DOCUMENTS All drawings, specifications and other Contract Documents shall be returned to the office of the Architects in an unmutilated condi- tion and without any marks or annotations, on• or before time of delivering proposal. ADDENDA Any addenda issued during the time of bidding shall be Covered in the proposal, and inclosing the contract they will become a part thereof. BONDS The Accepted Contractor shall furnish completion bond satisfactory to the Owner equal to the total amount of the contract as follows for the full protection of the Owner against loss or damage that may be occasioned by mechanic liens or other liens, or by loss of claims on acoount of materials or labor furnished, as security for the due and faithful performance by the Contraotor within the time limit of this contract, the same to be retained by the Owner until the due completion of the whole of the work. Upon the due and faithful performance and fulfillment by the Con- tractor, conditions hereinbefore contained on the part of the Con- tractor to be observed, performed and complied with, the Contractor shall be entitled to have returned to him the bond so deposited by him within six (6) months. PROPOSALS Proposals shall be enclosed in opaque, sealed envelopes addressed to the Architects and marked "Proposals ". No oral, telephonic or telegraphic proposals will be considered. Proposals shall be signed by the bidder, giving business address. In oase of firms or corporations, the proposals must be signed by the authorized officers. Proposals shall be made out on forms provided by the Architects. Give alternate bids as called for in specifications and proposal blanks. -a- G E N E R A L C O N R I T I O N S NOTICE TO BIDDERS All Contractors figuring on this work shall be sure that they understand ell plans, details, apecifioations, and conditions clearly, for each will be bound by all things therein whether . under a partioular heading or not, that in any way affects his portion of the work, should the oontraot be awarded him. PERMITS The Contractor must, at his own expense, obtain all necessary permits, pay all legal fees and comply with all State Building and Sanitary Laws, all municipal rules, ordinances and regula- tions relating to the building and the preservation of the pub - lio health and safety. SITE, QUANTITY SURVEY The Contractor shall visit the site of the proposed work and shall carefully inform himself of the existing conditions, he shall also make a oareful quantity survey of the plans, and shall bear in mind all notations etc., on the same and shall be fully bound by all things contained in plans and these speoifications. He shall verify all measurements etc., on plans, before starting work. 4PPLICATION OF CONDITIONS The Conditions and clauses, printed as well as written, shall apply to all branohes of the work with an equal foroe, whether the work is done under one general contract, or several separate ones. KINDS OF MATERIAL The Contractor shall provide for all labor, scaffoldings, appli- ances, etc., necessary for the proper execution of the various portions of the work. The materials unless otherwise specifically agreed upon, shall be new, and together with the workmanship, shall be the best of their respective kinds for the uses intended, and shall be at all times, subject to the inspection of the Architects for rejection or approval. The Owner will provide materials as agreed upon. RUBBISH REMOVED The Contractor shall from time to time as directed by the Archi- tects, remove all rubbish from the building, shall clean out the entire building to the satisfaotion of the Architects. -b- FOREMAN The Contractor shall give the work his personal attention and be on the job a sufficient time to keep in close touch with the progress of construction. If a foreman is employed he Shall be a competent general foreman, with authority to act, and any in- structions given such foreman by the Architects, shall be consid- ered in the absence of the Contraotor, as having been given him. TENDERS In the reception of tender of bond on the work, the Owner inours no obligation to accept the lowest or any bid. Each bid shall be constructed to cover all the work finished oomplete, ready for occupancy, unless otherwise instructed. SPECIFICATIONS AND DRAWINGS The drawings and these specifications are intended to describe and provide for a finished piece of work. They are intended to be co- operative, and what is called for in one, is as binding as if oalled for in both. The Contractor will understand the work is to be completed in every detail, notwithstanding every item necessarily involved to be not particularly mentioned. The Contraotor will understand that he will be held to provide all materials and labor necessary for the entire completion of the work intended to be described and shall not avail himself of any manifestly unintentional error, or omission, should any exist. Should there be any error or inconsistence in the draw- ings or specifications, the