HomeMy WebLinkAbout01814 ORD - 07/10/1945AN ORDINANCE MAKING IT UNLAWFUL TO MOVE BUILDINGS IN CORPUS CHRISTI WITHOUT A LICENSE; PROVIDING FOR THE ISSUANCE OF A HOUSE MOVER'S LICENSE UPON APPLI- CATICH; PAYMENT OF LICENSE FEE AND ESECUTION AND DELIVERY OF BOND; PROVIDING THAT BEFORE A BUILDING OR STRUCTURE SHALL BE MOVED THAT THE CITY ELECTRICIAN MUST BE OCUSULTID AND A LST- TER OF-APPROVAL ISSUED BY HIM WHICH SAID LET- TER SHALL CONTAIN CERTAIN NECESSARY INFORMA- TICK, .AND TRAP_, APPLICATION SHALL BE MADE TO THE CITY,ENGINEER FOR PffiiMIT TO MOVE SUCH . BTRUCTDHE; PROVIDING FOR ISSUANCE OF PERMITS TO MOVE BUILDING ON APPLICATION AND PAYMENT OF FEES ;. PROVIDING FOR PAYMENT FOR OVERTIMS OF CITY EMPLOYEES AND FOR EXTRA BELP; PRO- VIDING THAT,FAILDRE TO PAY FOR OVERTIME CR FOR.RXTRA HELP SHALL CANCEL ANY LICENSE FOR HOUSE MOVING; PROVIDING FOR MONTHLY REPORTS BY HOUSE MOVERS; PROVIDING FOR TWENTY -FOUR HOUR NOTICE TO BE GIVEN TO CITY ENGINEER AND OTHER PERSONS AND FIRMS BEFORE MOVING A HOUSE, BUILDING OR OTHER STRUCTURE1 PROVIDING THAT BUILDINGS SHALL BE MOVED WITH REASONABLE DISPATCH; PROVIDING POU.CANCELLATION OF LI- CENSE; PROVIDING.PERALTIES FOR VIOLATION HEREOF;. OTHER PARTS; AND DECLARING-AN $MERGENCY,:�„ BE IT MDAIAED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXASt Section 1. That hereafter it shall be unlawful for =7 person, firm, or corporation to mow any house, building, or structure within the corporate limits of the City of Corpus Christi, Texas, without first obtaining and having in effect a valid house mover's license as provided herein and complying with all the conditions of this ordinance. Section 2. AxV person, firm, or corporation, who is engaged in the business of moving houses, buildings, or other structures, in the City of Corpus Christi, or who desires to engage in such business, shall apply to the City Engineer of Corpus Christi, Texas, fora house mavens lioenee and in such application shall state the name and ad- dress of such house moving business, the names and addresses of all persons owning any interest in said house moving business, the equipment of such house moving business and the experience of such house mover or such person in such business and such other information as the City I ?14 Engineer of Corpus Christi, Teas, may doom necessary. If, upon investigation, the City Engineer shall find the person, firm, or corporation engaged in such business, or desiring to engage in such business, is equipped to move houses, buildings, and other structures in a satisfactory manner, the City Engineer "ball issue a house mover 1e license to such person, upon the pay- ment of a house mover's license fee of Ten ($10.00) Dollars and upon the said person, firm, or corporation executing and delivering to the City of Corpus Christi a good and valid bond in the sum of Two Thousand ($2,000.00) Dollars, payable to the City of Corpus Christi and conditioned as follows: "That said person, firm, or corporation shall keep the City harmless from any and all damages by the moving of any house, building, or structure along and upon the streets of said City and "hall repair or pay for all damages to said streets, bridges, or culverts, or damages to other property in said City, and that suoh person, firm, or corporation, shall o=- ply with all the terms of this ordinance and all other ordinances of the City of Corpus Christi, now in force and effect and that may be hereafter duly and legally passed and approved by the City Council of the City of Corpus Christi, Tease." Said bond shall also be con- ditioned that it shall not be discharged by one recovery thereon, but that the obligation is a continuing one. That said person, firm, or corporation may give as surety upon said bond a good and reliable surety company or may give a per- sonal bond with two or more persona u sureties, said bond shall be approved by the Mayor and the City Council of the City of Corpus Christi; that after said application has been made and approved, and said bond executed and delivered, the City Engineer shall issue a house moverts license to such person, firm, or corporation, which said license shall be valid for a period of one year from date of issuance, which said license shall authorize said person, firm, or corporation to engage in the business of moving houses, buildings, or other structures within the corporate limits of the City of Corpus Christi as hereinafter provided. Such license shall not authorize the moving of any buildings un- less other provisions under this ordisanoe are strictly complied with. section 3. town any person, firm, or corporation, holding a valid house mover's license, shall desire to move a y house, building, or other structure within the City of Corpus Christi, such person shall first consult the City Electrician and shall give to the City Elaotri- oian information as to the location of the hones to be moved, the route on which said house is proposed to be talon over the streets of Corpus Christi, and the final location of such building or structure, and if the City Electrioian deems it neoessary, such applicant and the City Eleotrioian shall go over such route. The City Electrician shall there- upon issue a letter addressed to the City Enginsor of the City of Corpus Christi, which said letter shall state his approval or disapproval of the route to be taken, the zu or of signal lights, traffic lights, and fire alarm wires that it will be aeoessary to out, or to move in order that such building or structure may be moved. Such applicant shall take such statement of the City Electrician to the City Engineerts of- fice and there make applioation for permit to move such house, which said application shall state the location of the house, the route to Is taken, and the final location of the structure to be moved, and shall have attached to it the statement of the City Electrician as hereinbefore provided. If the City Engineer approves such application, he shall issue a permit for the moving of such house, building, or other structure upon the applicant paying the following charges: Twenty Five ($25.00) Dollars £or'the first traffic signal light that is to be taken down or removed, and Ten ($10.00) Dollars for each additional traffic signal light; Five ($5.00) Dollars for the first fire alarm wire to be taken down, sad Three ($3.00) Dollars for each additional fire alarm wire. " Section ll. If such