Price, being the owner of all the property abutting on both sides of the street hereinafter more fully described, has petitioned the Mayor end Oity Council of the City of Corpus Christi, Tema to close said street; and WHEREAS, notice of the proposed closing of said street has been given by publication and by mail to the last ]mown address of all property owners abutting said street and within four hundred fifty (450) feet of any portion thereof, purscaat to the provisions of Section 6, Article 2, of the City Charter of the City of Corpus Christi, Texas, and of the hear. A� ing to be held thereon on September 18, 1945 at 4 o'clock p. M. in the ^sp+ Council Chamber 3n the City Ran in Corpse Christi, Tams; and WHEREAS, in accordance with the notice co given and under the Provisions of SsctiOn 8, Article 2 of the City Charter of the City of Corpus Christi, Tema, a public hearing was held by the City Council of the City of Corpse Christi, Texas at 4 o'clock P. M. on September 18, 1945 in the Council Chamber in the Oity Hall in Corpus Christi, Texas; and WHERR a, at such public hearing it was established and determined that the public welfare, convenience, and necessity will be better served by closing said street; ' NOW, TIDE, BE IT•O88AINED BY T3E CITY COUNCIL Op THE CITY OF CORPUS OFMISTIl SECTION 1. That the unnamed street lying between Block Iv and Block V of the Oorpue Beach Hotel Addition to the City of Corpus Christi, and extending for a distance of approximately four hundred eighty -tbres (483) feet, more or less, between Avenue A and Hamilton Road, as shown by plat of said subdivision recorded in Vol. 1, page 51, Map Records of Nuecss County, Texas, said unnamed street lying within the corporate limits of the City of Corpse Christi, Be, and the same .1e= Hereby Closed. 1$ 45 SECTION 2. That the City of Corpus Christi hereby quitclaims to Larkin F. price, being the owner of all the property abutting upon _ said street, all the title or interest i&ich said City may have in said street hereby closed. SECTION 3. The fact that public convenience and necessity will be better served by the immediate closing of the street described in Section 1 of this Ordinance creates a public emergency and imperative public necessity, requiring the suspension of the Charter Rule that no ordinance or resolution shall be passed finally on the date it is interoduced an& that such ordinance or resolution shall be read at three (3) regular meetings of the City Council, and the Mayor, having declared that such public emergency and imperative public necessity exists, and having ree, quested that such Charter Role be suspended and that this Ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY ORDER. Breakers Hotel Corpus Christi, Texas September 5, 1945 To the Honorable Voyor, and City Council, of the City of Corpus Chriutl, Toms; Petition to Close Street The undersigned, Laskin F. Price, of Corpus Christi, respect- fully petitions the I*or and City Council of the City of Corpus Christi to close the street located within the corporate limits of the City of Corpus Christi described as; The un -named street lying between Block 4 and Block 5 of the Corpus Beach Hotel Addition to the City of Corpus Christi and extending for a distance of approximately four hundred eighty -three (483) feet between Avenue A and Hamilton Road, as shown by plat of said subdivision recorded in Volume 1, page 51, Map Records of Huecee County, Texas; and in connection therewith, petitioner represents; 1. Said street was platted and dedicated upon the original plat of the said Corpus Beach Hotel Subdivision which was filed for record on December 8, 1910, but the same has never been opened or used as a street and could serve no useful purpose; in fact, the Breakers Hotel vas built across slid street over thirty (30) years ago and has since that time been continuously used as part of the hotel property. 2. The petitioner, Larkin F. Price, is the sole owner of all of the property which chute on said street, namely, Blocks 4 and 5 of the Oorous Beach Hotel Addition. 11MREFO_RE, petitioner respectfully prays that a date for a public hearing upon this petition be set; that notice of such hearing be published in the official newspaper of the City and in another newspaper of general circulation in the City and that notice of such hearing be mailed to the last known addresses of all owners abutting said street and within four hiadred fifty (450) feet therefrom, and that upon such hearing duly held, all as provided by Section 6, Article 2 of the City Charter of the City of Corpus Christi, Texas, said street be publicly abandoned and permanently closed from public use and all of the rights of the City therein quitclaimed to the abutting property ovmers.
