Ray Kring • Mayor Jason Luby called the meeting to order in the Council Chamber of the City Hall, stating the purpose of the Special Meeting was to hold public hearings on zoning applications and any other business as may properly come before the Council. City Manager Townsend presented Application #574-2, H. E. Savoy, for change of zoning from "R -1B" One -family Dwelling District to "R-2" Multiple Dwelling District on Lots 10 & 11, Block 12, Flour Bluff Park, locatedon the east side of McDonald Street south of Matlock Street. The request was heard by the Planning Commission May 21, 1974, and forwarded to the Council with the recommendation that it be approved as a logical extension of the present "R-2" zoning to the north. The Planning Staff concurred in this recommendation. Mr. Townsend pointed out that this tract of land is located in Noise Zone #1 and there are no noise problems. No one appeared in opposition to the recommendation of the Planning Commission. Motion by Lozano, seconded by Branch and passed, that the hearing be closed. Motion by Stark, seconded by Ricardo Gonzalez and passed, that the recom- mendation of the Planning Commission be concurred in and Application #574-2, H. E. Savoy, for change of zoning from "R -1B" One -family Dwelling District to "R-2" Multiple Dwelling District on Lots 10 & 11, Block 12, Flour Bluff Park, be approved and an ordinance be brought forward effectuating the change. City Manager Townsend presented Application #C574-3, City Planning Com- mission, for change of zoning from "B-1" Neighborhood Business District to "B-4" General Business District on Lots 1 & 2, Block A; Lots 1, 2 and 3, Block B, Manor Terrace and a portion (351.30' front by 260' depth) of Lots 8 and 9, Gnegy Addition, located on both sides of South Padre Island Drive at Manor Drive. The request was heard by the Planning Commission on May 21, 1974, and forwarded to the Council with • Minutes Special Council Meeting June 19, 1974 Page 2 the recommendation that it be approved as a logical extension of "B-4" zoning in the area. The Planning Staff concurred in this recommendation. He reported that two letters had been received since the Commission hearing in favor of the application. No one appeared in opposition to the recommendation of the Planning Com- mission. Motion by Branch, seconded by Lozano and passed, that the hearing be closed. Motion by Ricardo Gonzalez, seconded by Acuff and passed, that the recom- mendation of the Planning Commission be concurred in and Application #C574-3, City Planning Commission, for change of zoning from "13-1" Neighborhood Business District to "B-4" General Business District on Lots 1 & 2, Block A; Lots 1, 2 and 3, Block B, Manor Terrace and a portion (351.30' front by 260' depth) of Lots 8 and 9, Gnegy Addition, be approved as requested, and an ordinance be brought forward effectuating the change. City Manager Townsend presented Application 4574-4, Seymour Mendell, for change of zoning from "R -1B" One -family Dwelling District and "R-2" Multiple Dwelling District to "A-2" Apartment House District on 13.2 acres out of Lots 17 and 18, Section 28, Flour Bluff and Encinal Farm and Garden Tracts and Lot 9, Block 2, Greenway Gardens 12, located south of Sparkle Sea Drive and east of Rodd Field Road. The request was heard by the Planning Commission May 21, 1974 and forwarded to the Council with the recommendation that it be denied, but in lieu thereof "A-1" Apart- ment House District be approved on that portion of the subject property presently zoned "R-2" and that "R-2" Multiple Dwelling District be approved on that portion zoned "R -1B" Single-family Dwelling District. It was the Planning Staff's opinion that "A-2" should be denied and that the portion presently zoned "R-2" should remain so zoned, but that the portion zoned "R -1B" should be zoned "R-2" also, which would provide a buffer between the single-family development to the north and "A-2" to the south. Chief Planner Larry Wenger pointed out the location of the property on the land use map and explained that there are four stub -end streets indicated on the existing filed plat which are built and there is a problem of tying these streets into the future development. He stated the Staff recommends that some of these streets connect into the area of request since there is presently only one access to Rodd Field Road road (that being Sparkle Sea Drive),/which would not be adequate to serve the single- • Minutes Special Council Meeting June 19, 1974 Page 3 family area. He further stated that it is the Staff's opinion that approval of additional "A-2" zoning would place an undue concentration of population in this area in view of the "A-2" zoning already existing. The applicant was not present to present a plan, and no one appeared in opposition to the foregoing request. Motion by Acuff, seconded by Lozano and passed, that the hearing be closed. Motion by Stark, seconded by Acuff And passed, with Luby voting "Nay", that the recommendation of the Planning Commission be concurred in and Application #574-4, Seymour Mendell, for change of zoning from "R -1B" One -family Dwelling District and "R-2" Multiple Dwelling District to "A-2" Apartment House District on 13.2 acres out of Lots 17 and 18, Section 28, Flour Bluff and Encinal Farm and Garden Tracts, and Lot 9, Block 2, Greenway Gardens #2, be denied, but in lieu thereof "A-1" Apartment House District be approved on that portion of the property presently zoned "R-2" and that "R-2" Multiple Dwelling District be approved on that portion zoned "R -1B" Single-family Dwelling District, and an ordinance be brought forward effectuating the change. ORDINANCE NO. 12137 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF H. E. SAVOY BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOTS 10 AND 11, BLOCK 12, FLOUR BLUFF PARK, SITUATED EN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "R-114" ONE FAMILY DWEILING DISTRICT TO "R-2" MULTIPLE DWELLING DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. The Charter Rule was suspended and the foregoing ordinance was passed by the following vote: Luby, Acuff, Branch, Tom Gonzales, Ricardo Gonzalez, Lozano, Sr., and Stark, present and voting "Aye". ORDINANCE NO. 12138 AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CITY OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON LOTS 1 AND 2, BLOCK A; LOTS 1, 2 AND 3, BLOCK B, MANOR TERRACE, AND A PORTION OF LOTS 8 AND 9, GNEGY ADDITION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "B-1" NEIGHBORHOOD BUSINESS DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. There being no further business to come before the Council, the Special Meeting was adjourned at 4:50 p.m., June 19, 1974,