Contractor, before proceeding with the work, shall make the mention of same to the Architect for adjustment. In no case shall the Contractor prooeed with the work in unoertainty. DETAILED INSTRUCTIONS Should it appear that the work hereby intended to be done, or any of the matter relative thereto are not sufficiently detailed or explained in the drawings or in these specifications, the Contraotor shall conform to the Additional explanations or draw- ings. In the event of any doubt or question arising respecting the drawings and these specifications, reference shall be made to the architects whose decision shall be final and conolusive. No alibied oral admission, condition or inadvertent neglect on the part of the architects will be accepted as an exouse for bad work. MEASUREMENTS Preference shall be given to figured dimensions on the drawings rather than to measurements scale. The figures witnessed by arrowheads, unless otherwise explained, are intended to represent -0- exact measurements. It is understood that the Contractor shall make such slight alterations as may be necessary to make ad- justed parts finished ones, without extra charges, leaving all oomplete and in proper shape when done. It shall be the duty of the Contractor to verify all dimensions shown on the draw- ings and report any error of inconsistency to the Architects be- fore beginning work. COPIES FURNISHED Unless otherwise provided in the Contract Doouments.the 'lrohi- teots will furnish to the Contractor, free of charge, all copies of drawings, and specifications reasonably necessary for the exeoution of the work. SHOP DRAWINGS The Contractor shall submit with such promptness as to cause no delay in his own work or in that of any other Contractor, two copies of all shop or setting drawings and schedules re- quired for the work of the various trades, and the Architects shall pass upon them with reasonable promptness. The Contractor shall make any corrections required by_the Architects, file with him two corrected copies and furnish suoh other copies as may be needed. The Architects' approval of such drawings or schedules shall not relieve the Contractor from responsibility for deviations from drawings or specifications, unless he has in writing called the Architects' attention to such deviations at the time for sub- mission, nor shall it relieve him from responsibility for errors of any sort in shop drawings or sohedules. DRAWINGS AND SPECIFICATIONS OF THE WORK The Contractor shall keep one copy of all drawings and speoifi- oations on the work, in good order, available to the Architects and to his representative. SAMPLES The Contractor shall furnish for approval all samples as direct- ed. The work shall be in accordance with approved samples. CHANGES IN THE WORK The Owner, without invalidation of the Contract, may order extra work or make changes by altering, adding to or deducting from the work, the Contract sum being adjusted aocordingly. All suoh work shall be executed under the oonditions of the original con- tract except that any claim for extension of time caused thereby shall be adjusted at the time of ordering such changes. -d- MUTUAL RESPONSIBILITY OF CONTRACTORS Should the Contractor cause damage to any other Contractor of the work, the Contractor agrees, upon due notice, to settle with such Contractor by agreement or arbitration, if he will so settle. If such other Contractor sues the Owner on account of any damage alleged to have sustained, the Owner shall notify the Contractor who shall defend such proceedings at the Owner's expense and if any judgment against the Owner arises therefrom the Contraotor shall pay or satisfy it and pay all costs in- curred. SUB - CONTRACTORS The Contractor shall, as soon as practicable after the signa- ture of the Contraot, notify the Architects in writing of the names of the subcontractors proposed for the principal parts of the work and for such other as the Architects shall direct and shall not employ any that the Architects may within a reasonable time object to as incompetent or unfit, If the Contraotor has submitted before signing the Contract a list of subcontractors and the change of any name of such list as required in writing by the Owner after signature of agree- ment, the contract price shall be increased or diminished by the difference in cost occasioned by such change. The Archi- tects shall, on request, furnish to any subcontractor wherever practical, evidence of the amounts certified on his account. The Contractor agrees that he is as fully responsible to the Owner for the acts and omissions of his subcontractors and of persons either directly or indirectly employed by them, as he is for the aots and omissions of persons directly employed by him. Nothing contained in the Contract Documents shall create any contractual relation between any subcontractor and the Owner. RELATION OF CONTRACTOR AND SUBCONTRACTOR The Contractor agrees to bind every subcontractor and every subcontractor agrees to be bound by the