CLOSING A PART OF BLOCKS NUMBERED TWENTY-ONE
(21), ONE HUNDRED TWENTY -014E (121) AND TWO HUNDRED
TWENTY -ONE (221) AND ALL OF BLOCKS NUMBERED ONE
HUNDRED TWENTY -TWO (122) AND TWO HUNDRED TffZNTY-
TWO (222), WITH INTERVENING STREETS, DRIVES AND
AVENUES, AS THE CASE MAY BE, WITHIN AND PARTLY
OUTSIDE OF THE DESCRIBED BOUNDARY LINES OF A CER-
TAIN 13.93 ACRE TRACT IN ORIGINAL PORT ARANSAS
CLIFFS, AND ORIGINAL SEASIDE CAMP MEETING GROUNDS
SUBDIVISION, NUECES COMM, TEXAS, IN THE CITY OF
CORPUS CHRISTI, TEXAS, AND DECLARING AN EMERGENCY.
WHEREAS, notice of the closing of a part of Blocks
Numbered Twenty -one (21), One Hundred Twenty -one (121), and Two
Hundred Twenty -one (221) and all of Blocks Numbered One Hundred
Twenty -two (122) and Two Hundred Twenty -two (222), with inter-
vening streets, drives and avenues, as the case may be, embraced
within and partly outside of that certain 13.93 acre tract In the
original Port Aransas Cliffs and the original Seaside Camp Mssting
Grounds Subdivision, Nueces County, Texas, in the City of Corpus
Christi, Texas, hereinafter described, has been given by publica-
tion and by mail to the last known address of all owners abutting
said described property and within four hundred fifty feet (450+)
thereof, and thereafter, pursuant to said notice, to -wit; On the
9th day of April, 1945, a public hearing was held by the City
Council of the City of Corpus Christi, Texas, in accordance with
the provisions of Section 6, Article 2, of the City Charter of the
City of Corpus Christi, Texas; and
WAS, it has been duly determined by the City Council
after such public hearing, that the hereinafter described streets,
blocks and portions thereof are closed, and that the same have
been closed for many years, and that certain hereinafter described
streets have never been used as a thoroughfare by the general public
and that certain streets have never been graded, and that the
owners of the property abutting and immediately adjacent to said
portions thereof are willing to have the hereinafter described
blocks and streets closed and favor the closing of the same, and

