topeka Street hereinabove described shall be closed upon the execution and.. delivery of the instruments desoribed in Section Y hereof, SECTION 6. The fact that public convenience and necessity will be better served by the closing of the above described portion. of Topeka Street and that such closing will materially reduce the traffic hazards in the south portion of Carpus Christi creates a public emer- gency sad imperative public necessity requiring the suspension of the Charter rule or requirement that no Ordinance or Resolution shall be jaassed finally on the date it is introduced, and that such Ordinance or Resolution shall be read at three several meetings of the City Council, and the Mayor having declared in writing that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this Ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS, ACCORDINGLY, SO ORDAINED.