terms of the agreement, the General Conditions, the Drawings and Specifications as far as applicable to his work, including the following provisions of this approved in writing as adequate by the Owner or Archi- tects. This does not apply to minor subcontractors. ARCHITECTS' STATUS The Architect shall have general supervision and direotion•of the work. He is the agent of the Owner only to the extent pro- vided in the Contract Documents and when in special instances as he shall, upon request, show the Contractor written auth- ority. He has authority to stop the work whenever such stop- page may be necessary to insure the proper eabcecution of the Contract. As the Architects in the first instance, the inter- preter of the conditions of the Contract and the judge of it performance, they shall use their powers under the dontraot to enforoe its faithful performance by both. In giving instructions, the Arohiteota shall have authority to make minor changes in the work, not involving extra cost, and not inconsistent with the purpose of the building, but other -. wise, except in an emergenoy endangering life or property, no extra work or change shall be made unless in pursuanoe of a written order from the Owner signed or countersigned by the Architects or a written order from the Architects stating that the Owner, has authorized the 'extra work or change and no claim for an addition to the contract sum shall be valid unless 80 ordered. The value of any such extra work or change shall be determined by estimate and acceptance in a lump sum. THE OWNER'S RIGHT TO WORK If the Contractor should neglect to prosecute the work properly or fail to perform any provision of this contract, the Owner, after three days written notice to the Contractor, may with- out prejudice to any other remedy he may have make good such deficiencies and may deduct the cost thereof from the payment then or thereafter due the Contraotor; provided, however, that the Architects shall approve both such action and the amount oharged to the Contraotor. APPLICATION FOR PAYMENTS The Contractor shall submit to the Arohiteots an application for each payment, and if required, reoeipts or other vouchers showing his payments for materials and labor, inoluding pay- ments to subcontractors. CERTIFICATES OF PAYMENTS . If the Contractor has made application as above, the Architects shall, not later than the date when each payment falls due, issue to the Contraotor a oertifioate for such amounts as he decides to be properly due. No certificate issued nor payment made to the Contraotor, nor partial or entire use or occupancy of the work by the Owner shall be an acceptance of any work or material nor in accor- dance with this contract. The making and acceptance of the Owner, other than those arising from unsettled liens, from faulty work appearing after final payment or from requirement of the specifications, and of all claims by the Contractor except those previously made and still unsettled. Should the Architects win an award by arbitration, upon demand when due, the Contractor shall receive, in addition to the sum named in the certificate, interest thereon at the legal rate in force -f- at the place of building. PAYMENTS WITHHELD The Architects may withhold or, on account of subsequently dis- covered evidence, nullify the whole or a part of any certificate to suoh extent as may be necessary to protect the Owner from lose on account of: (A) Defeotive work not remedied. (B) Claims filed or reasonable evidence indioating prob- able filing of claims. (C) Failure of the Contractor to make payments properly to suboontraotors or for material or labor. (D) A reasonable doubt that the Contract can be completed for the amount unpaid. (E) Damage to another Contractor. When the above grounds are removed payment shall be made for amounts withheld because of them. CONTRACTOR'S LIABILITY INSURANCE The Contraotors shall maintain such insurance as will protect him from claims under Workmen's Compensation Acts and from other claims for damage or personal injury, inoluding death, which may arise from operations under this Contract, whether such operations be by himself or by any subcontractor or anyone dir- ectly or indirectly employed by either of them. Certificates for such insurance shall be filed with the Owner, if he so re- quires, and shall be subject to him for approval for adequacy of protection. DAMAGES If either party to this Contract should suffer damages in any manner because of any wrongful act or neglect of the other party or of anyone employed by him, then he shall be reimbursed by the other party for such damage. Claims under this clause shall be made in writing to the party liable within a reasonable time at the first observance of such damage and not later than the time of final payment, except as expressly stipulated otherwise in the case of faulty work or materials, and shall be adjusted by agreement or arbitration. LIENS Neither the final payment nor any part of the retained