that it will be to the advantage of the City of Corpus Christi
to have said blocks and streets closed.
NOW, THEREFORE, B& IT ORDERED BY TSF CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEIAS.
SECTION 1; That the following described blocks, streets
and portions thereof embraced within and partly outside of the
boundary lines of a certain 13.93 sore tract in original Port
Aransas Cliffs and original Seaside Camp Meeting Grounds Subdivision,
Nueoes County, Texas, as now owned and possessed this date by the
Guaranty Title and Trust Company, Trustee, be closed to public use,
to -wit; 9 /
%4 All the portion of Blocks Numbered Twenty -one (21) , One
Hundred Twenty -one (121) and Two Hundred Twenty -one (221);
All of Blocks Numbered One Hundred Twenty -two (122) and
Two Hundred Twenty -two (222), of said Port Aransas Cliffs Subdivision;
All that unclosed portion of Aransas Avenue remaining at the
south end of Aransas Avenue running between the uncancelled portion
of Block Numbered One Hundred Twenty -one (121) and Lots Numbered
One (1) to Eight (8), and a portion of Lot Numbered Nine (9) of
Block Numbered Two Hundred Twenty -one (221) of the Port Aransas
Cliffs Subdivision which extends to the boundary line of that lot
or tract of land conveyed to Joha-R. Thomas on January 13, 1938,
by the Guaranty Title and Trust Company, Trustee, by deed recorded
in Volume 235 at page 556, Deed Records of Nueoes County, Texas,
and between Blocks Numbered one Hundred Twenty -two (122) and Two
Hundred Twenty -two (222) of the Port Aransas cliffs Subdivision,
connecting with Tod Street and the unnamed street or avenue touch-
ing original Blocks Numbered Twenty -seven (27) and Twenty -eight
(28) of the original Seaside Camp Meeting Grounds;
All of Tod Street running east of Septa Fe Street and abut-
ting Blocks Numbered Twenty -one (21), One Hundred Twenty -one (121),
One Hundred Twenty -two (122), Two Hundred Twenty -one (221) spa Two
Hundred Twenty -two (222) of the Port Aransas Cliffs Subdivision;
All of that space within a designated unnamed street or
avenue running in a northeasterly direction from Santa Fe Street
to Ocean Drive abutting Blocks Numbered Twenty -one (21), One Hundred
Twenty -two (122) and Two Hundred Twenty -two (222) Of the Port Aransas
Cliffs Subdivision and abutting the north side of the original Blocks
Numbered Twenty -five (25), Twenty -six (26), Twenty -seven (27), Twenty -
eight (28) and Twenty -nine (29) of the original Seaside Camp Meeting
Ground a;
Approximately 207.5 feet of the remaining south end of
Denver Avenue running between the uncancelled portions of Blocks
Numbered Twenty -one (21) and One Hundred Twenty -one (121) of the
Port Aransas Cliffs Subdivision connecting Tod Street, and the un-
named street adjacent to Block Numbered One Hundred Twenty -two (122),
port Aransas Cliffs Subdivision and touching Block Numbered Twenty -
six (26) of the original Seaside Camp Meeting Grounds;
All that portion of old San Antonio Avenue called Santa Fe
Street lying southwest of and adjoining the said portion of Port
Aransas Cliffs herein described which lies more than eighty (80)
feet, measured at right angles, from the southwest boundary line of
said Santa Fe Street as established by the Highway Engineering Depart-
ment of the County of Nueoes before the area was incorporated in the
City of Corpus Christi and as now laid out and occupied, the intention
being to constitute Santa Fe Street a highway or a street of a uniform
width of eighty (80) feet at this portion of its extent and to vacate
- -and close that small portion lying along its northeast margin, triangular
in shape, which is in excess of eighty (80) feet and which causes the
said Santa Fe Street to have an irregular width greater than the width
preceding and following this portion;
All that part of old Ocean Drive as shown on said map of
port Aransas Cliffs and on map of Seaside Camp Meeting Grounds which
lies northeast of and contiguous to the northeast boundary of the above
described 13.93 acre tract and which is more than forty (40) feet,
measured at right angles or radially, as the case may be, from the
center line of the strip of highway pavement as laid out and constructed
under direction of the Highway Engineering Department of the County of
Nusces and as now existing on said Ocean Drive, the intention being to .
allow for a right of way width of eighty (80) feet for said Ocean Drive,
in the City of Corpus Christi, Texas, and declaring an emergency;
SECTION 2: That the above described portions of said sub-
divisions, the streets, drives, avenues and other public places in the
same be, and the some are hereby cancelled and extended, as the case
may be, and the portion or portions thereof, so cancelled, be returned
to the abutting property owners entitled to the same.
SECTION 3: That the Guaranty Title and Trust Company, Trustee,
as owner of said property is authorized to file an instrument in writing
with the Clerk of the County Court of Nueoes County, Texas, for recording
in the Deed Records of said County, cancelling the above described
streets, blocks and portions thereof.
SECTION 4: The fact that public convenience and necessity
will be better served by the immediate closing of such described portion
of the original port Aransas Cliffs and the original Seaside Camp Meeting
Grounds Subdivisions, creates a public emergency and public imperative
necessity requiring the suspension of the charter rule that no ordinance
or Resolution shall be passed finally on the date it is introduced, and
that such Ordinance or Resolution shall be read at three Several meet-
ings of the City Council and the Mayor having declared that such public
emergency and imperative necessity exist, and having requested that
such charter rule be suspended, and that this Ordinance be passed
finally on the date of its introduction, and take effect and be in
full force and effect from and after its passage. IT IS ACCORDINGLY
ORDAINED.

Gentlemen;
For the reasons set forth in the emergency clause
of the foregoing Ordinance, a public emergency and an imperative
necessity exist for the suspension of the charter rule or require-
ment that no Ordinance or Resolution shall be passed finally on
the date it is introduced, and that such Ordinance or Resolution
shall be read at three several meetings of the City Council; I,
therefore, hereby request that you suspend said charter rule or
requirement and pass this Ordinance finally on the date it is
introduced, or at the present meeting of the City Council.

