CONIROL DIVISION OF THE CITY OF CORPUS CHRISTI,
TEAS; CREATING THE OFFICE OF DIRECTOR OF SAID
DIVISION AND DEFINING HIS DUTIES AND POWERS;
PR0VIDING FOR CONTRACTS TO BE ME FOP. TEE
CIMfNG OF LOTS; PROVIDING PE11ALTIES FOR THE
VIOLATION HEREOF; AND DECLARING AN EMERGENCY
7MERFds, it is emsential for the health and well -being of
• the inhabitants of the City of Corpua Christi that lots within maid
City shall be free from weeds and rubbish as provided for in Ordinance
No. 1601 of the City of Corpus Christi, Texas; and,
WHEREAS, many of the owners of lots in the city are unable
to obtain the necessary facilities to clean their lots and some of
the owners are non - residents of the city; and,
MEREAS, the creation of a 9Peed and Rubbish Control Division
of the City of Corpus Christi, Texas, will greatly aid in the enforce -
(t went of Ordinance Ho. 1601 and will cause the lots in the City to be
cleaned; therefore,
BE IT ORDAIID;D BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TM -
Section 1. There is hereby created "The Steed and Rubbish
Control Division" of the City of Corpus Christi, Texas, which said'
Division shall be a part of the Department of Public Health and shall
be under the Commissioner of Police, Public Health and Safety of the
City of Corpus Christi. The Weed and Rubbish Control Division is
• hereby created for the purpose of cleaning lots of rubbish and cutting
weeds thereon.
Section 2. There is hereby created the Office of the Director
of the ?Peed and Rubbish Control Division of the City of Corpus Christi,
Texas. The said Director shall be nominated by the Commissioner of
Police, Public Health and Safety and shall be appointed by the City
Council. The said Director shall hold office at the will and
pleasure of the City Council and shall receive such compensation as
the City Council v y from time to time provide.

The said director of the Weed and Rubbish Control Division
shell have charge of all weed and rubbish control; shall make in-
spections of premises; shall cause (with the Director of Public
Health) notices to be sent to owners or occupants of promises to
cut weeds, and/or remove rubbish and/or do other things to make
such premises clean and sanitary, he shall havo charge of all
machinery and equipment acquired or used by such control division
in its work and be responsible for its upkeep and proper keeping;
and shall keep a proper record of all equipment, materials and
machinery so acquired or used by such control division; he shall
cause to be prepared proper notices to be sent out, contracts to
be prepared for the furtherance of such work, he shall sign all`
contracts with owners, for the City of Corpus Christi, for the
cleaning of such lots upon such terms as my be determined by
such director and the Commissioner of Police, Public Safety and
Health, which said contract forms shall be approved by the City
Attorney; he shall keep proper records of all notices sent out,
contracts made, money received and any and all transactions in
regard to such Division; he shall make monthly reports to the
Commtissioner of Police, Public Health and Safety of the work_ done
by said Division and shall send a copy of said report to the Mayor
and City Council; he shall make a proper bond, payable to the mayor
of the City of Corpus Christi, Texas, and his successors in Office
in the sum of Five Thousand ($5,000.00) Dollars conditioned that he
will faithfully perform all the duties of his office and pay over
into the General Fund of the City of Corpus Christi, Texas, all
sums of money that may be collected by him as Director of said
control division, which said obligation shall be a continuing one
and shall not be discharged by one recovery on said bond; he shall
promptly notify the city attorneyts office of the failure of any
owner or occupant of premises in the City who shall fail to clean
such promises after notice; he shall, in case an miner fails to
clean the premises, and his control division does such work, keep
a proper record of the tine and labor expended in cleaning said
premises and submit the same to the Mayor and Director of Public
Health in order that the lien provided in Ordinance Ho. 1601 may
be filed and fixed as provided therein.
The said Director shall have such deputies to assist him as
the City Council may deem advisable, such deputies shall hold of-
fice at the will and pleasure of the City Council and receive such
compensation as said Council may fix and determine from time to
time; such deputies shall be bonded as herein provided for the
Director.
Section 3. It shall be the duty of the said Director and /or
his deputies and they shall have the right and power to go on any
premises in the City of Corpus Christi, Texas, for the purpose of
making inspections to ascertain if such premises are free from weeds
and rubbish, and it shall be unlawful for any person to prevent the
said Director and /or his deputies from making much inspections or
to interfere therewith in any manner.
Section 4. all moneys collected by said ]Teed and Rubbish
Control Division shall be paid into the General Rind of the City
of Corpus Christi, Texas.
Section 5. any person who shall violate any part of Section 3
of this Ordinance, shall be deemed guilty of a misdemeanor, and upon
conviction in the Corporation Court, shall be fined in any aum not in
excess of Two H nidred ($200.00) Dollars.
Section 6. The fact that the creation of The Weed and Rubbish
Control Division of the City of Corpus Christi, Texas, vn 11 be.of great
benefit to the citizens of Corpus Christi and'will aid materially in
reducing the dangers now existing to the public health creates a
public emergency and an imperative public necessity requiring the sus-
pension of the Charter rule providing that no Ordinance or Resolution
shall be passed finally on the data it is introduced and that such
Ordinance or Resolution shall be read at three several meetings of
the City Council, and the Mayor having declared that such public
emergency and imperative necessity exist, and having requested that
said Charter rule be suspended and that this Ordinance take effect
mz and be in full force and effect from and after its passage, IT IS,
ACCORDINGLY, SO ORDAINED.

For the reasons set forth in the emergency clause of
the foregoing Ordinance, a public emergency and an imperative
necessity exist for the suspension of the Charter rule or
requirement that no Ordinance or Resclution shall be passed
finally on the data it is introduced, and that such Ordinance
or'Resolution shell be read at three several meetings of
the City Council: I, therefore, hereby request that you
suspend said Charter rule or requirement and pass this Ordi-
nance finally on the date it is introduced, or at the present
meeting of the City Council.