percent- age shall become due until the Contractor, if required, shall - deliver to the Owner a complete release of all liens thereof and if required in either case, an affidavit that as far as he has knowledge or information the releases and receipts inolude all labor and material for which a lien could be filed, but - g- the Contractor may, if any subcontractor refused to furnish a release or reoeipt in full, furnish a bond satisfactory to the Owner, to indemnify him against any liens. If any lien remains unsatisfied after all payments are made, the Contractor shall refund to the Owner all money that the latter may be com- pelled to apply in discharging such a lien inoluding all costs and a reasonable attorney's fee. ARCHITECTS' DECISIONS The Architects shall, within a reasonable time, make decisions on all olaims of the Owner or Contractor and other matters re- lating to the execution and progress of the work or the inter- pretation of the Contract Documents. The Architects' decision in matters relating to artistic effects shall be final, if within the terms of the Contract Documents. Except as above or as otherwise expressly provided in the Con- tract Documents, all the Architect's decisions are subject to Arbitration. ARBITRATIONS All questions subject to arbitration under this Contract shall be submitted to arbitration at the choice of either party to the dispute. The Contractor shall not cause a delay of the work during any arbitration proceedings, except by agreement with the Owner. The demand for arbitration shall be filed in writing with the Architects in the case of an appeal from his deoision, within ten days of its reoeipt and in any other case within a reasonable time after oause thereof and in no case later than the time of final payment, except as otherwise ex- pressly stipulated in the Contract. If the Architects fail to make a deoision within a reasonable time; as stipulated in the Contract, an appeal to arbitration may be taken as if his decision had been rendered against the party appealing. No one shall be nominated as arbitrator who is in any way finan- cially interested in this Contract or in the business affairs of either the Owner, Contractor or Architects. Unless otherwise provided by controlling statutes, the partdes may agree upon one arbitrator, otherwise there shall be three, one named in writing, by each party to this Contract, to the other party and to this Architect and the third is chosen by these two arbitrators. If there be one arbitrator his decision shall be binding; if three, the deoision of any two shall be binding. Such decision shall be permitted by law; it may be filed in court to carry it into effeot. The arbitrators, if they deem that the case demands it, are authorized to award to the party whose contention is sustained such sums as they shall appeal and, if the appeal was taken without reasonable cause, damages for delay. The Arbitrators shall fix their own compen- sation, unless otherwise provided by agreement, and shall as- sess the costa and charges of the arbitration upon either or -h- both parties. The award of the arbitrators shall be in writing and it shall not be open to objeotion on account of the form of the proceeding or the award, unless otherwise provided by the Controlling statutes. CASH ALLOWANCE The Contractor shall enclose in the Contract Sum all allow - anoea named in the Contraot Documents and shall cause the work covered to be done by such oontraotors and for suoh sums as the Architects may direct; the Contractor declares that the Con- tract sum inoludea such sums for expenses and profit on ac- count of cash allowanoes as he deems proper. No demand for expenses or profit other than these included in the Contract Sum shall be allowed. The Contractor shall not be required to employ for any such work persons against whom he has a reasonable objection. USE OF PREMISES The Contractor shall confine his apparatus, the storage of ma- terials and the operations of his workmen to limits indicated by law, ordinances, permits or directions of the Architects and shall not unreasonably encumber the premises with his materials. The Contractor shall enforoe the Architects' instructions re- garding signs, advertisements, and fires. The Contraotor shall protect shrubbery and lawns as directed by the Architects. CUTTING, PATCHING AND DIGGING The Contractor shall do all cutting, fitting, or patching on his work that may be required to make its several parts done together properly and fit to receive by work of other Contract- ors, shown upon, or reasonably implied by the Drawings and Specifications for.the completed structure, and he shall make good after them as the Architects may direct. Any cost caused by defective or ill -timed work shall be borne by the party responsible thereof. The Contractor shall not endanger any work by cutting, digging, or otherwise, and shall not cut or alter the work of any other Contractor save with the consent of the Architects. CLEANING UP The Contractor