moving of such building or structure is done between the hours of BIRD a.m. and 5;00 p-m., there shall be no charge for the services of the City Electrician in taking down the traffic signal lights or fire alarm wires other than the charges above speoi- fied. If it is necessary in the moving of said house, building,.or structure, for the City Electrician or hie helpers-to work after work- ing hours, then much house mover shall pay an additional sum amounting to time and one -half of the regular wages of such electrician or his helpers to the City of Corpus Christi, which said City shall in turn pay said amount to the City Electrician or his helpers. In the event it shall be neoeasary for the City of Corpus Christi to employ addi- tional electricians to aid in removing said signal lights or fire alarm wires, then such house mover shall pap all expenses incurred by the City for such extra men. A11 fees and charges provided in this Ordinance shall be paid to the City Engineering Department, ond-by the City Engineering Department transferred to the City Tax Assessor and Col- lector, upon receiving proper receipt therefor, and the City Engineer- ing Department shall send the statement for such extra help or overtime on the part of city employees to the person, firm, or corporation hold- ing the license to move houses or other buildings in the City of Corpus Christi. Failure of the house mover to pay for such extra men or over- time within tan (10) daps after the receipt of such statament, shall automatically oancel the license of such person, firm, or corporation engaged in the business of house moving in the City of Corpus Christi, Texas, and a letter from the City Engineer to much person, firm, or corporation shall be sufficient to cancel such permit. Section 5. That all persons, firms, or corporations which shall hereafter engage in the business of moving houses, buildings, or struo- tures within the corporate limits of the City of Corpus Christi, shall on or before the 5th day of each month hereafter file with the City Engineer a report, which report shall contain a description of the house, building, or structure moved, the size of the same, the lot and'block, and the addition or part of said City upon which said building is situated before being moved, and the lot, block, addition or part of said City to where the same was moved and the route along whioh said building was moved, naming the streets or alleys or parts of said City over which the some was moved. Section 6. That all persons, firms, or corporations engaged in the moving of houses, buildings, or struotures within the corporate limits of said City shall, before moving the as=, give notice to all persona, firms, or corporations having poles, lines, wires, or other fixtures that may be effected along the routs, over which said house, building, or structure may be moved, which notice shall be given at least twenty four hours before said house, building, or structure shall be moved. That notice shall also be given to the City Engineer of the City of Corpus Christi at least twenty four hours before the moving of any house, building, or structure, and which notice shall contain the name of the streets and alleys or parts of the City, and the description of the parts of said City over which said house, build- ing, or structure is to be moved, and also a description of the location of the culverts or bridges over which such house, building, or structure is to be moved. section 7. That said persons, firms, or corporations engaged in the moving of houses, buildings, or structures in said City shall move the same with reasonable dispatch and without unnecessary delay, and shall not unreasonably or unnecessarily block traffic upon amr streets or alleys of said City. Section 8. Any person, firm, or corporation, who shall have a house mover's license and who fails or refuses to comply with the pro- visions of this ordinance, shall be subject to the penalties herein- after provided and it is further provided that such license shall be cancelled by written notice by the City Engineer to such person, firm, or corporation notifying him or them that said permit had been cancelled, in which written notice shall be not forth the grounds and reasons. Section 9. In addition to the cancellation of the license as hereinbefore provided, any person, firm, or corporation violating any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor and upon conviction thereof in the Corporation Court of the City of Corpus Christi, shall be fined in any awn not less than Five ($5.00) Dollars nor more than Two Hundred ( #200.00) Dollars for each violation thereof. In case the house- moving business which shall violate sup of the provisions of this ordinance, shall be a corporation, then in that event the president, vice president, secretary, treasurer, or any manager, agent, or employer, shall be also severally liable to the penalties herein provided. Section 10. All ordinances and parts of ordinances in conflict herewith are hereby especially repealed. Section 11. That if any part of this ordinance is or should be held invalid or unconstitutional for any reason, then that foot -hall not invalidate the entire ordinance, but the balanoe thereof shall re- main in full force and effect. Section 12. The fact that many houses, buildings, or structures are moved within the corporate limits of the City of Corpus Christi, Texas, and that such persons moving such structures have been securing removal of traffic lights and fire alarm wires without payment to the City of Corpus Christi; and the further fact that there is a need for a regulation of routes to be taken by such house movers, and that the people in the City of Corpus Christi be more adequately protected, creates a public emergency and an imperative public necessity requir- ing the suspension of the Charter rule providing that no Ordinance or Resolution shall be passed finally on the date it is introduced and that such Ordinance or Resolution shall be read at three several meet- ings of the City Council, and the Mayor having declared that such pub- lic emergency and imperative necessity exist, and having requested that said Charter rule be suspended and that this Ordinance take effect and be in full force and effect from and after its passage, IT IS, ACCCRD- INGLY, SO ORDAINED. ``��, PASSED AND APPROVED ON TRIE / �OZ.ftidgy of July A.