NOTICE OF HEARI -NG TO VACATE AND CLOSE CERTAIN
BLOCKS AND STREETS IN THE CITY OF CORPUS CHRISTI, TEXAS
WWMAS, a petition has been filed with the City Council of the
City of Corpus Christi, Texas, requesting the vacating and closing
certain streets, blocks and portions of blocks embraced within the
described boundary lines of a certain 13.93 ears tract; the dedication
of certain defined additional space for public use on Ocean Drive and
Santa Fe Street of the Fort Aransas Cliffs, and the original Seaside
Camp Meeting Grounds Subdivisions, as shown by a red penciled outline
upon a blue print copy of said subdivisions now on file with said
petition, reference to such petition and the attached blue print copy
of said subdivisions being here and now made for any and all purposes.
(a) vacating and closing that portion of Blocks Numbered
Twenty -one (21), One Hundred Twenty -one (121) and Two Hundred Twenty -
one (221), as same appears within red pencil lines on attached blue
print; and
(b) Vacating and closing all of Blocks Numbered One Hundred
Twenty -two (122) and Two Hundred Twenty -two (222), of said Fort
Aransas Cliffs Subdivision;
(c) Closing and Vacating that unclosed portion of Aransas
Avenue remaining at the south end of Aransas Avenue running between
the uncancelled portion of Block Numbered One Hundred Twenty -one
(121) and Lots'Numbered One (1) to Eight (8), and a portion of Lot
Numbered Nine (9) of Block Numbered Two Hundred Twenty -one (221)
of the Fort Aransas Cliffs subdivision which extends to the boundary
line of that lot or tract of land conveyed to John R. Thomas on
January 13, 1938, by the Guaranty Title and Trust Company, Trustee,
by deed recorded in volume 235 at page 556, Deed Records of Nueces
County, Texas, and between Blocks Numbered one Hundred Twenty -two

(e) Closing and vacating all of that space within a designated
unnamed street or avenue running in a northeasterly direction from
Santa Fe Street to ocean Drive abutting Blocks Numbered Twenty -one
(21), Gas Hundred Twenty -two (122) and Two Hundred Twenty -two (222)
of the Fort Aransas Cliffs Subdivision and abutting the north side of
the original Blocks Numbered 'Twenty -five (25), Twenty -six (26)
Twenty -seven (27), Twenty -eight (28) and Tweaty -nine (29) of the
original Seaside Camp Meeting Grounds;

(f) Closing and vacating approximately 237.5 feet of the
remaining south end of Denver Avenue running between the unoancelled
portions of Blocks Numbered Twenty -one (21) and one Hundred Twenty -one
(121) of the port Aransas Cliffs Subdivision connecting with Trod
Street, and the unnamed street adjacent to Block Numbered One Hundred
Twenty -two (122) port Aransas Cliffs Subdivision and toua-hing Block.
Numbered Twenty -six (26) of the original Seaside Camp Meeting Grounds;
(g) Vacating and closing that portion of old San Antonio
Avenue called Santa Fe Street lying southwest of and adjoining the
said portion of port Aransas Cliffs herein described which lies more
than eighty (80) feet, measured at right angles, from the southwest
boundary line of said Santa Fe Street as established by the Highway
Engineering Department of the County of Nueces before the area was
incorporated in the City of Corpus Christi and as now laid out and
occupied, the intention being to constitute Santa Fe Street a highway
or street of a uniform width of eighty (80) feet at this portion of
its extent and to vacate and close that small portion lying along its
northeast margin,_ triangular in shape, which is in excess of eighty -
(80) feet and which causes the said Santa Fe Street to have an irregular
width greater than the width preceding and following this portion;
(h) Vacating W closing that part of old Ocean Drive as
shown on said map of port Aransas Cliffs and on map of Seaside Camp
Meeting Grounds which lies northeast of and contiguous to the north-
east boundary of the above described 13.93 acre tract and which is
more than forty (40) feet, measured at right angles or radially, as
the case may be, from the center line of the strip of highway pave-
ment as laid out and constructed under direction of the Highway
Engineering Department of the County of Nueces and as now existing on
said Ocean Drive, the intention being to allow for a right,of way
width of eighty (80) feet for said Ocean Drive.
The dedication by proper instrument of writing a strip of land
out of said above described 13.93 acre tract and out of said Block
Numbered Twenty -nine (29) of the original Seaside Camp Meeting Grounds,
and along the northeast boundary line of Santa Fe Street as shown
on the foregoing plat of said 13.93 acre tract, such as to provide
for said Santa Fe Street a total width of eighty (80) feet, said strip
extending from the northwest boundary line of said Block Numbered
Twenty -nine (29) to the northwest margin of said Aberdeen Avenue and
the northeast boundary line of said strip being located eighty (80)
feet northeasterly, measured at right angles or radially, as the case
may be, from said southwest boundary line of Santa Fe Street as es-
tablished by the Highway Engineering Department of the County of
Nueoes;
Also, a strip of land out of said above described 13.93 acre
tract and out of the northeast portion of said Block Numbered Twenty-
five (25) of the Seaside Camp Meeting Grounds, as shown on the fore-
going plat of said 13.93 acre tract, such as to provide for said Ocean
Drive to have a right of way extending forty (40) feet southwesterly

