HomeMy WebLinkAbout01817 ORD - 07/17/1945AN ORDINANCE REgUMING ALL EMPLOYEES OF THE CITY OF CORPUS CHRISTI DRAWING CAR OR MOTORCYCLE ALLMNCES AND ALL EMPLOYEES OF SAID CITY USING THEIR OWN AUTOMOBILES OR MOTORCYCLES REGULARLY IN THE CITY'S BUSINESS TO CARRY PUBLIC LIABILITY AND PROPERTY DAMAGE INSURANCE ON SUCH VEHICLE; DE- FINING THE LIMITS OF SAID INSURANCE; PROVIDING THAT CERTIFICATES CERTIFYING THAT SUCH VEHICLES AM INSURED BE FILED WITH THE CITY CONTROLLER; PROVIDING THAT NO EMPLOYEE SUBJECT TO THE TERMS OF THIS ORDINANCE SHALL BE PAID EITHER HIS SAL- ARY OR CAR OR MOTORCYCLE ALLOWCE UN13SS HE SHALL HAVE FILED WITH THE CITY CONTROLLER A VALID CERTI- FICATE OF INSURANCE ON HIS AUTOMOBILE; AVID DE- CLARING AN EMERGENCY, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1. That it is for the beat interests of the City of Corpus Christi, Texas, that all employees drawing oar or motor- cycle allowances from said city and all employees using their own, cars or motorcycles regularly in the cityts business carry public liability and property damage insurance on their said vehicles at all times. SECTION 2. That all employees of the City of Corpus Christi drawing car or motorcycle allowances from the City of Corpus Christi and all employees using their owa automobiles or motorcycles regularly in the business of the City of Corpus Christi, Tdxaa, shall be required to carry public liability and property damage insurance, as hereinafter specified, on their automobiles or motorcycles at all times. By the term "Using their own automobiles or motorcycles regularly in the business of the City of Corpus Christi, Texas" is meant any employee using his or her automobile or motorcycle regularly in the business of the city and who claims on his or her income tax 33 113% or more on the expenses of such car as deductible items because such car is used in the business of the city. SECTION 3. All public liability and property damage insurance shall be carried with an insurance company licensed to do business in the State of Texas, and the mini,mm+ limits of such policy or policies 1917 - 1 - shall be Five Thousand ($5,000.00) Dollars for injury to each person and Ten Thousand ($10,000.00) Dollars for all personal injuries in each aooi- dent and Five Thousand ($5,000.00) Dollars for property Get provided however, if the State Board of Insurance Commissioners shall hereafter adopt a standard policy providing substantially the same protection as hereinbefore required that such standard policy shall be regarded as a compliance with the terms of this ordinance. SECTION 4. 911 employees of the City of Corpus Christi subject to the provisions of this Ordinance shall procure from the company or person issuing to them an insurance policy as required by this Ordinance a certificate, oertifying that such insurance policy has been issued, and such certificate shall state thereon the name of the company issuing the same, the limits of said policy, the time of the expiration of such policy, and that the premium on such insurance has been paid. All employees of the city subject to the provisions of this Ordinance shall forthwith file said certificate with the City Controller. In the event such insurance policy shall be cancelled after issuance, then it shall be the duty of any employee receiving notice of cancellation of such insurance policy to notify the city controller of such oanoells- tion and to procure another insurance policy and deposit a valid oerti.fi- cats with the City Controller in lieu of the certificate on the policy thus cancelled. SECTION 5. The City Controller of the City of Corpus Christi shall not issue any warrant or voucher in payment of the oar or motorcycle allowance of any employee of the City, or any warrant or voucher in payment of the salary of any employee of the City who regularly uses his or her oar in the city's business, unless such employee shall have filed with the City Controller a valid certificate of insurance as herein provided, such certi- ficate showing that the said insurance is in force at the time of the issu- ance of such check or voucher and which has not been cancelled. SECTION 6. It shall be the duty of any employee subject to the terms of this ordinance to notify the City Controller of any sale or exchange of any automobile or motorcycle owned by such person, and so used by him, and - 2 - to immediately procure nee insurance on such automobile or motorcycle that may be acquired as the result of such sale or trade. Failure to so notify the City Controller shall be grounds for dismissal. SECTION %. The fact that the efficiency of the employees of the City of Corpus Christi will be increased and the City of Corpus Christi will be better protected from liability under the provisions of this Ordi- nance creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no Ordinance or Resolution shall be passed Finally on the date it is introduced, and that such Ordinance or Resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this '.Ordinance be passed finally on the date of its introduction, and take effect and be in fill force and effect from and after its passage, IT IS ACCORDINGLY HO ORDAINED.