shall at all times keep the premises free from accumulations of waste material or rubbish caused by his em- ployees or work, and at the completion of work he shall remove all his rubbish from and about the building and all his tools, scaffolding, and surplus materials, and shall leave his work "Broom Clean" or its equivalent, unless more exactly specified. In oase of dispute the Owner may remove rubbish and charge the -1- cost to the several Contractors as the Architects are deter- mined to be just. EXAMINATION OF PREMISES Before submitting proposals for this work, each bidder will be held to have examined the premises and satisfied himself as to the existing conditions under which he will be obliged to operate in performing his part of the work, or that will in any manner affeot the work under this contract. No allowance shall be made subsequently in this connection, in behalf of the Contractor for any error or negligence on his part. S P E C I A L C O N D I T I O N S 'These Special Conditions and General Conditions of the A.I.A. hereby become a part of this specification. LOCATION OF SITE The location of the building on the lot shall be as shown on plot plan. SCOPE OF WORK Unless otherwise specified, the Contractor shall supply all labor, transportation, materials, apparatus, fuel, energy, light, scaffolding and tools necessary for the entire, proper and substantial completion of his work; and shall install, main- tain and remove all equipment of the construction and other utensils or things, and be responsible for th6 safe, proper and lawful construction, maintenance and use of same; and shall construct in the best and most workmanlike manner, a complete building and everything properly incidental thereto as shown on the plans, stated in specifications or reasonably implied therefrom, all in accordance with the Contract Documents. LAYING OUT BUILDING The General Contractor shall employ an experienced and compe- tent civil engineer, cause him to establish a permanent bench to which easy acoess may be had during the progress of the work, to determine all lines and grades and to verify same from time to time during the progress of the work and shall keep on the job at all times a complete level, keep same in good working condition and allow the Architects unrestricted use of same at all times. TEMPORARY OFFICES Each Contractor shall provide his own office on the premises, maintain same and remove same when directed. -j- STORAGE SHEDS, ETC. The General Contractor shall provide on the premises where di- rected, shall maintain same in good condition and shall remove same when directed, suitable,substantial,watertight storage sheds in which he shall store all materials which would be dam- aged by the weather. WATER FOR BUILDING WORK The General Contractor shall provide and pay for all water re- quired in the building work. SANITARY ARRANGEMENTS The General Contractor shall at the beginning of the work pro- vide on the premises where directed, a suitable temporary con- venience and enclosure for .the use of all workmen on the job, shall maintain same in a sanitary condition and remove same and all its contents at the completion of the building and when directed by the Architects. ELECTRICAL ENERGY The General Contractor shall make all necessary applications, pay all fees, and charges, obtain neoeseary permits and pro- vide and maintain electrical energy for power, light, as re- quired for surfacing machines on wood, terrazzo or other items of construction, and as neoessary for providing and maintain- ing artificial light in the progress of any branch of the work. PROTECTIONS The General Contractor shall take over and assume all respon- sibility for the entire premises, maintain all protections and provide and`maintain all additional protections as required by the Architects and the governing laws, rules, regulations and ordinanoes. •?111 shall be responsible for any loss or damage caused by him or his workmen to the property of the Owner or to the work or materials of the other Contractors or sub -con- tractors and shall make good any loss, damage or injury with- out oost to the Owner. The General Contractor shall carefully protect all trees, shrubs, hedges, walks, lawns so indicated on the 'plans not speoified as being removed from injury during building work and pay for all damage to same resulting from insuffioient or improper protec- tion. The General Contractor shall, at his own cost, settle and dis- charge all claims made against the Owner and shall indemnify and save harmless the Owner from loss and damage from claims made by adjoining Owners, on account of work done under this contract. - -k- All protections and methods of protection shall at all times be subject to the approval of the Architects and shall be main- tained until the completion of all work under this contract. INSURANCE Each Contractor shall secure and protect the Owner from liabil- ity whatsoever for injury to any person or persons or property. Eaoh Contractor