That Petitioner is the owner of the following described 13.93
acres;
13.93 acres of land out of the Rincon del Oso Grant to Enrique
Villareal. Said survey is situated in Nueoes County, Texas, about
5 miles S. 20° E. from the County Court House and embraces all of
Blocks 25, 26, 27 and 28 and a portion of Block 29, in Seaside Camp
Meeting Grounds, a subdivision shown by map of record in the office
Of the County Clerk of Nueoes County, Texas, in Map Book A at page
47, and all of Block 222 (fractional) and 122 (fractional) and the
southeast portion of Blocks 221, 121 and 21 (fractional), in Port
Aransas Cliffs, a subdivision shown by map of record in the office
of the County Clerk of Nueoes County, Texas, in Map Book A at page
27, together with included and portions of adjoining streets, being
described by metes and bounds, as surveyed, as follows;
Beginning at a 1 -inch iron pipe set flush with the ground in
the curved southwest boundary line of Ocean Drive and northeast boundary
line of Block 21 in said Port Aransas Cliffs, the east corner of Lot
1 in South Shore Place, a subdivision shown by map of record in the
office of the County Cleric of Nueoes County, Texas, in Map Book 6 at
page 20, for the most easterly north corner of this survey, whence
the center point for the circular curve of said southwest boundary
line of Ocean Drive and northeast boundary line of Block 21 hears

Thomas on January 13, 19380 by Guaranty Title and Trust Company, Trustee,
as of record in the Deed Records of Nusoes County, Texas, in Volume
235 at page 556, for the west corner of this survey whence said center
Point for the circular curve bears N.48052105nE. 11$99.20 fast and a
point, the intersection of said curved northeast boundary line of
San Antonio Avenue with the centerline of Miller Street, one of the
streets of said Port Aransas Cliffs, lies northwesterly 625.00 feet,
measured along said curve,-

That Petitioner desires to vacate and close all the blocks and
portion of blocks bmbraced within the above described boundaries and
also close and vacate all the streets and avenues within the confines of
the above described 13.93 acres, in order that said portions may here-
after be referred to as acreage, as well as dedicating certain additional
space to the public for highway use hereinafter described, as more fully
shown by the blue brint of the Port Aransas Oliffs subdivision prepared
by Bluohar Engineering Company, hereto attached and made a part hereof,
which clearly sets out by red pencil outline the changes sought to be
made, to -wit;
(a) Vacating and closing that portion of nlooks numbered twenty-
one (21), One Hundred Twenty -one (121) and Two Hundred Twenty -one (221)
as same appears within red pencil lines on attached blue print; and
(b) Vacating and closing all of blocks Numbered One Hundred
twenty -two (122) and Two Hundred twenty -two (222), of said Port Aransas
Cliffs subdivision;
(a) Closing and vacating that unclosed portion of Aransas Avenue
remaining at the south end of Aransas Avenue running between the unoan-
called portion of Block numbered one hundred twenty -one (121) and Lots
numbered One (1) to Eight (8), and a portion of Lot Numbered Nine (9) of
Block numbered Two Hundred Twenty -one (221) of the Port Aransas Cliffs
subdivision which extends to the boundary line of that lot or treat of
land conveyed to John R. Thomas on January 13, 1938, by the Guaranty
Title and Trust Company, Trustee,by deed recorded in Volume 235 at page

