HomeMy WebLinkAbout01825 ORD - 07/24/1945AA ORDDNANCE PRGM32iG THAT ALL PASSENGER ELEVATOR CABS IN THE CITY -OF CORPUS CHRISTI SHALL BE EN- CLOSED AND EQUIPPED WITH A DOOR OR SAFETY GATE; MAKING IT UNLAWFUL FOR ANY PERSCN TO PDT IN MOTICN OR NEW IN MOTION A PASSENGER ELEVATOR CAR UNLESS THE DOOR OR SAFETY GATE OF SAME IS CLOSED; PROVIDING IT SHALL BE THE DUTY OF MANAGERS OR SUPERINTENDENTS OF HOTELS AND BUILDINGS TO SEE THAT THE SAFETY DOOR OR GATE OF PASSENGER ELEVATOR CARS, IN THE BUILDINGS OR HOTELS OR= THEIR CONTROL, ARE CLOSED AT ALL TIMES WHILE THE SAID PASS- ENGER ELEVATOR CAR IS IN MOTIONS MAEIEG IT UNLAWFUL FCR ANY MANAM CR SUPERINTENDENT OF A HOTEL OR BUILDING TO PERMIT ANY PASSEN- GER ELEVATOR CAB IN SUCH HOTEL OR BUILDING ti TO BE.PUT IN MOTION WITHOUT HAVING THE SAFETY DOOR OR GATE TO SAID PASSENGER ELEVATOR CAR CLOSED AT ALL TnffiS; AND PROVIDING THAT IF ANY PART OF THIS ORDINANCE LS INVALID, SUCH INVALID- ITY SHALL NOT AFFECT THE OTHER PARTS OF THE OR- DINANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEYASt SECTICN 1. It shall be unlawful for any person, firm, or corporation in the City of Corpus Christi to operate, or cause to be operated, an elevator car for the purpose of carrying Passengers, unless said passenger elevator oar is enclosed on all sides, except for the door or gate of said oar, by good and substantial material, and the walls of said oar shall be solid with no openings, except the door or gate of said oar, up to the height of three and one -half (3*) feet, and the said walls above said three and one -half (3j) feet height shall be of good and solid construction, and may be constructed of strong hardware cloth of not more than two -inch mesh, or they may be constructed of vertical steel pieces placed not more than two inches apart. All such elevator passenger oars shall be equipped with a door or safety gate not less tban six (6) feet high, and in case ouch elevator passenger care are equipped with a safety gate, said safety gate shall not have any opening between the vertical pieces comprising said gate, of more than eight (8) inches. SECTION 2. It shall be unlawful for any person in the City of Corpus Christi to,put in motion or came to be put in mo- tion or to keep in motion any passenger elevator car, unless the door or safety.gate of said oar is closed. SECTION 3. It shall be the duty of the managers or super- , intendants of hotels and buildings having passenger elevator care therein to see that the safety doors or gates of all passenger ele- vator oars are closed while said passenger elevator oar is in motion. SECTION 4. It shall be unlawful for any manager or super- intendent of any building or hotel in the City of Corpus Christi, Texas, having passenger elevator oars therein, to permit the said passenger elevator oar to be operated or put into motion without the safety door or gate to said oar being closed at all times while the said passenger elevator car is in motion. SECTION 5. Any person, firm, or corporation which shall violate any provision of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction in the Corporation Court, shall ~ _ be fined in any am not`in excess of Two Hundred ($200.00) Dollars. In case a corporation is the violator of any provision of this ordiaanoa than the president, vice- president, secretary, treasurer, manager, or any agent or employer of suoh corporation shall also be severally liable for the penalties herein proscribed. SECTION 6. That if any part of this Ordinance is or should be hold invalid or unconstitutional for any reason, than that fast shall not invalidate the entire ordinance, but the bal- none thereof shall remain in full force and effect. SECTION 7. This ordinance 'shall be known as the "Passenger Elevator Safety Ordinance of the City of Corpus Christi" and may be ferred to and cited by said name of said ordinance. _ The foregoing ordinance was read the first time and passed to the second reading oa the / O day of 1915, by the following vote: - 2 - Roy L.