shall take out immediately on starting the work and shall maintain for the benefit and protection of the Owner, an Owner's Contingent Liability insurance policy in the limits of 45,000.00 (Five Thousand Dollars) for injury to one person. The policies shall be in form, and in all other respects sat- isfactory to the Owner. Evidence that such insurance is in force shall be submitted to the Architects immediately upon the sign- ing of the Contract by either producing the policies to the Ar- chitects for inspection, or the Liability Company's usual form of certificates. Said policies and certificates shall certify, among other things, that the insuranoe will not be oanoelled or lapsed during the progress of the work covered by specifica- tions. Each Contractor shall protect his work against loss by fire, ex- plosion and tornado. The Contractor's interests shall consist only of all labor and materials which he may have put into the building, and for which he has not been paid, and the Owner's interest shall consist only of all labor and materials in the building for which he shall have paid. Building materials, contractor's equipment etc., may be stored on the premises, but the plaoing of same shall be subject to the approval of the Architects. When any room in the building is used as a shop, storeroom etc., the one making use of such room will be held responsible for any repairs, patching or cleaning arising from such use. Each Contractor shall protect and be responsible for any damage to his work or material, from the date of the agreement until the final payment is made, and shall make good without cost to the Owner, any damage or loss•that may occur during this period. Each Contractor shall handle all material as directed, so that it may be• inspected by the Architects. All cement, lime, gypsum blocks and other material affeoted by the weather shall be covered and protected to keep them free from damage while they are being transported to the site. Should any material be found defective or in any way contrary to the contract, this material, no matter in what stage of com- pletion, may be rejected by the Architects and shall be removed from the premises at once. OTHER CONTRACTORS Each Contractor shall allow the Owner or anyone employed by him directly or indirectly, whether union or non - union, in the building or about the premises at all times. The Architects and their representatives shall, at all times, have access to the work wherever it is in proparation or pro- gress and each Contractor shall provide proper and safe facili- ties for such aocess and for inspection. The Owners may maintain inspectors on the job in addition to the Architects, for the purpose of inspecting materials, methods and character of the work or equipment and these inspectors will deal with the Contractor only through the Architects. COOPERATION OF OWNER The Owner shall have the right to take possession of and use any completed or partially completed portions of the structure -m- of work notwithstanding the time for completing the entire work or such portions as may not have expored; such possession and use shall not be an acceptance of the work taken or used. If such prior use increases the cost of the work or delays its completion, the Contractor shall be entitled to extra compensa- tion or extension of time, or both. The Contractor's claim for such extra compensation shall be in writing, with vouchers and other supporting data attached. • ORDER OF WORK If, in the judgment of the Architects, it becomes necessary at any time during the erection of this building in order to ac- celerate the work, each Contractor or sub - contractor, when or- dered and directed by the Architects, shall cease work at any particular point and transfer his men to such point or points, and execute such portions of his work as may be required, to enable others to hasten and properly engage and carry on their work, all as directed by the Architects. Within one week after the Contractor has been notified by the Architects that he has been awarded the contract, he shall sub- mit to the Architects, a schedule of operations giving the date that each part and branch of the work will be started and fin- ished. He shall also keep a record of progress, covering eaoh part of the work and submit two copies to the Architects every two weeks. This schedule shall be made in such form as will meet with the approval of the Architects. TIME OF COMPLETION The work is to be carried to completion with utmost speed. Before signing the contract, a definite time schedule shall be prepared by each Contractor, to which he shall work and of which he shall immediately furnish the Architects a copy. The date of completion shall be not later than the numbers of .days stipulated in the Contract. If, in the opinion of the Architects, it becomes necessary for maintaining the schedule and for the completion of the build- ing within a specified time, to work after regular hours or on holidays, Contractors