HomeMy WebLinkAbout01824 ORD - 07/24/1945AN ORDINANCE AMENDING AN CEDIEANCE "REGULATING THE BEEPING OF DOGS WIT= THE CITY LIMITS OF THE CITY OF CORPUS CHRISTI; REQUIRING A LICENSE FOR EACH DOG KEPT WITHIN THE CITY LIMITS AND PROVIDING FEE THEREFOR; PROVIDING FOR CERTAIN EXCEPTIONS, CREATING THE HUMM DEPARTMENT OF THE CITY CF CORPUS CHRISTI, TEXAS; PROVIDING.FCR THE DIS- POSAL OF DOGS; PROVIDING FOR THE SAFEGUARD OF THE PUBLIC BY PROCLAMATICH PROHIBITING DOGS RUNNING AT LARGE DURING PERIOD OF PROCLAMATION; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH, AND CONTAINING A SAVING CLAUSE; FIXING A PEN- ALTY FOR THE VIOLLTICN OF THIS ORDINANCE; AND DECLARING AND EMERGENCY, ". BEING ORDINANCE NO. 1,669, PASSED AND APPROVED BY THE CITY COUNCIL OF THE Cm OF CORPUS CHRISTI ON APRIL 17, 1944, BY MABING CERTAIN ADDITIONS TO SECTION III AND SECTION VI THEREOF, AIM AMENDING SECTION VIII. THEREOF; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS; SECTION 1. That Ordinance No. 1669, passed and approved by the City Council Of the City of Corpus Christi, Texas, on the 17th day of April, 1944, and recorded in Volume 13 on Page 458 of the Ordinance - Resolution Records of the City of Corpus Christi, Taxes, be amended as follows, to -wit: , That Section III of said Ordinance be amended by adding to Section III, at its conclusion, Section III -A, which is as fol- lass, to -sits "Section III -A. All of the doge hereinbe£ ore excepted from the.provisions requiring license in Section III shall be in- occulated against rabies, except doge under the age of three (3) months, and it shall be unlawful for anV person to own, keep in his or her possession, or be concerned in keeping any dog mentioned in the exceptions in Section III other than a dog under the age of three (3) months, unless said dog•has been vaccinated against rabies; and any person owning or keeping in his or her possession, or who is concerned in keeping said dog, shall have in his or her possession a certificate from a person licensed to practice veterinary medicine, stating that said dog has been inoculated against rabies within a period of one (1) year." — - 1 - That Section VI of said Ordinance be amended to read here- after as Follows, to -Wit: `VI. Illegal Keeping of Doge and Impounding of Dogs. (a) It shall be unlawful for =7 person in the City of Corpus Christi to own, claim, keep or have in their possession any dog under the following conditions or circumstances, to -wit: (1) Any dog over the age of three (3) months without first having had said dog inoou- lated against rabies. (2) Any dog over the age of throe (3) months and under the age of six (6) months that does not have affixed to his collar on .aid dog a metal tag certifying that said dog has been inoculated against rabies, and such person awning, claiming, or keep- ing said dog shall have in his or her pos- session a certificate from a person, li- ceased to practice veterinary medioins in Texas, stating that such dog has been in- _ ovulated against rabies. tag (3) AV dog with a metal/on hie collar show- ing said dog to have been inoculated against rabies unless said dog has in feet been inoculated against rabies. (4) bW dog six (6) months of age or over which has not been inoculated against rabies after reaching the age of six (6) months, and is not licensed ae provided in Section III of this Ordinance. (5) Any dog six (6) months of age or over that does not have affixed to its collar or har- ness the license tag provided for in this Ordinance. (b) It shall be the duty of the Superintendent of the Humane Department and any police officers or humane officers to take up and - 2 - take charge of wry and all dogs not wearing a license tag properly obtained under the provisions of this Ordinance, and all doge found at large in violation of Section II of this Ordinance, and all dogs over the age of three (3) months and under the age of (6) months taut are not inoculated against rabies, as provided herein, and to take maid dogs to the City Pound or other suitmW] place, there to be impounded and detained for a period of three (3) calendar days. (o) It shall be unlawful for any person to conceal, hide, or secrete any dog kept in violation of this Ordinance. (d) It shall be unlawful for any person to interfere with or prevent in any manner the Superintendent of the ]inane Depart- ment, or any police officer or any humane officer in taking up a dog as hereinbefore provided, and any person so interfering or pre - vanting skull be deemed guilty of as offense of a breach of the peace." That Section VIII of said Ordinance be amended to read hereafter as follows, to -wits "VIII. (a) livery animal that has rabies or