HomeMy WebLinkAbout01851 ORD - 10/09/1945AN ORDINANCE CANVASSING THE RETURNS AND DECLARING THE RESULTS OF AN ELECTION HELD IN THE CITY OF CORPUS CHRISTI, TEXAS, ON THE 6TH DAY OF OCTOBER, A. D., 1945, UPON THE QUESTION OF ADOPTING AMENDMENTS TO THE CITY CHARTER OF THE CITY OF CORPUS CHRISTI; AND DECLAR- ING AN MORGENCY. VEMM&a, heretofore, on the 28th day of August, A. D., 1945, the City Council of the City of Corpus Christi passed an ordinance r calling an election to be held in said City on the 6th day of October, A. D., 1945, on the propositions set out on the official ballot attached hereto and marked Exhibit "A ", and made a part hereof as though copied herein verbatim; and, WHEREAS, it appears that the requirements of the law as to mail- , ing copies of the proposed amendments to the qualified voters, the giving of proper notice of the Council's intention to pass an ordinance submitting said amendments, and all requirementa of the law respecting the submission of amendments of a City Charter to the qualified voters were in all re- "e spects lawfully and properly performed and executed; and. SAS, notice of said election was accordingly given as re- quired by law, and as directed in the Ordinance calling the election, an J is shown by affidavits properly filed in the Office of the City Secretary; and, WHEREAS, amid election was duly and legally held on the 6th day October, 1945, in conformity with the election ordinance heretofore passed by this Council and the result of said election has been duly certified and returned to this Council by the proper judges and clerks thereof; and, WHEREAS, this Council has canvassed the returns of said election on the propositions hereinabove stated, which was held on the 6th day of October, A. That the propositions to amend the City Charter of the City of Corpus Christi were sustained by a majority of the legally qualified voters in said City, voting in said election, and the City Council of the City of Corpus Christi is hereby authorized to adopt and place in full force and effect the amendments to the City Charter of the City of Corpus Christi, in accordance with the propositions so voted on at said election. SECTION 2. The fact that such amendments change the entire form of Government of the City of Corpus Christi and the fact that such amendments become effective immediately, create a public emergency and public imperative necessity requiring the sus- pension of the Charter rule or requirement that no Ordinance or Reso- lution shall be passed finally on the date it is introduced, and that such Ordinance or Resolution shall be read at three several meetings of the City Council, and the Mayor having declared in writing that such Charter rule be suspended, and that this Ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS, ACCORDINGLY, SO CRDAINED.