must immediately do so upon request with- out additional cost to the Owner. RESPONSIBILITY The General Contractor assumes entire responsibility, shall be responsible each for his own work and every part thereof, and all work of every description used in connection therewith. He shall specifically and distinctly assume and does so assume all risks of damage or injury from whatever cause to property or persons used or employed on or in connection with his work. and of all damage or injury from any cause to property or per- -n- sons or property wherever located, resulting from any connec- tion with his work, and undertake and promise to protect and defend the Owner against all claims on account of any such dam- age or injury. Each Contractor will be held responsible for the execution of a satisfactory and complete piece of work, in accordance with the true intent of the drawings and specifications, Me shall pro- vide, without extra charge, all incidental items required as a part of the work, even though not particularly specified nor indicated, and if he has good reasons for objecting to the use of any material, appliances, or methods of constructions as shown or specified, he shall make report of such objection to the Architects and obtain proper adjustment before the Contract is made, and shall proceed with the work, only with the under- standing that a satisfactory job will be required. MATERIALS AND WORKMANSHIP Unless otherwise specified, all materials shall be new and both workmanship and materials shall be of good quality. Each con- tractor shall, if required, furnish satisfactory evidence as to the kind and quality of his materials and workmanship. Each Contractor shall submit samples of materials, finish, ap- pliances etc., when required by the Architects and all such sam- ples must be approved by the Architects in writing before the work is executed and all work shall conform in all respects to the approved samples. Any work which does not conform to the approved samples will be rejected and shall be removed and re- placed by work that does so conform. In case samples submitted are not approved, others shall be submitted until satisfactory samples have been approved. Each Contractor shall make such tests as may be required to show that the requirements of the specifications have been ful- filled. All tests shall be made under the supervision and di- 'reotion of the architects and each Contractor shall provide all necessary materials, labor, apparatus, etc., properly prepared, adjusted and run, before the .Architects are asked to inspect same. EXTRAS Bills for extras will be allowed only when work is ordered in writing. No bills, based upon verbal orders, will be considered by these - Architects unless a000mpanied by written order from the Architects. APPROVAL OF MATERIALS Contractors shall make written request to the Architects for, and obtain their approval of the use of any materials, construc- -o- tion, etc., other than those mentioned as standards in the speci- fications, or indicated on the drawings and of materials, con- struction etc., proposed for use when "approved materials" or work are specified without mentioning any standard by name. Contractors shall make such request within five days after con- tract is signed, and before ordering any material or work re- quiring approval by the Architects. REPORTS On the 1st and 15th of each month the Contractor shall furnish Architects a correct report in triplicate, giving the following information regarding the work during previous period: List of materials delivered to the site, stating name of brand, quality and amount of same. List of material built in place. Statement giving the condition, general progress of the work and the percentage of each brand of the work that has been finished. Statements giving general progress of the work that is being done away from the site and approximately when it will be finished and delivered. These reports shall be made in such form as directed by the Architects and as will meet with their approval. In addition to the above reports, the Contractor shall furnish the Archi- tects, before the first payment becomes due, a correct state- ment showing estimated cost of each part of the work as sub- divided in the specifications, the total equaling the contract price. This statement shall be for the use of the Architects, at their discretion, in preparing estimates for payments on account. GUARANTEE The General Contractor shall guarantee his work for a period of one year from the date of acceptance by the Architects and shall leave the work in perfect order at completion, and neither the final certificate or payment nor any provision in the Con- tract Documents shall relieve the Contractor of the responsi- bility for negaigence or faulty materials or workmanship within the extent and period provided by law and upon written notice he shall remedy any defects due thereto and pay all expenses for any damage to other work resulting therefrom.
