HomeMy WebLinkAbout01841 ORD - 09/15/1945AN ORDINANCE AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON UNDER THE AGE OF SEVENTEEN VRAR3 TO BE ON OR IN ANY STREET, ALLEY, OR PUBLIC PLACE IN THE CITY OF CORPUS CHRISTI DURING CERTAIN HOURS, OR TO BE AT ANY TIME IN ANY PLACE WHERE INTOKICATING LIQUOR IS SOLD; MAKING IT UNLAWFUL FOR ANY PARENT OR PER- SON IN LOCO PARENTIS ENTITIED TO THE CUSTODY OR CONTROL OF ANY PERSON TO VIOLATE THIS ORDINANCE; MA=G IT UNLAWFUL FOR ANY PERSON TO INDUCE, EN- COURAGE OR ASSIST ANY PERSON UNDER SEVENTEEN YEARS OF AGE TO VIOLATE THIS ORDINANCE; MAKING VIOLATIONS A MISDEMEANOR; IMPOSING PENALTIES; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COITUS CHRISTI, TEBAS: SECTION 1. That it shall be unlawful for any person under the age of seventeen (17) years to be on or in any street, alley, or public place in the City of Corpus Christi at any time between the hours of 11:00 p.m. and 6300 a.m.; and it shall be unlawful for any such person at any time to be in any place where intoxicating liquor is sold, whether for consumption on the premises or not. Provided, however, it shall be a defense to any proceeding hereunder that such person was on or in such street, alley, or place in pursuance of the duties of a lawful employment, or was in the company of his or her parent or person standing in loco parentis, or was on or in such street, alley or place as an incident of attendance at a school or church meeting or entertainment, and by permission of his or her parent or person in loco parentis. - SECTION 2. It shall be unlawful for any parent or person in loco parentis entitled to the custody or control of any person under the age of seventeen (17) years to knowingly allow such person under the age of seven- teen (17) years to do any act in violation of this Ordinance. SECTION 3. That it shall be unlawful for any person to induce, en- courage or assist any person under the age of seventeen (17) years to do any act in violation of this Ordinance. SECTION 14. The term "public place" as used herein means any theatre, carnival, show, store, restaurant, soft drink stand, hotel lobby, park, plaza or square, or any other place to which the public is admitted, whether with or without the payment of any consideration for such-Admission. 1'941 SECTION 5• That any person violating any provision of this Ordinenca shall be deemed guilty of a misdemeanor and shall be punished by a fine not exceeding Two Hundred ($200.00) Dollars; provided that any such person falling within the age classification of a delinquent child under the laws of this State shall be proceeded against as a de- linquent child. SECTION 6. That if any part of this Ordinance be held invalid, such invalidity shall not affect the remaining parts hereof, and the City Council declares that it would have passed this Ordinance without such invalid part. SECTION %. The fact that the public health, safety and welfare of the citizens of Corpus Christi, Texas, under the age of seventeen (17) years will be greatly aided by the passage of this Ordinance, creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule providing that no Ordinance or Resolution shall be passed finally on the.date it is introduced, and that such Ordinance or Resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such public emergency and imperative necessity exist, end having requested that such Charter rule be suspended, and that this Ordinance be passed finally on the date of its introduction end take effect and be in full force and effect from and after the fifteenth (15th) day of September, A. For the reasons set forth in the emergency clause of the foregoing Ordinance, a public emergency and an imperative necessity exist for the suspension of the Charter rule or requirement that no Ordinance or Resolution shall be passed finally on the date it is introduced and that such Ordinance or Resolution shall be read at three several meetings of the City Council; 1, therefore, hereby request that you suspend said Charter rule or requirement and pees this Ordinance finally on the date it is introduced, or at the present meeting of the City Council.
