LLER OF THE CITY OF CORPUS CHRISTI, TEXAS, TO EXECUTE, FOR AND ON BEHALF OF SAID CITY, A CONTRACT WITH JACK BONNER, SENIOR; AM DECLARM AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TE S; SECTION 1. That the Mayor and City Controller of the City of Corpus Christi, Texas, be, and they are hereby, authorized and direoted to exeoute, for and on behalf of said City, a contract with Jack Bonnor, Senior, a oopy of said contract being made a part hereof, and reading as follows: IgzD 2BE STATE OF TETBS 0 CCCBTf OF 3oECCS This memorandum of agreement made and entered into by and between Jack Bonner, Sr., of the County-of Iusces, State of Texan, and thd.eity of Corpus Christi, Texan, a mmmnioipal corporation, - �THSSSETHs 1. The said Jack Bonner, Sr. hereby sells and agteea to convey to the City of Corpus Christi, Tons, the following described property situated in faeces County. Texas, to -wits All of Lots Three (3), Four (4) and Five (5), Block Two (2), Brennan Addition to the City of Corpus Christi, baecss Comity, Texas, according to a map or plat of said addition on file in the Office of the Comity Clark of $cocas County, Toxea, to which map or plat reference is hers made for more complete description. In addition to the agrameant to convey the said property, the said Jack Bomar, Sr. agrees to pay the additional sum of Fifty (150.00) Dollara cash on execution of and delivery of deed described in paragraph Two (2) hereof. 2. The City of Corpus Christi, Texas, hereby sells and agrees to oonvey to the said Jack Bonner, Sr. the following described property situated In Auaces County, Texas, to -wits All of Lots =oven (11) and Twelve (12) and the South Nine (g) Feet of Lots Thirteen (13) and Fourteen (14), in Block Foss (4) of the Brennan Addition to the City of Corpus Christi, Texas, according to a map or plat of said addition on file in the Office of the Comity Clark of faeces County, Texas, to which said map or plat reference is here made for more com- plete description, 3. Each of the above portion agroes to furnish the other with a policy of title insurance to be issued by the Guaranty Title and Trust Company of Corpus Christi, Texas, in the usual and ccstomary form, which policy shell be issued immediately upon the closing of this deal, and filing of each of tbo�sbove deeds for record. pending the closing of this deal, the opinion of the examining attorneys of said title company showing title to the rs- apeotive properties to be good in the respective grantors, and the company agreement to issue said policy upon closing of the deal and filing of dead, shall be deamed sufficient for closing, and the deal sball be closed thereon, - 1 and the policies lamed thereafter in accordance herewith. The opinion of the examining attorneys of such title company on the respective titles shall be deemad conclusive as to the status of each of then. The parties hereto agree that this contract shall be an order on said title company to issue the respective title policies. 4. In case any objections to title to either of the above pro- portion are raised in maid opinions of the title attorneys, then the party to convoy the said property shall have a reasonable time in whioh to cure paid objections end ahow good title, and secure the final approval of said title by said title company *a attorneys. In the event of failure no to cur* said 4efects, then the party failing to cure maid defects agrees to pay all of the expenses incurred by the other party in having his or its title to its reapootive property examined and this contract, at the option of the other party, be cancelled, or the other party my enforce specific performance hereof. 5, Each party agrees upon approval of said title insurance by said title company's attorneys, and agreement to issue title policy as above not out, to deliver a good and sufficient warranty deed drawn in accordance with the provisions of this contract, properly conveying said above described properties. 6. All taxes to include the year 1944 to be paid on the respective properties by the respective owners thereof and taxes for the current year shall be prorated to date of closing. 7. It in agreed that this deal shall be closed me soon as possible and that possession of the above described properties will be given imms- distehy upon closing of the deal. S. it is understood by the parties hereto that no agent has been concerned in this transaction, and there is no real estate commission due to any person by reason hereof. The fact that the lots to be acquired under the afore- said contract are needed for the drainage program of the City creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no Ordi— ce or Resolution shall be passed finally on the date it is introduced, and that such Ordinance or Resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, and having requested that such Charter rule be suspended, and that this Ordinance be passed finally on the date of its introduction, and take ef- fect immediately and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED. Corpus Christi, Texas 1945 TO THE MEMBERS OF THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI Corpus Christi, Texas Gentlemen: For the reasons set forth in the emergency clause of the foregoing Ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or re- quiremant that no Ordinance or Resolution shall be passed fi- nally on the date it is introduced and that such Ordinance or Resolution shall be read at three several meetings of the City Council, I, therefore, hereby request that you suspend said Charter rule or requirement and pass this Ordinance finally on the date it is introduced, or at the present meeting of the City Council.
