HomeMy WebLinkAbout01823 ORD - 07/24/1945ERK,hrr 7 -16 -45 AN ORDINANCE TO BE AN ORDINANCE ACCEPTING A BOND MADE, EXECUTED AND DELIVERED BY THE CORPUS CHRISTI NATIONAL BANS OF CORPUS CHRISTI, TEXAS, PRINCIPAL, WITH TYPO SURETIES, INDEMNIFYING THE CITY OF CORPUS CHRISTI AGAINST LOSS AND DAMAGES WHICH MAY ACCRUE BY REASON OF THE PAYMENT OF CERTAIN CITY OF CORPUS CHRISTI STATE AID SEAWALL AND BREAKWATER CONSTRUCTIO14 BONDS, WdICH BONDS ARE ALLEGED TO BE LAST, AND DECLARING All EMERGENCY. BE IT ORDAINED BY THE CITY OF CORPUS CHRISTI, TEXAS, SECTION 1. That whereas, it appears that City of Corpus Christi State Aid Seawall and Breakwater Construction Bonds, Series 1923, Nos. 1736, 1737 and 1738, each in the prinoipal sum of Co. Thousand Dollars ($1,000.00), dated April 10, 1923, and interest in the sum of Twenty Five ($25.00) Dollars each, coupons attached,/have been lost and cannot be found, and were held by Corpus Christi National Bank for collection; and, whereas, said Corpus Christi National Bank has tendered a good and sufficient bond indemnifying the City of Corpus Christi against all loss and damages by reason of the payment of said bonds and coupons without the surrender and cancellation thereof, which bond has been approved by the City Attorney: THEREFORE, said bond is in all things accepted and approved by the City Council of the City of Corpus Christi, and the Mayor, Finance Commissioner and City Controller are directed to issue a warrant or warrants payable to Corpus Christi National Bank for the amounts due on said bonds and coupons, payable out of the Interest and Sinking Fund set aside and appropriated for payment of said series of bonds, and the interest thereon. SECTION 2. The fact that said bonds and interest coupons are long past due and that the owners thereof are demanding payment creates a public emergency requiring the suspension of the Charter rule requiring that no ordinance or resolution shall be passed finally on the date it is introduced, except in case of public /sa 5 emergency, and the Mayor having requested the suspension of the rule, same is hereby suspended and this ordinance shall be in force from the date of its passage and approval by the Mayor. Gentlemens For the reasons set forth in the emergency clause of the foregoing Ordinance, a public emergency and an imperative necessity exist for the suspension of the Charter rule or re- quirement that no Ordinance or Resolution shall be passed finally on the date it is introduced and that such Ordinance or Resolution shall be read at three several meetings of the City Council; I, therefore, hereby request that you suspend said Charter rule or requirement and pass this Ordinance finally on the date it is introduced, or at the present meeting of the City Council.