(a) Closing and vacating all of that space within a designated
nnnamad street or avenue running in a northeasterly direction from Santa
Fe Street to Ocean Drive abutting Blocks Numbered Twenty -one (21)0
One Hundred Twenty -two (122) and Two Hundred Twenty -two (222) of the
Port Aransas cliffs Subdivision and abutting the north side of the
Original Blocks Numbered Twenty -five (25). Twenty -six (26),
Twenty -seven (27), Twenty -eight (28) and Twenty -nine (29) of the
Original Seaside Camp Meeting Grounds;
(f) Closing and vacating approximately 237.5 feet of the
remaining south and of Deawer Avenue running between the unoancelled
portions of nlooks Numbered Twenty -one (21) and One Hundred Twenty -one
(121) of the Port Aransas Cliffs Subdivision connecting with Tod
Street, and the unnamed street adjacent to Block Numbered One Hundred
Twenty -two (122) Port Aransas Cliffs subdivision and touching Block
Numbered Twenty -six (26) of the Original Seaside Camp Meeting Grounds;
(g) vacating and closing that portion of old San Antonio
Avenue now called Santa Fe Street lying southwest of and adjoining the
said portion of Port Aransas Cliffs herein described which lies more
than eighty (8) feet, measured at right angles, from the southwest
boundary line of said Santa Fe Street as established by the uighway
Engineering Department of the County of Nueoes before the area was
incorporated in the City of Corpus Christi and as now laid out and
occupied, the intention being to constitute Santa Fe Street a highway
or street of a uniform width of eighty (80) feet at this portion of
its extent and to vacate and aloes that small portion lying along its
northeast margin, triangular in shape, which is in excess of eighty
(80) feet and which causes the said Santa Fe Street to have an
irregular width greater than the width preceding and following this
portion;
(h) Vacating and closing that part of old Ocean Drive as
shown on said map of Port Aransas Cliffs and on map of Seaside Camp
Meeting- Grounds which lies northeast of and contiguous to the north-
east boundary of the above described 13.93 sore treat and which is
more than forty (40) feet, measured at right angles or radially, as
the case may be, from the center line of the strip of highway pavement
as laid and constructed under direction of the Highway Engineering
Depart %f'Vhe County of Nueoes and as now existing on said Ocean Drive,
the intention being to allow for a right of way width of eighty (80)
feet for said Ocean Drive.
Second
As, if and when an order has been duly entered directing the
the vacating and closing of the aforesaid blocks and streets, your
Petitioner alleges that it is its intention and agreement to dedicate
by proper instrument of writing (1) a strip of land out of said above
described 13.93 acre treat and out of said Block numbered twenty -nine
(29) of the original Seaside Camp Meeting Grounda, and along the north-
east boundary line of Santa Fe Street as shown on the foregoing plat of
said 13.93 sores treat, such as to provide for said Santa Fe Street a
total width of eighty (80) feet, said strip extending from the north-
west bOUdiLary line'-of= aeid'Blook numbered twenty -nine (29) to the

northwest margin of said Aberdeen .;venue and the northeast boundary line
of said strip being located eighty (80) feet northeasterly, measured atrigh
angles or radially, as the case may be, from said southwest boundary line of
Santa Fe Street as established by the Highway Engineering Department of
the County of Nueoes; (2) a strip ofland out of said above described
13.93 acre tract and out of the northeast portion of said block numbered
Twenty -five (25) of the Seaside Camp Meeting Grounds, as shown on the
foregoing plat of said 13.93 Sore treat, such as to provide for said
Ocean Drive to have a right of way extending forty (4o) feet southwesterly
from said oenterline of the pavement now existing and in use thereon,
said strip extending from the northwest margin of said Aberdeen Avenue,
northwesterly, to its extremity in the northeast boundary line of said
Block numbered twenty -five (25) and the southwest bouada3* line of
said strip oeing located forty (40) feet southwesterly, measured at
right angles or radially, as the case may be, from said center line of
payment.
THIRD.
petitioner alleges that the aforesaid blocks and streets
sought to be vacated and closed were never opened, never improved,
never maintained and never used except by the scatting owners and the
general purpose of their original dedication having - failed, together
with the sustematio diversion of the land included in such streets and
avenues to uses foreign to said dedication furnish unmistakable evidence
of their abandonment and because of such open and visible sots not to
put such streets and avenues to public use, the dedication of such
streets and blocks has been revoked and the furtherance of the original
purpose and dedication abandoned and the undersigned being the sole and
only abutting owner of such Streets and avenues has become the sole and
only user and owner of such streets and avenues.
w8EREFORE, petitioner prays that notice be given as
provided in Section VI, of Article 2, of the City Charter of Corpus
uhristi, Texas, and that upon hearing duly held by the said uity
Council the above described blocks and portions thereof be ordered
vacated and closed and the streets and avenues which petitioner