symptoms thereof, or any animal that bites, scratches, or otherwise attacks ary person within the City, shall be impounded and hold for a period of twelve (12) days in the City Dog Pound or in any veterinary hospital desig- nated by the Director, Corpus Christi- Nueoes County Health Unit, and under the supervision of said Director. If in the opinion of the Superintendent of the Humane De- partment and the Director of the City - County Health Unit, the person owning any such animal described in the preceding paragraph, will keep said dog aefely tied up and confined, they, at their mole and only option, may permit the owner to keep said dog in hie possession upon the owner executing an agreement that he will keep the dog con- fined for twelve (12) daps and under constant supervision and will have the animal examined by a veterinarian at his own expense on the date of the execution of said agreement, which said examination shall reveal such animal to be without such visible symptoms of rabies and agrees to have the animal re- examined by a vaterinarian on the sixth and twelfth day during Bush observation period, and such person fur- ther agreeing that if said dog shows any abnormal signs that he will immediately notify the veterinarian of the City Humane Department. In the event that any person makes such an agreement with the IDmane Department and fails to carry out the provisions of such an agreement, he shall be deemed guilty of a violation of this Ordi- name. (b) In case an animal, which is an animal suspected of hav- ing rabies, is impounded in the City Pound for said period of twelve (12) days, the owner of said dog shall pay to the Humane Department a fee of Five ($5.00) Dollars to defray the expense of such impounding of such animal for observation. (o) Any animal that has rabies or that is exhibiting symptoms of having rabies shall not be allowed, at any time, on the streets or public ways of the City until said animal is released from observation by the Veterinarian of the Corpus Christ- Huecea County Health Unit. (d) Every animal that has been exposed to rabies shall be confined at once in the City Dog Pound or some veterinary hospital designated by the Health Unit Director and kept there under the super- vision of said Health Unit Director for such period of time as he may deem neoessary, and the owner of said dog shall pay to the Humane De- partment a reasonable amount to defray the expense of keeping said animal it it shall be oonfined in the City Dog Pound. (e) The owner, keeper or persons in charge of any animal that hag rabies, or that has been exposed to rabies, or that has symptoms thereof or that ban bitten, scratched or otherwise attacked any person within the City, shall, on demand, turn over said animal to the Health Unit Director or to his deputy. (f) It is further provided that if any person shall request the Superintendent of the Humane Department to ship the head of any animal that has died, which said animal is suspected of having rabies, to a laboratory for the purpose of examining said hand and determining - 4 - whether or not same said animal had rabies, such person making such de- mand shall pay to the H®ane Department the sum of Two and 50100 ($2.50) Dollars for each head to defray the expenses of obtaining a container for said head and peaking and shipping the same. (g) The body of any eaimal that has died of rabies shall not be disposed of except as directed by the Health Unit Director. (h) It is further provided that in the event the owner of :slid dog shall fail to pay the fees and expenses provided herein that auah dog shall be disposed of as provided in Section 4I of this Ordinance providing for the sale of unredeemed dogs and disposal of dogs not redeemed or purchased." SECTION 2. The fact that this amended Ordinance is necessary for the public welfare of the citizens of the City of Corpus Christi, Texas, and that the existing Ordinance is considered incomplete and will, by this amendment, become more effective and practical, and that the prompt and proper enforcement of the same is naceasary to protect the public health o£ the citizens of the City of Corpus Christi, creates a public emergency and imperative public necessity requiring the suspension of the Charter rule providing that no Ordinance or Resolution shall be passed finally on the data it is introduced, and that such Ordinance or Resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such public emergency and imperative necessity exist, and having requested that said Charter rule be sus- pended, and that this Ordinance take effect, and be in full force and offset, from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
